Actually, the instructions say the following:

"...you do not need to submit documentation for traffic fines and incidents that did not involve an actual arrest if the only penalty was a fine less than $500 and/or points on your driver's license."

My interpretation is that if the fine was less than $500 and/or you only received points, then you need not submit the documentation.

So...if the fine was less than $500 and you also received points...no need to document.

Or...if the fine was less than $500 and you received no points...no need to document.

Or...if there was no fine but you received points...still no need to document.

I don't believe the points matter, only issue is if the fine was more than $500, then you must provide documentation. That's my interpretation anyway.

According to the new N-400 instructions (effective 1/22/2009), you do not need to provide evidence of your traffic tickets if they were under $500 and did not involve alcohol or drugs (See page 5, Step 2, "Other Documents"). I attached the instructions to this post, but it is also available here:

We should be very careful about this.

According to the text of N400 instructions, it said "you do not need to submit documentation for traffic fines and incidents that did not involve an actual arrest if the only penalty was a fine of less than $500 or points on your driver's license."

First, how can you prove the amount of fine ? Unless you have traffic ticket, you can not prove it.

So you should have either traffic ticket copy, or court documentation copy.

Second, it said, "a fine of less than $500 or points on your driver's license".

So even if you have a fine less than $500, you still needs to provide the documentation if you have demerit point(s).

But it is varied from USCIS adjudicator to adjudicator. So better be prepared than sorry.

Update....My wife received her ASC appointment letter on 05/08 and her biometrics is scheduled for 05/16. This was approximately 2 weeks after her NOA. My stepdaughter finally received her NOA as well on the same day. Waiting for her ASC date now.

Thank you for you answer. Any idea why she didn't receive her NOA at the same time as my wife as they were filed at the same time? Any idea what would be a reasonable time to wait for her NOA before thinking there may be a problem? Thanks.

Only other thing I can think of is if you have a Will listing each other as beneficiary of your respective estates. This is good to have regardless of your petition. Good luck!

My wife and stepchild filed a joint I-751 application as they entered the country concurrently. My wife received here NOA stating that her conditional residence status was extended one year while her petition is processed.

My concern is that her daughter was not named on the NOA even though she was noted on the petition. The money paid was for both parties and the receipt indicates that.

Does anyone know whether the child should receive a separate NOA as well?? She will be traveling to Brasil in June and her Permanent Residence card expires May 17.

My wife has not received her ASC appointment notice yet so I don't know if my stepdaughter will be listed on that or not. Any insight would be appreciated. Thanks!

Look in the instruction on page 6 under Part 5: Household Size. It states to be sure not to enter anyone person more than once since some may fall under two different catagories. In your case, just don't make an entry for your spouse. You should be fine.

That last I-864 that I filed for my wife's AOS specifically stated in the instructions that one must notarize the document. I am now submitting the latest form for her daughter's AOS who has come to live with us but I see no mention in the instructions about needing a notarization. I take it this is not longer a requirement? Thanks.

Yep...my wife's 9 year-old daughter had to have an interview along with my wife.

You only need one original notarized I-134 for your K-1. Then you can make copies of that notarized doc for each of your two children.

I just put "Unknown at this time" and did not have any problem.

My wife received here Greencard on Tuesday which was 13 days after her interview and one week after her Welcome letter. However, her 9 year-old daughter has not received anything yet. She was at the interview also and the woman told them both they were approved.

Anybody have any idea why the daughter's would be taking longer? She hasn't received her welocme letter or greencard yet. Thanks.

Yes...no fee for my wife's daughter either.

You could stop in and inquire about your case. They will be able to tell you if your case is at least in their system. Also, if you call the USCIS number, they can also tell you if your AP is in the system, even if it doesn't show online yet...from what I understand, they are different databases.

The folks at the USCIS in Pittsburgh were very nice and helpful. I would just walk in and ask them what you need to do to expedite things. Can't hurt to try and it is better than waiting for an appointment.

My wife's daughter is a 9 year-old and she too had to have the biometrics done even though it says on the form that only those over 14 year-old have to do it. She also must attend the AOS interview that we have scheduled in May so no, I don't believe your case is unusual. My wife's daughter also had to attend the K-1 Visa interview.

That's not what happened with us. When we went for my wife's biometrics for her AOS, we were told both her and her daughter would have to come back and have photos taken again for the AP. My wife went the next day and then received her AP in about one week. We couldn't get her daughter there again for about 3 weeks and she never received her AP in the mail. Once she went and had her photo taken specifically for the AP, she received her document in a week or so.

Don't know what the process should be, I'm just saying what we had to do in order to get the AP. We specifically asked the folks when we were there if we had to come back for that and were told that we did.

Did you have the biometrics done for your AP? My wife and step-daughter didn't get their AP's until that was done even though it said it had been approved online. They needed a photo for the AP because it is copied onto the AP documents that you receive.
