  1. hi all! so here my thing.. we are preparing our documents for the affidavit of support, my mom will provide her income tax for us, but she said to me that she only have her "green card" and told me that she only have an immigrant status, im worried that this will cause a problem for us, i can't provide yet for the affidavit bec. i just graduated march of 2010 and still unemployed, i just took my licensing exam 2 days ago and waiting to see if i passed..hopefully. :unsure: will anyone give me a piece of advice on what to do? thanks in advance!

  2. I am asking maganda those questions because I am trying to determine if there were other factors involved in the visa approvals of her friends. It just seems to me that there must be more to the story of their visa approvals than simply submitting an I-134 from a cosponsor.

    hmm.. i just hope that im not in a bad situation right now, we would just talk to our atty. after all he is the one who approved before pushing this through.. thankyou for your time tahoma i really do appreciate it! :thumbs:

  3. It would be very helpful if Lorenzo got a job, any job, before his fiancée's interview. Even if he worked for only a couple of months at a job which put him on a trajectory to earn over 125% of the poverty line for his household size and the area he lives in, his fiancée would stand a much better chance of a visa approval. This is one way he could do it on his own, and would not have to rely solely on whether Manila would accept his cosponsor (and approve the visa too).

    Even though the consular officer will take into account Lorenzo's education, employment potential, his fiancée's potential, and other factors, I fear that he will run into trouble because he simply has had no income whatsoever. I've not seen a case in Manila that's been approved under these same circumstances.

    hello Tahoma!, that's what i fear also that i will get into trouble if the consul. would know that i don't have any job experience,income whatsoever, im really trying to finish this nclex and go for a visit to my dad at least 1month then comeback maybe get a part time job while finding an opening, im pretty sure my mom will help me find a job since she is also a nurse, im just hoping that for now things would go well..

  4. Something that I do not think any other member has yet mentioned is that the OP is studying for his NCLEX, therefore presumably soon he will be able to get a job as a registered nurse and meet, on his own, the poverty guidelines.

    OP, how soon will you become a registered nurse? Perhaps by the time your petition gets approved by USCIS you can get your job as an RN and show your recent pay in your affidavit, along with your mother's co-sponsoring (just in case).

    hi Aztec&Taino!, im on the last lap of my review and my target for taking the exam is coming late dec or early next year, i just feel more pressured to finish this damn test and get a job, but taking the nclex is not that easy i have to be 100% ready when i take the test besides its to expensive to register for the exam, also my mom said that i dont have to get a part time job i just need to focus on my exam, after this i would have to go to texas to visit my dad so i can't get a job real soon, maybe early next year, i just hope the consulate would consider if ever the interview comes...

    you haven't yet received NOA1 from USCIS?

    NOA1 does that mean the receipt no. or something? because that just the mail the i got..

  5. hello! i am on k1 visa too and still waiting for our noa2.My fiance has a job but it does not meet the required income needed for a household of three.I was so worried that i will not be granted a visa during the interview in Manila because of this matter.But 2 of my friends who are now in US assured me that it is not a problem since i can get a cosponsor.My 1st friend's fiance was working in the phils so he did not file taxes in US, so he couldnt provide a tax return which is a requirement in form 134.So he asked his mom as cosponsor and the form she filled up was the one showed during the interview.And there wasnt a problem.She was granted a visa and as i said she is now in US.My 2nd friend was also petition thru k1 with a cosponsor.His fiance lost a job and so he asked his mom as co sponsor.

    So i wonder where u read that post that says cosponsor is not allowed in Phil.Immigration..

    i have read on lots of sites and also some forums,i just don't remember, think repression is setting in lol, anyway im happy to hear your story and be re assured by your friends who have passed this, also knowing that im just not the only one going thru this situation, as for me im still waiting for the consulate to reply on our petition its been 3mos since we mailed the application but there is no single mail yet, :( i can't wait to be with my fiance i miss her already, 4 yrs of my life(college) we've been together this is the only time were been separated for tooo long! but were here and all we have to do is wait and pray ofcourse, thanks and godbless! :D

  6. hello SimplyMacy!, im so glad to hear your thoughts about our case, it really took away my anxiety, i will talk to my mom about that I-186 form and talk to our atty. about this matter, im disappointed that our atty didn't explain this situation to us before pushing through the application, :angry: i hope that the consul in the philippines would understand our situation and approve our case, :D by the way, i think our family really is inline with nursing including my mom, my brother although he's a CNA and my stepfather, my father, my stepmom, me and my fiance, :rofl:, thanks for sharing your toughts! it really helps! god bless! :thumbs:

  8. Do some reading in the Philippines regional forum to learn from people going through Manila. The acceptance of joint sponsors for K visas is not a given. Close relatives of the petitioner seem to be preferred. Also, if the petitioner is a recent college grad and/or just joined the workforce (and thus are seen to have good earning potential ahead of them) the joint sponsor is more likely to be accepted.

    Also, be sure to check with the embassy before using forms that are not listed as being requested. You don't want to incur a delay while you get a joint sponsor in the US to send the proper form.

    hello Anh map!, yes i will go to the regional forum to have more info,im just worried because after reading lots of forums on the net i knew that only the phil. immig. doesn't approve co sponsors, yes we are both recent college grad.(march 2010,both nurses) i hope they will consider our situation bec. i cant stand being away from my fiance for a long time. also my mom is more than willing to provide all our needs even my father even if they are divorced who is also a nurse,i hope our situation will not be grounds for denial to our petition. thankyou and godbless! :lol:

  9. The I-864 is binding. The I-134 isn't.

    Check the USCIS website to locate the form and it's instructions. It's more involved than the I-134 but they're more likely to take it seriously if you include it.

    There's definitely a CHANCE that you'll be approved this way... but there's still also the chance you won't. Usually they allow it for students because the reason they aren't earning money now is to have a better earning potential later.

    thanks for the advice Vanessa&Tony, i will check with our attorney tommorow about this situation, im just really concerned that im in this situation, and our atty didn't bring this stuff up and explaining the possible situations for denials such as this, thanks for the help! god bless!! :thumbs:

  10. they will occasionally accept a co-sponsor for K1 if the co-sponsor signs an I-864 and because the petitioner doesn't have income because they are or were a student.

    hello Vanessa&Tony!, thanks for the reply, does this mean that we have a chance to get approved on our petiton based on our situation? i haven't talked yet to our atty. about this matter and i will try to contact him as asap, i just want to have some opinions hopefully positive to relieve my anxiety. by the way what is this "I-864", sorry for the trouble of asking, thanks in advance! :D

  11. hello!, im new to this site and i think it can help me on my k1 visa issue, if somebody can help me to give some advices for my k1 visa it would be much appreciated! so here is my situation, i am a 20y.o filipino american citizen just came here in C.A last may after my graduation as a nurse and now currently reviewing for NCLEX. i decided to get a k1 visa for my finance(4yrs relationship) who is also a nurse graduate and recently passed the board exams, because it doesn't make sense if she would still stay there now that i am here and we can't stand to be separated for a longtime. :( as i browsed the internet i knew that PHILIPPINE IMMIGRATION doesn't accept a CO-SPONSOR, it really concerns me because my MOM who is also a nurse is the one who will provide the affidavit of support we even used an attorney to help us and prevent any mistakes so the process could run smoothly, im really disappointed that the atty. didn't bring this scenario to us, i live with my brother and stepfather they are both CNA's and im only the one who is not yet employed, im really concerned that our application will get denied after spending much on attorney's fee and k1 application. i would give my advance gratitude for those who will take time to read and reply to my concerns! thanks. :no:
