Parents in law came here from China on a 10 year tourist visa. Father in law left after 5.5 months. Applied for and got I-94 extension for mother in law, she will leave mid-March.
When can they come back without issues?

Current NBC processing date for I-539 is March 17th, about 140 days behind. So we are not likely to hear from them before January 1 for an application received 8/14. Makes you think.

My wife's mother has been here for a few months; her I-94 expires late September.
She's a super nice lady and we want her to stay longer so we can enjoy her company and take her some other places in the US. So we're filling out the I-539 Application to Extend/Change Nonimmigrant Status.
The thing we are stuck on is this: should we change her return ticket and present a copy of the the updated itinerary as part of the application packet?

Goes by place where you sent the petition.
When not enough space on the page, mark it then attach a separate page with same question number and provide full answer in that page.
Does name mean the form which was filed, or the person I filed it for, or both?

How to answer in the room given?
And what do they mean by name, place and date? I understand date, but name and place of application could mean different things to different people.I
Filed I-129F @VSC 09/21/2010, approved; I-485 @ Chicago Lockbox 10/15/2011, approved. I-751, Chicago Lockbox, 5/9/2014, denied.
I did ask this question in another subforum, but no answers, not even any views as far as I can tell.

I have to enter yes for this, then fill out that I did an I-129F which was approved, an I-485 also approved, and finally a I-751 which I messed up on, so I have to start over.
The example form does not show how to answer this, and I can't begin how to imagine how to do that in the room given.

So when filing a new I-130 and I-485 concurrently, should I send both packages in the same mailer? If so, send a short letter of explanation outside of both packages, then inside each package a separate cover letter, each referencing the other form?

One more question: will I also have to do and complete a new I-693?
Aaaand one other question: since her GC is no longer valid, do I use her Alien Registration Number on these forms?

Which human would have to check e-verify? At her job, or someone at DHS? As far as I can tell, she is a very much valued employee, anyone who did such a check would incur the wrath of management.
I did file I-131 and I-175 before. In fact those I still have on my computer from the original app, I will be able to just copy and make make a few updates.
One more question: will I also have to do and complete a new I-693?

So a few questions:
1) She is working, and by dint of very hard work and taking care of the right people, is getting a pretty decent salary for someone whose parents couldn't afford better higher education for her than a 3rd rate diploma mill. What happens with the job?
2) Does she need to leave the country?
3) Do I file I-130 and I-485 at the same time, or file the 1-485 after the I-130 passes?

You'll have to start all over - I-130 and I-485 as LPR status is abandoned through the GC she had before.

talk with the shift supervisor, not the person at the first window that calls you in.
I-130, is that for someone who is already in the country? Can I file both simultaneously? Will my wife have to leave the country?

OP: I think you waited way too long. If you got RFE back in May 2014 on your ROC application process, today is basically 8 months ago. You cannot wait that long for an RFE. I am not sure the exact time, but if my memory doesn't fail on me (anyone can correct on this since I really don't remember for sure) you have 90 days to submit evidences for an RFE from the date it was mailed to you. You are now gathering evidences for an RFE that was issued to you in May? Or am I misunderstanding you? I may. However, if I am not misunderstanding you, I really don't know what I could advice you on since then yes, you have abandoned the application. Although not sure what green card they want your wife to surrender..the one that expired already? Maybe. Anyway, I would try to make an infopass with them and try to convince them to reinstate your ROC application and mail away immediately (once they reinstated your application) all the evidences you have gather, enough or not. However, if they don't willing you help you out then I'm afraid you'll have to go through the whole AOS process again with your wife. It is an expensive lesson, but a learned lesson. Very sorry to hear that! All the best to you!
Oh now I see it was October they sent you the RFE...than maybe it is less than 90 days as I thought and that's where you "fell out of the deadline"? Same idea though...try to make an infopass and see if they are willing to reinstate your ROC application. Sorry about mixing up your dates there...
If the expense is only money, I can live with that.

If we knew more about you it would help, as to what state you live in, as here where we live, I had my wife put on every thing and with just a phone call, telling them, "I am responsible for payment, but I want my wife added to the account to be able to speak to the company about any bills, or problems that arise. It was easy. Power, water, cable, even our car insurance.
This is real, documented proof, and very easy to get.
Could tell you more but we can tell nothing about you, as there is no time line filled out.
State laws vary from state to state.

Sent I-751 packet in on May 9, 2014; her 2 year green card expired May 18. August 29, they sent RFE. I was supposed to reply by November 21.
I did send in:
* a bank statement with both our name on it
* screen shots of our bank account webpages showing mutual access to bank accounts
* screen shot of the Hennepin county website showing shared ownership of our home
* documentation showing my wife as beneficiary on my work benefits: 401K, life insurance policy, etc.
* itineraries and plane tix for our vacation in Mexico, October 2013
I know I sent other stuff. I didn't make a second application packet and a hard drive crash took care of the electronic copies. Argh.
I have my wife authorized on phone, gas and electric bills, but all the bills the send only have my name on them.

Did you send in the evidence already, or you are still trying to gather it to send in? On the RFE there is a date that they need to receive the documents by. If this didn't happen, then they will consider it abandoned.
I must have missed that. On top of my ADHD. Argh.

Sorry to hear of your trouble. I am a little confused though:
- they mention she needs to give back a greencard, but if you are filing AOS, she wouldn't have a greencard yet?
- When did you send in the additional evidence? Was it within the timeframe given on the RFE?
- Are you sure it was received?
I made a mistake. This is in relation to an application for lifting conditions for permanent residence. I sent in the application and evidence for that. I haven't been able to scrounge up additional evidence they want. I thought I had a lot longer to get this done. Utility bills are impossible. Mods, if you need to move this to another forum, please do so.

I am the petitioner. Sent in application for adjustment of status for my wife last may. October they sent it back with some errors and request for evidence.
Now they've said the petition is abandoned and that she needs to surrender her green card. #######!!!!!!
I've been trying to get their freaking evidence. Trips we took together, proof that we own a house together, and that she's the beneficiary on my life insurance I sent in, but it wasn't enough. I am having trouble doing more. Utility bills only show my name.
What do I do??????

So I sent in the application, now my wife is bored with school and wants a job. She seems to think that if I can send in a copy of the receipt from filing AOS, I won't have to pay separate fees for EAD and AP. Can anyone confirm this?

My finace and I have a 20 year age difference. We pretty well breezed through. I have to admit, I was scared stiff we wouldn't pass the interview, although I really had no good reasons for that.

The interviewer was a very polite and pleasant lady whose hometown is also Minneapolis.
I was surprised it went so quick and easy, because I thought I had done a poor job of preloading the petition: 6 photos, some chats, a log of Skype calls that I had pulled together by hand (I'm a Linux user, and Skype for Linux shows the time and date only for the highlighted event in the call history), and hotel receipts/boarding passes/train tix for our first 2 visits together.

After taking a look at the example forms, I've revised my answers the 11 and a couple of other questions and will send out a corrected form out to Guangzhou posthaste

Strong bond between mother and daughter, not sure when we can go back to China to visit, an assurance that Mom would not become a public charge and she would personally see to it that Mom went home when time as up.
