  1. Just as a side note to the below, with regards to the SSN or ITIN, I went round and round with this. I applied for the ITIN for my spose for the purposes of filing my taxes, the IRS kept sending it back stating that I had to apply for the ITIN in conjunction with filing the taxes.

    The easiest route for doing this, especially if the spouse is not yet here in the US, is to go to a tax professional, such as HR Block, have them prepare the taxes for the year, they, at the same time can also include the application for the spouse's ITIN. Your taxes along with application for ITIN will be submitted at the same time. Once the ITIN has been issued and approved, it will then be attached to the return that was submitted and then the return processed. I live here in TX, but from date of submission to date return received was about 6-8 weeks.

    HAHAHA I was coming back to edit my post but will not let me now... I was incorrect about the 50% thing (I was looking at claiming a dependent earlier which I can not claim, Sorry)

    Nonresident Alien Spouse

    If your spouse is a nonresident alien, he or she must have either a SSN or an ITIN if:

    1. You file a joint return,

    2. You file a separate return and claim an exemption for your spouse,or

    3. Your spouse is filing a separate return

    Married Filing Jointly

    1. You were married at the end of 2013, even if you did not live with your spouse at the end of 2013

    2. Your spouse died in 2013 and you did not remarry in 2013

    3. You were married at the end of 2013 and your spouse died in 2014 before filing a 2013 return

    A married couple filing jointly report their combined income and deduct their combined allowable expenses on one return. They can file a joint return even if only one had income or if they did not live together all year. However, both person must sign the return.

    Nonresident aliens and dual status aliens

    Generally, a married couple cannot file a joint return if either spouse is a nonresident alien at any time during the year. However, if you were a nonresident alien or a dual-status alien and were married to a US citizen or resident alien at the end of 2013, you can elect to be treated as a resident alien and file a joint return. See Pub. 519 for details

    Married filling separately

    Be sure to enter your spouse's SSN or ITIN on Form 1040. If your spouse does not have and is not required to have a SSN or ITIN, enter "NRA"

    But really on the W4 it doesn't matter what you put...

    I had a similar situation. I went ahead and kept the "1" on my W-4. The truth is, you can claim whatever you want on your employer's W-4 forms, what really matters is that when it comes time to actually file your taxes is that you report the information accurately. The less you withhold from your paycheck typically means that you will be more likely to receive a return. (Other factors can affect whether or not you receive a return). Subsequently, because I filed my taxes for the year I was married as "married filing joint," to help satisfy the conditions of evidence needed for the visa process, I obtained from my spouse a power of attorney for the purposes of doing our taxes. (If you decide to do the same make sure you have the POA translated) My suggestion is that you go to a tax professional this year when you choose to file, to ensure taxes are done properly and call them ahead, explain the situation and determine what paperwork to take with you so that you can file in your spouse's absence.

    Hello All...

    I got married on Nov 19, 2013 and had to update my W-4 tax form when I got back in early december. I was a bit confused as to how I should file my taxes now that I am married and my wife is overseas. I filed the i-130 just last week - so its gonna be take some time before she comes to america.

    -I am working

    -My wife just started working a few weeks ago (in India)

    I spoke with my accountant on this matter and he suggested that I put the number "1" for the total number of allowances I am claiming for my W4 form. However, he said that I should check the option " Married, but withhold at higher single rate."

    What I want to know is - now that I am married, am I suppose to file as "2" for the total number of allowances I am claiming for my wife and I? Or is it okay with what I have right now listed as "1" ?

    I dont want any issues during the i-130 process when they have to check on how I filed my taxes. Salary is not the problem - but was wondering if it would be an issue if they see that I filed as "1" instead of "2", Or if there is anything that I need to be aware of when they look at my taxes. (My concern is why I have filed as single instead of married even though I checked the married box)

    Any suggesstions or tips on what I should do would greatly be appreciated.

    My husband recently received his visa and will be entering the US later this month. My question is what exactly are the next steps that we need to take once my husband arrives? Do we start the process towards naturalization or do we work towards extending his permanent residency first? Additionally, we requested his SSN card to be issued and mailed upon visa approval, is that sent automatically or do we have to send proof that he has entered the US?

  4. My husband had his interview. After the interview, he received the refusal sheet, no items were marked as additional evidence being needed. The interviewer told him that she believed in our relationship and that in 3-6 weeks his number would appear for him to send his passport in again. I asked him if he was given any reason for the refusal, the response he was provided was that they needed to check up on one more thing. Has this happened to anyone else? What was the outcome? Any insight from anyone as to what they might possibly be looking into since they said we provided all evidence they needed and that they believed in our marital relationship?

  5. We have a medical exam coming up in Ankara, Turkey on October 8th, 2012.

    1) How long does the medical exam take?

    2) What shots/vaccines were required? I have the list, but does the doctor want the whole list?

    3) Any suggestions? Dos or Don't dos during medical exam?

    They say to allow 4 days from your medical examination to your actual interview date. It can take several hours and it all really depends on what information you are able to produce when you have your appointment and whether or not they accept the documentation. If they feel vaccines are needed you will have to take those and one of the tests does require a person to return a few days later for the area to be checked. My advice would be to do the medical at least a week out from the interview date, take as much medical documentation as you have concerning vaccines you have already had and just try and be as thorough as possible. Make sure to read all the instructions regarding the payments etc.

  7. It seems to me that there have been some rather lengthy delays with the Ankara Consulate in terms of being able to schedule the CR-1 interviews. Is any one else experiencing the same. Does anyone know on average the timeline from when all paperwork is received at NVC until interview date at the consulate is determined? I am growing increasingly concerned, not only because I know that Ankara is responsible for interviewing for not only Turkey, but also with some of the recent upset in the Middle East and more importantly the events that took place in Turkey recently, if this too will delay scheduling and processing times. Just wanted to know if anyone had any insight they wanted to share and see if others were experiencing the same. Any insight anyone can share would be much appreciated.!

  8. I looked for the answer here but could not find the answer. Does anyone know how long it takes a petion to be returned to the United States from the Embassy. I called UCIS and they do not have it. They told me I had to wait 120 days. Does that mean it takes 120 days for the file to be returned or do they have 120 days to review it?

    Hi yes. It can take anywhere from 1 month to 12 I have seen in some curcumstances for the file to be returned to USCIS, then it has to undergo the review and the approval/denial. The 120 days that you were quoted is an approximate time frame for review once it has actually been returned and received by USCIS from the consulate. Although I understand you have valid points as to why you had limited time together etc, the truth of the matter is that they want to see above and beyond evidence of a bona fide relationship. As someone else mentioned above, one option to consider would be to marry there and move there temporarily if that is feasible for you then re-apply for an IR1-CR1. If not, another option would be to wait out the final decision of the review once it has been returned to USCIS. It is really more a decision of what works better in your particular situation.

    As for contacting a representative, typically from what I have seen from others who have posted on this site is that they can assist with obtaining more clarity from the consulate as for the reason for the file being returned to USCIS but as far as assisting with getting the case approved, unless there was an administrative error or something along those lines, their reach for aiding you in obtaining the approval you are seeking can be rather limited.

    Yesterday I received an email confirmation that our Choice of agent form has been accepted. Anyone know how long I will have to wait to be billed for the DS-230? I have already paid the AOS of $88 and sent the AOS packet last week. All I have left is to pay the next bill and forward the packet.

    Anyone know the timing of these steps?

    It can vary greatly but ours took about 5 days after Choice agent was accepted. If you like, for more accurate information you can go visit my timeline. Primarily what is going to help move things along is that you have your documents ready to go for each of the additional packages that will need to be sent in after paying the two separate fees. If you are ready to send the document that are required once the fee is paid that helps to move things along. From what I was told at the time we paid our fees, it can take approximately 20 business days to review and approve/deny/request additional information for each package.

    Wow, so sorry to hear that. So, does that mean you have a 1 year ban before you can re-apply or a 1 year ban before it can be approved? If it is 1 year before it can be approved, possibly you can re-start the application process about 7 months in to the ban. I wish you all the best of luck. Like to see your positive attitude.

I have seen that some people did not have to take all the blood tests and I would like to hear from anyone who got married in Turkey and if they took the blood tests, chest xrays, and if they got the certificate that indicates they were free to marry prior to leaving the United States.

    To make it really clear, everything will take place in Turkey if that is where you plan to wed. I did not have to do anything state side prior to getting married in Turkey. Hope that helps.

    Hi , yes, before you can proceed with any steps on the Turkish end of things you will first need to visit an American Consulate or Embassy in Turkey to obtain a certificate that allows you to wed. Research online the embassy or consulate that is nearest you, you can make an appointment online and there should also be instructions of what all you will need to bring with you in order to obtain that document.

    After you have completed several other steps after obtaining the documents allowing you to marry in Turkey, yes, you will be subjected to a blood test there. As you will be marrying abroad in Turkey, from my understanding, you should not need to do any blood tests in the US.

I contacted one of my senator's office last week and today I found out that our file is being sent back to USCIS.The Consular officer says that the relationship was entered soley for immigration. I have only seen him once in 3 years. We are trying to save our money for our future. He had his interview last month and was given a 221G form requesting proof of relationship. He brought hotel receipts, engagment ring receipt,emails, my phone log from my calling card and pictures to the interview. I thought that was enough. In response to the 221G we sent pictures, emails (about 65) , engagment ring receipt (again), envelopes from the mail I sent him.

    The only possible red flag I can think of is that I am a lot older than him (about 17 1/2 years) We get along great and the age has never bothered us.

    I plan to call USCIS tomorrow or Monday. I also plan on calling my representative in congress. I am doing the right thing by contacting USCIS? I am unsure what to do at this point. I am also considering hiring a lawyer but I thought I would contact USCIS first.

    Has anyone else gone through this? What is my best course of action.

    Hi So sorry to hear about this. Unfortunately my fiance and I experienced something similar and I had actually gone and visited him about 5 times from when we first met to when he had his interview which was about a year and 1/2 total. At the time of our petition the requirement was a minimum of 1 personal meet in a 2 year period. I am not sure if that has changed or not. No, we were not out-right told that the reason he was not granted or issued a visa was because they thought he was in it only for immigration, however they state that they needed more evidence of the relationship. While you can contact your congress person for aid etc, the unfortunate fact is that they are really looking for concrete evidence of you both trying and wanting to spend time together, planning for a long term future together and wanting to be married to each other. Although you state that for financial reasons you decided not to see each other more over those three years, in their eyes, they may question how you plan for a long future together and have a solid enough foundation on which to build that future if you have only been together 1 time in those three years.

    My suggestion to you is that before you spend the money for the attorney, that you do a few "free" consultations with several attorneys.That way you can get the professional opinion of several individuals to see if they concur that the primary issue is the lack of personal meet or something else. In addition, as the file is being returned to USCIS, do not be surprised if it takes 6-8 months for them to actually receive the file. You may want to consider exploring other options, going for visits, if you have not already done so, get letters from family members attesting to your relationship etc. Unfortunately however, if USCIS comes to the same or similar conclusion as the consulate, you may want to consider working on building your relationship more so from the stand-point of spending quality time together, in person, then re-petitioning. I will tell you that we provided much of the same documentation as you described, proof of phone conversations, video chats, letters mailed snail mail to each other, and other such pieces of what we felt were concerete pieces of proof or our relationship and still found ourselves in the same boat as you.

    Anyway, just wanted you to know that you were no alone. If I can be of any help to you, please send me a private message. I know this can be dis-heartening, but do not give up. Just re-group, utilize as many resources as you can at your disposal and consider your options and alternatives and go from there. I wish you the best.

  14. Hello! I'm posting on behalf of my friend who, due to some unexpected financial setbacks, had to push her wedding on the 4th of August. We looked at all the options but they really have no other options but to choose this date. This is the 90th day so we're wondering if there will be any impact on her fiance's adjustment of status or should they start applying for the AOS now? I'm not really knowledgeable on the K1 visa procedure. Thank you so much in advance!

    You absolutely do not want to miss the deadline. To play it safe, I would suggest just going to courthouse and doing the marriage, then if there are plans in the works for a ceremony, do the ceremonial service on the 4th as planned. They can do a renewal of vows or religious ceremony but ensuring the legal marriage takes place prior to the expiration date is essential.

If Any turkish people out there or whoever had a turkish person come to visit them could share there experience about proving the money to go and interview and which documents were asked and such would be greatly helpful :D I really wonder when you give them the statement from the bank stating that if you have 10k dollars or whatever in your bank and you have the paper that states that then will they believe it or will they call or need another paper? Like will they just take a look and then move onto the next question?

    Hi There,

    Are you an I-129 F or an IR-1/CR-1? Here are some links that provide step by step instructions. What money for the interview do you speak of? If you are an I-129F, I know that typically once the consulate contacts you to schedule the interview date they will provide you instructions on how to make the payment, usually done at a TEB (Turkish Economic Bank) and then the receipt of payment is taken to the interview. If you are an IR-1/CR-1, then the majority of the fees will be paid once requested from you by the NVC. They will send you e-mails with instructions and invoices to make the payments. If you are referring to the money needed to go to the interview, my suggestion would be to set aside about $ 400 for the medical examination (it can be costly if your significant other has not had the required vaccinations)

    If you can tell me more information about what case you are filing for I can give you some more information. In the mean time, you can utilize these websites to obtain much of the information you need.

    I have a question about the G-325A. my fiancee filled the form out on my last trip to manila and printed her name on the bottom but did not sign or date the form in the signature section. can i send in a scanned copy that has her signature. (think i just got my answer by reading further down the step by step page. :( anyone ever send in scanned docs and got approved before?

    I would suggest sending to her all documents that need her original signatures via e-mail requesting that she print and sign several of them, just in case one gets lost or something then have her mail them through Fed Ex or DHL direct back to you. I used DHL to ship from CA to Turkey and my husband received the documents within 3 days. But you do need original signatures. Also, just a suggestion, some of these documents have expiration dates, so make sure that you download the most current templates/documents. I would determine what documents will require her signature for all phases of the process going forward and have her fill them out and sign them. She may, if you provide her the links be able to just fill them out online then print several copies and sign. Hope this helps.

    I just had some questions regarding the process, after NVC has reviewed the files and if they assign an interview date:

    Is there an additional fee that must be paid prior to my husband having the interview? (He paid the AOS and IV/DS-230 fees to the NVC direct) Are there additional fees on top of these fees outside of the fees for the medical examination?

    Also, anyone who recently went through the process, once you received notification from the NVC that your AOS and IV packet reviews were completed, about how long was it from that date to your interview date please? I am curious primarily with interviews taking place in Ankara please.

    My final question, is there another packet that is sent into the consulate prior to the interview or does my husband just need to prepare the final file containing the required documents along with the additional evidence of bona fide marraige and evidence of relationship that he will take with him to the interview?

    I had my visa interview a week ago and I am still waiting for it to be sent. The CO said my visa was approved. I gave my address info to UPS table at the embassy. But when I track the packet it tells me it's not been given to UPS yet...

    Anyone has any idea how long does it take them to send out the passport/visa?

    Have you called the consulate to get a status update and to just ensure that there was not a glitch or anything? I would suggest calling, if nothing else to ask for the tracking number, so if it was sent you can ensure you can stay on top of it.

  19. My husband and I have a 18 month old together, is that enough proof of a real relationship? He is not a picture person, so we don't have many pictures together, at least not enough to fill a whole big album with photos.

    We have been together for about 6-7 years. When we started dating I was a 14-15 and he was 19-20. Is there anyway he can get in trouble for statutory rape, or could we just say we started dating when I was 18? I am 21 now and he is 27.

    My first advise to you is never to lie. Your situation is what it is, things transpired as they did, and you both are still together after all these years, so place focus on the positive things. No, having a baby is not enough. You have to prove relationship not that you've had relations, so although maybe you do not have a ton a pictures, you do not need a ton, just hopefully you have pictures from varying time frames to provide. In essence, in that you have been together for so many years, maybe put together a timeline using the pictures or something like that. A few pictures from the varying time frames should be sufficient. Things that help support your relationship include joint accounts, joint dwellings, visits with each other, proof of engagement or marriage, letters of support from family, there are many pieces of information that you can use to support the relationship. Look at the below link, it provides a lot of useful information pertaining to this subject. The good thing you have going for you is the length of time you have been together.

    Towards the bottom of the link I have posted, there is a section regarding evidence of relationship or documents to support the relationship. I would focus on obtaining these. Hope this helps

    i have such a huge dillema ..... I came to the US to be with my husband who had promised me so many things. When i got here the first week was great. Then i asked him about the deposit for our apartment. He didnt have any money. I had my salary from my job in the UK which was enough for an apartment. We were denied because his cedit history is bad. I then had to live with his family on a matress on the floor. He became physically ill for 3 weeks and i had to look after him.

    I took up a job which was alot less than i am qualified to do to get some money. I managed to save up some and got an apartment under my name. I am still working trying to work on my driving as i dont have a licience yet so getting around would be difficult. It has been 3 months now he has had no money, i have paid to get his car fixed along with insurance, i bought all the food, gas, cigarettes furniture for the apartment. He has literally NO money. I am so stressed out. I feel that i have been lied to and cheated out of my new life. He also said that he had sent my daughters visa off but no sign of i at the NVC.

    I made a choice to come here and i left so much behind. I intend to stay here and work out my life as i have nothing to go back to in the UK. I just feel so let down, disappointed and frustrated. Everytime i ask about him working it turns into a full scale argument, and then him blaming me for being impatient or that i am seeing someone else.... I get a bunch of excuses and then it goes back to me carrying around a whole load of bad feelings towards him. Feelings that make me feel awful inside. I try to wake up and accept the situation but its getting harder. I am usually a happy bubbly person and i am starting to feel depressed now. He said he is really trying but i dont see it to be honest. My old mum always said if you dont have a job get out there 7 days and make it a job to get a job. I feel like i am drowning.

    I havnt been taken out anywhere, not been sightseeing i am just heavy with all this. I understand that marriage is for better or worse richer poorer, but i feel i am being used and taken advantage of. I have spent every penny i have sorting everything out. Even the money my family gave me for a wedding gift has gone on is car and food. I feel so sad its like ths and i am not sure what to do.

    I just need some constructive advice. I think i know my answer but just needed to put my feelings out there to see if anyone else went through this themselves.

    I am so sorry to hear you are struggling. Have you considered talking with a marriage counselor or someone of the like? Everything involved in this process is emotionally daunting and while you may be handling things one way, he may be handling it another. The truth is that you don't know what is going on inside of his head and maybe he needs someone else a neutral 3rd party to talk to, it is just an idea.

    Really need some help here please. I have been directed to several sites, however I am getting conflicting information and I am confused and I don't want to make any mistakes. I am hoping that some people who have recently gone through the process can provide some assistance please. My case is now at NVC for the I-130, IR-1/CR-1. Here is what I need help with please:

    1. Of all the documents for NVC- AOS, IV packet etc which documents can be certified copies and which must be originals? (marriage certificate, police certificate, military, birth certificate, etc. etc. etc.)

    2. For documents that can be certified copies, what must the certified copies entail? If the copies are notarized and stated that they are true copies of the original with notarial signature is this sufficient? Must certified copies have apostitles?

    3. Of our marriage documents, we had everything translated, the birth certificate used, the passports, the marriage certificate, the police record etc, all translated by a certified translator with a copy of the original and all with apostitles. If they ask for originals, do we want to send these originals or the original marriage certificate with out the translation and without the apositles?

    Also, I need clarification on exacly how everything is sent in. I understand I have to wait for our case # from NVC and also the invoice number so that we can use the system through NVC to make the payments. Do you make payment for everything all at once at NVC and then send in all the papers together (bar codes showing proof, choice of agent, and all the packages for AOS and IV packet?

    I know I am asking for a lot of information, I just don't want to delay the process by doing anything wrong. I have done my research, however I am just not sure which research is current and which is out of date. So anyone that recently went through NVC who can provide insight and help walk me through this process, it woud be greatly appreciated. Any suggestions your have any do's and don't, please include anything you think would be helpful for me to know. Also, anyone petitioning for their spouse from Turkey out there, can you tell me please approximately how long from when your case was assigned at NVC to when you were given your interview date and then how long until your interview please?
