  1. you have 2 shots at this:

    1. get an ISO http://www.dhs.gov/files/publications/gc_1305658440339.shtm and get it sorted out over the telephone.

    or

    2. walk in to the local CBP secondary inspection / deferred inspection office closest to you (no appointment needed), get the shift supervisor, tell him/her that the cbp officer at the POE messed it up, and that you want it (visa designation) corrected on the spot, with a work order to issue the correct card coming from his/her office. Don't leave until you see the work order generated.

    sounds good. thanks Darnell!

  2. ok everyone i got an update. i finally talked to her yesterday afternoon. and no...it wasn't a mexican stand off type confrontation. finally got an answer and it was one of those defining moments for me. i asked her yesterday afternoon why she was so unhappy when im around and seems like she's not into the marriage anymore. she told me that when she got here, it was because she really missed her family back home. i really do understand because this is the first time she's been this far away from them since she was born. then she said she started to get used to being here and trying her best to get acclimated with the way of life here. but one thing she hated was that i smoke. so she said that she thought if she made such a big change in life (immigrating to a new country for me), that the least i can do was make a small change myself. she's been telling me for a very long time to quit but haven't. so beginning of July she requested i stop and i did, cold turkey. about a week after i quit, i asked her why she was acting the way she was not talking to me . she said something and i guess i got irritated and told her "hopefully you work soon so that we don't see each other as much anymore". i told her i said it as a joke because of how she was not talking to me and that i felt she didn't want to be around me. i could've sworn i wasn't irritated but she told me that it sounded like i was snapping at her. then she told me that ever since i quit cold turkey, i've been snapping at her and she didn't know why. right when she said that, we looked at each other and i swear both of us saw the lightbulb come on. she then asked me if it could be because i was quitting smoking at that time. she said she only started noticing me having a bad attitude when i stopped smoking.

i feel sooo terrible at how i've been acting towards her. i should've expected a change in me when i decided to quit cold turkey and gave her a heads-up, but i didn't think i would be that bad. so to somewhat make up for it, i gave her a big wet kiss right smack on the lips and gave her a really big and tight hug! she told me that i was very cranky and snappy the first couple of weeks of me quitting and that im actually back to my normal self again. but even though i wasn't cranky and snappy anymore, she told me she just got hurt at what i said and every time she saw me, it comes back and gets her really down. she said she thought i didn't want to be with her anymore when i said that that's why she started mentioning divorce in a semi-joking way because she wanted to see where she stood with me. i know it doesn't make up for me being such a jerk, but i told her that everytime i think about her, she still makes my heart skip a beat like the very first time i saw her when we were kids. i also said to her that i still get excited and look forward to seeing her when she's out of my sight. now to surprise her by getting a dozen tulips (her favorite flower) delivered to her.

i am glad to say we were able to talk. im especially glad that she was able to get her sama ng loob off her chest. thanks everyone for listening (or reading for that matter) and giving advise.

  6. i tried it twice. once they found out that my wife was married to an U.S. citizen, they closed the book on us. they need strong ties over here. and i mean stronger than a G.I. Joe toy with the kung fu grip, strong. i owned a bar over here and 2 houses. they didn't care.

the OF-169 is said to be in the packet that you receive, however my wife never got her packet ......long story

    piglett

here i am not making this up :wacko::innocent:

A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC, the NVC will send your relative a packet of forms that you and your relative must fill out before your relative can be given an interview date with a consulate abroad. The packet will likely contain an Of-169 form, and an Of-230 part one and two forms that must be filled out by the intending immigrant. An I-864 form is also included that must be filled out by the petitioner (living in the US). The I-864 is the Affidavit of Support form that requires copies of the petitioners past 3 U.S tax returns (or tax transcripts which are free from the IRS) as well as any bank or financial records available (see the I-864 for exact requirements based on your case). The petitioner must make at least 125% above the U.S federal poverty to indicate to the U.S government that the intending immigrant will not become a federal charge to the government when he/she arrives in the U.S.. If the petitioner cannot meet these requirements, then he/she must still file an I-864, and find a joint sponsor who can meet the requirements on his/her own. When a joint sponsor is needed ,proof of their U.S citizenship or permanent residency is required. (i.e. copy of birth certificate, immigration status etc). The joint sponsor must be residing in the U.S, and he/she must also submit his/her past 3 years U.S tax returns along with bank or any other financial records available. The joint sponsor must submit his/her own I-864 form to accompany the petitioner's I-864 form.

Forms that may be either sent back (or requested to be gathered and kept for the interview) to the NVC or the consulate abroad (depending upon which consulate you are going through) before an interview date with a consulate abroad can be scheduled are as follows:

    Pre-Interview Forms / Items: 1. Completed and signed OF-169.

    2. Completed and signed Of-230 Part 1 and 2 forms.

    3. I-864 Affidavit of Support Form along with past 3 year U.S tax returns (or transcripts) and any other financial documents required.

    4. A copy of intending immigrants biographic page of passport(s) including expiration date.

    5. Original or certified "long" birth certificate. *

    6. Original adoption decree. (if applicable)

    7. Marriage certificate. (if applicable)

    8. Divorce decree(s) or death certificate(s) (if applicable)

    9. Police certificate(s) **

    10. Court and prison records.(if applicable)

    11. Custody records. (if applicable)

    12. Military records (if applicable)
