  1. My husband and I just had our interview last week - and were approved :D When you receive your actual paper appointment notice in the mail, it will state that if your eligibility is based on your marriage, your husband or wife must come with you to the interview.

    Good Luck!

I honestly don't understand because on the letter we received it says that only the Applicant is to go to the interview. under preference category is CR1- Conditional Spouse of U.S. Citizen.

  2. Today finally after many months we received notice that our interview date is December 15, at 8:15 am!! We are so excited!! But a little nervous on the same token. I do have a quick question for the ones that have been through the process. Do my husband and I have to go together to the interview, or is it just him that needs to go?? If anyone can help answer this question I would appreciate it!

  3. Ok So I did just what you suggested and instead of waiting I called. I asked the rep if there was a case number assigned and an invoice and she said yes, and proceeded to give me both numbers, but she said I couldn't do anything else yet because the invoice had not been created yet. When I logged in the NVC page to see if I could make the payment, it doesn't show a bill being generated yet. Any ideas as to how long may be the wait before the bill is generated, or is it something I will have to check on a daily basis???

noooooo! okay - first off: congrats on making it through to the other side!!!

second of all, don't "wait" for anything! call every day and by the end of 3 days or so,you should have NVC case number.

While you are on the phone with them, gettnig that case ID#, ask them for the Invoice ID and give them both of your email addresses.

Then immediately have beenficiary email over a DS-3032 email, naming you as Agent. That way you can pay for the IV and the AOS online.

Once those funds show as "clear" you can send the Affidavot of Supprt and the DS-230 which has to be filled in and signed by beneficiary.

If your spouse is in another country, get him/her to fil in Part1&2, sign part1, and dhl it to you pronto, b/c you could be sending it to NVC next week!!! Along with the DS-230 you have to include all original documents, and one set of photocopies. HEre is a link to the government web site listing the DS-230 instructions and the documents needed:

  4. Greetings to all,

My approval letter was sent stating a date of june 17, 2011. I contacted the NVC to find out about my case, and they told me to send an email to NVCResearch@state.gov, along with a scanned copy of the I797 Notice of Action and the name and date of birth of both petitioner and beneficiary. I did that Thursday July 14, 2011. Since it has been way past the 15 business days. I also sent a similar email to NVCInquiry@state.gov on the same day. Today I finally got an answer from both the Research and the Inquiry email:

    1st Email from Research:

    Dear Sir/Madam:

The NVC recently received this petition. The appropriate agent

(applicant, petitioner, or attorney) will receive instructions for the

further processing of this petition within 6 to 8 weeks.

But just a few minutes ago I got this 2nd email from Inquiry:

    Dear Sir/Madam:

Your inquiry has been received at the National Visa Center (NVC).

This petition is now eligible for further processing. The petitioner, principal applicant, and/or attorney of record will receive an instruction package regarding further processing of this petition.

The NVC does not have an overall processing time due to the fact that we cannot estimate how long it would take someone to accurately complete and submit the requested documentation. Once documentation is received at the NVC, the processing time for all documents to be reviewed is 2 to 4 weeks. Further information will be sent after the review is completed.

If a period of one year passes from the last date of contact with the NVC (by telephone, mail, or email), all submitted fees and documents will expire. If this occurs, your fees will need to be repaid and documents will need to be resubmitted in order to continue the immigration process.

    Case Number: WAC1190*******

    Petitioner's Name: KARLA

    Principal Applicant's Name: SERVANDO

    Preference Category: CR1

    Your Priority Date: 24Feb2011

    Foreign State Chargeability: MEXICO

    AMERICAN CONSULATE GENERAL

    PASEO DE LA VICTORIA #3650

    FRACC PART SENECU, CD JUAREZ

    CHIHUAHUA, MEXICO 32543

So I am guessing that in just a couple of weeks we will be getting our packet from the NVC to continue with the process.

  5. You are right it was approved on 6/17.

It is alright - I didn't want you to wait till 18th. Just scan your approval letter and email to them ASAP. Remember to add the full name and date of birth of both of you in the body of the email requesting them to research your case approved on 6/16 or 6/17 (your time line states 6/17), whcih ever is right.

  6. ok, so i got on the phone and called them up. The rep said that the requests get forwarded to them within 15 business days. They didn't have anything on my case yet, so he told me to send an email with a scanned copy of the I797, NOA2 form attached to it to NVCResearch@state.gov. Once they receive the email they will research what has happened and by next week should have something. I wish i had known this last week when the 15 BUSINESS days were up. Hope this helps.

  7. I wouldn't trust the site too much since I got the approval letter yesterday but the website still shows that it is under initial review. We filed our petition on February 24 2011. Now we are waiting for the NVC papers to come which if the timelines all say it correctly should be within the next couple of weeks.

For curiousity I looked up a couple of IR1/CR1 (I-130) case numbers and see where USCIS CSC is at currently.

Today is June 14, 2011 so the USCIS web site could only have information as late as June 13.

The latest case number which is approved, is WAC1190290090, approved on June 13, 2011, which is yesterday. Judging from near by case number it was first filed on March 12, 2011. Curiously cases as early as WAC1190285000 is approved on the same day.

So it looks to me they are trying to catch up and are trying to approve cases in as short as 3 months, but will probably not go shorter than 3 months, for the bulk of cases.

I will update this thread from time to time and see how fast the approved case numbers are moving.

  8. Oh, I know...I freaked out about the same thing cause I only lived with my husband for two months in Nicaragua before I had to return to the States. We lived with his parents, so I had his dad write a short letter stating that in exchange for living there, Armando supported them and us through his job and I helped around the house.

Other than that "formal" piece of evidence, I submitted pics of us throughout us knowing each other, of the wedding, letters/drawings we gave to each other, emails, affidavits from people who know us and attended the wedding. Plane tickets, visa/tourist cards (not sure what Mexico has), wedding/honeymoon receipts, etc..

Calling card phone records, any time of communication records...

A tip I got from a Spanish translator is to include a statement about why you (US) can not move to the Beneficiary's country. For me, it was because I had student loans to pay off here. A big one that that the government considers of high importance is that you have to stay here to take care of someone medically in your family. Or just something big like those two things.

Thanks for all the information. One of the main reasons why I can not leave the US is because I'm on disability from work, and still in the process of having physical therapy. I just had surgery on my shoulder on the 18th of this month for the second time. Also my daughter is still in school, and i don't want to move her to a new country all of a sudden.
