  2. Hi - I am asking this on behalf of a "friend" because she seems a bit lost in all this. She is from Denmark but her boyfriend/fiance is from Texas. She has been staying with him for about a year or a little more on a ESTA. She goes back home about every 90 days - staying anywhere from a week to 3 weeks.before coming back to the US. According to the info she has given me & my husband, her ESTA is almost expired so she plans to go home and apply for a visitor's visa b/c she doesn't think they will let her back in to the US on what short while is left on her ESTA. And she said they plan to get married about a month after she gets back here on a visitor's visa. She is confused and has been asking us a lot of questions. I haven't really said much on the whole matter b/c I know she is going about this all wrong, but I wanted to turn to the community here and get some thoughts and opinions b/c everyone here helped me out so much when my husband and I were going through our immigration process.

    If she actually gets a visitor's visa (without mentioning anything regarding marriage), would a courthouse even issue them a marriage certificate?? I don't think they would but I'm not positive. I want to have a little bit more knowledge from the community here before she starts asking me for advise.

  3. Thanks for the useful information. I just wanted to know what we have to think over and what our future holds. He's from the UK and we want to move there sometime in the very near future. We were thinking maybe next year but know I don't know. We'll have to read over this and the links provided above and look at the big picture.

    Although I am confused as to why we would have to pay taxes to the US if we are living in the UK. The UK will be taxing our income and I don't understand why either one of us would need to pay taxes to the US if we aren't living here. I'll have to research that more with the IRS.

  4. Well --- I just checked the USCIS website and they approved our I-129F Petition and mailed confirmation on May 19th, 201. I feel my first sense of relief :)

    I know there are more hurdles but I'm still happy and excited.

    Any advice on the next steps would be greatly appreciated.

    What papers could I start preparing for my fiance and his interview in London?

    How long does it usually take the case to get to London? And then how long until they make contact with him?

    He is actually here visiting right now!!

    I'm just so darned excited!!!!

  5. It's just a VERY frustrating process. I feel so discouraged and depressed now. My petition was rec'd on 12/27/10 but b/c of a problem with my payment, it didn't clear until 1/18/11. How is it that CSC seems so much faster that VSC? I just don't know how to cope with the possibility of having to wait 6 months for the NOA2 ... then to wait longer for the medical/interview for my fiance. This is just SO frustrating!!!

  6. Why does it take so long for this?? It's very discouraging.

    They rec'd my I129F on Dec 27th but b/c of problems with my bank account having to be closed b/c of theft, i had to send a new payment to them.

    But that didn't happen until Jan 18th b/c of the run around from Customer Service.

    Then they didn't put the paperwork back into processing until Feb 15th - 4 weeks after I made the payment.

    I feel so deflated right now b/c it feels like it is going to take forever for this process.

    I am so lonely without my fiance and want him here soon!!!! This waiting game really sucks.

    It seems like they would have a faster process. I mean seriously... what takes them SOOOOOO long to do this????

  7. Hi Everyone - Well, here is our progress report. We filed our I-129F form on 12/24/10. It was received and signed for on 12/27/10. I received an email notice on 1/3/11 with the USCIS Acceptance Confirmation subject and the receipt #. Here is where it all went wrong --- On 12/29/10 my car and laptop were stolen from my parent's house while I was in England visiting my fiance. I had to call the bank and freeze my account b/c there was banking information in my car and on my laptop. It was on 1/3/11 that USCIS tried to cash the check I had written them and of course it was rejected. I tried talking to their customer service people about sending another form of payment immediately but was told I would have to wait for official instructions to be sent to me in the mail or wait for the entire packet to be returned. I arrived back in the USA on 1/7/11 and was able to open a new banking account on 1/11/11. I finally received a letter from the USCIS on 1/18/11 and also received my new check card the same day! I'm very thankful they didn't return the entire packet, but now we are facing a huge delay on the process. I was able to pay over the phone on 1/18/11 and the transaction has cleared my account. Now I'm just waiting to see an official update to our case on the USCIS website. So there is our progress report so far!

    Oh! And our case is now being handled in the Vermont Service Center ...

  8. The USCIS website gives this on that status:

    On January 18, 2011, we suspended processing of this I129F, PETITION FOR FIANCE(E), because the fee payment was returned by the bank due to insufficient funds. We have sent you a check deficiency notice in the mail which explains the steps you must take to resume processing of your case. If you do not receive this notice within 30 days from January 18, 2011, please call customer service at 1-800-375-5283 for further assistance.

    This makes me think they are just sending me a letter so that I can make the payment... without sending back the whole application. Has anyone been thru this recently???

  9. Can someone give me the email address for the the VSC?? I can't seem to find one. They have my application but I know the check was declined by my bank b/c my car and laptop were stolen and I had to freeze the account. I called the USCIS once to inform them of this and ask if I could send in another payment. But they told me the paperwork would be returned to me. That was 10 days ago and still haven't received the paperwork. I really would just like to send them another payment and them not return my paperwork.

    I even have a I-797C receipt that makes it look as though they did cash the check but I know they didn't.

    So if anyone could give me an email to write to, I would greatly appreciate it. Its hard for me to call during the day b/c of work. I am not allowed to be on personal calls and the USCIS has such a long hold time. Or does anyone know if my fiance could call about it?

  11. Well - I called my bank and b/c the account is frozen they will not let ANY transaction clear the bank. Only deposits will be allowed to come through. They did tell me that the check tried to be cashed today, but was rejected

    I called the USCIS Customer Service line and spoke with a very automated human. She read me a very scripted response and said the 'packet' would be returned. So I don't know what will happen now. It's really frustrating!

  12. Ok. So the email I guess was just to inform us that TX rec'd it and is forwarding it to Vermont. I am planning to contact my bank to see if there is anyway they will let that one transaction go through or not. If not, I will try the USCIS and see if I can have another check sent to them immediately.

    I am just soooooo frustrated with the situation. I can't believe my car was stolen and put me in this predicament!!

  13. Hi All - I can't seem to find a definite answer to this question. Does USCIS cash the check first or send the NOA1 first?

    The reason I'm asking is because I sent my K1 application on Dec 24th and it was rec'd in TX on Dec 27th. I just rec'd the NOA1 email notification this morning but don't see the check has cleared the bank.

    And now I'm worried b/c I am out of the country and my car was stolen while I've been away. There were blank checks in my car and I had to call my bank and have them freeze my account until I get back. Therefore, no funds can go out at this time. And my online access doesn't show the USCIS check has cleared my bank at this time.

    So I'm just a bit worried. Should I contact them and see if I can overnight a new check to them? I just don't want our packet to be returned due to this.

  14. Yes, another $350 for the actual visa to be issued at the embassy. The 129F fee is going down to $340 if you file after Nov 23rd and AOS is going up $55.

    So I just want to make sure I'm following along here. If after Nov 23rd, I'll file the I-129F form to start the K-1 Visa process. This cost should be $340. After the I-129F is approved, it will be sent to the embassy in London where they will schedule and interview with my fiance, correct? He will have to pay approximately $350 in fees as well as a $200 medical exam fee with Knightsbridge, correct? Once that is approved and he is able to fly over here, we will get married. Once married, we will file an I-485 form which the new fee will be approximately $985 and a biometrics of $85, correct?

    Does that sound about right?

    I'm starting to think I need a flow chart!

    This is a complicated process.
