  1. Having the engagement party and then the wedding within a week could be a red flag. We went that route and it caused us problems. IMO, I would go the K-1 route. The K-3 wont speed things up in getting her to the USA. If you marry the I-130 is the way to go.

    His office is located in Ho Chi Minh. Vietnam can be a tough consulate, and you need to make sure you have all your ducks in a row.

  2. Why did they interviewed you two together?? i thought they only interview one person. how did you get into the interview?

    Now you can go inside and be with your S.O. in HCMC. The C.O. did ask if I wanted to be part of the interview. I wasn't about to say no.

    you cant do a DCF in HCM any more.

    If you live with your parents. Then again they could look at the fact you work outside the country.

    when you've been denied once a good immigration attorney is not a bad idea. You are going to have to overcome the lack of evidence from the K-1. Front load the petition. with as much evidence as possible when you file. HCMC still does not care to look at phone records or chat or emails.

    When we turned in our evidence they handed everything back but the I-864.

  4. My wife and I just finished our interview. I was with her. together they asked us a few questions and then the CO asked if I minded if she could interviewe us seperately. I agreed..no problem.. They asked her where I lived, what I liked to do. what my favorite vietnam food was, and if I liked the Coffee, and what type I drank. About 10 minutes later my wife motioned for me to join her and they asked me the same questions. Everything matched and she congradulated us. All together we in the consulate 3 hrs.... It was well worth the effort to make the trip for the interview. :dance: :dance: :dance:

  5. We included everything, even very personal conversations on chat. We had a lawyer handle our NOIR. Our petition was reaffirmed 4 days after they recieved it. We have our 2nd interview Feb 16.

    The format should be similar to a book with a index. Make it as easy as possible for the adjucator to find everything.

    Here is just a small sample

    10. Written correspondence evidence:

    a. Petitioner’s letters  Beneficiary: From January 2010 to August 2011.

    b. Beneficiary’s letters  Petitioner: From January 2010 to May 2011.

    c. Petitioner’s emails  Beneficiary: From November 2009 to September 2011.

    d. Beneficiary’s emails  Petitioner: From November 2009 to September 2011.

    e. Petitioner and Beneficiary’s chat logs: From November 2009 to May 2010.

  6. Being CR-1, having her get these 2 items to you is a good idea. Planing a step in this process is always a good idea. Whatever you can do to speed the process up :thumbs:

  7. Yes you can call dos. They will want case number, your name and date of birth, and your finacee name and date of birth.

    I doubt DOS will send you a email about your interview. they will tell you when it is. Once you know your interview date you can go to the consulate and they should give you a copy of P4

  8. I don't understand, aren't youg guys suppose to get emails of the letters!! I did when throughout the whole process...

    Your CR-1 ... NVC set your interview date, and does send out email comfirmation. The consulate on the other hand set's the interview date for K-1, and does not do email.. It took my wife 11 days to get P4 from the day they mailed it.

  9. Dos is the Department of State. their number is 202-663-1225. Push option 1 then 0 to speak to a visa specialist.

    CR-1 the NVC sets the interview date. K-1 the consulate sets the interview date. The department of state can tell your interview date.

  10. When they return a petition back to NVC it is for Review and possible revocation. You have to prove your marriage all over again. There should be a reason on the letter they gave your husband stating the reason they are returning your petition.

    If the interview went well, and it seems you had plenty of evidence to support a bona-fide marriage.

    My congressmans office was a great help with our case. But it seems some congressman help more then others. You can call dos, and ask them the status of the case.

    Again the letter should say why he was denied.

    If they do return your petition it can take up to 2 months or longer before you recieve anything from them.

    1st it goes to NVC for a short time then it will head back to NCIS CSC where it was approved.

    You will have a chance to rebut the consulates findings.

  11. Called DOS yesterday. They told me my wife's interview date, 2/16/2012. She still hasn't recieved package 4 yet. Hopefully she will recieve it soon so she can get her medical done. Already have police report. I plan to be there this time. Hoping for pink this time.

  12. If you recieved the NOA stating your petition has been reaffirmed. It should be on its way to NVC. They will only keep it a short time, and send it to the embassy. The embassy will schedule the appointment this time. They will send you wife a letter( package 3)Your wife will need to do a new DS230 part 1 ,and a DS2001.

  13. I feel your pain ....Once we recieved our noa. we waited 4 months before we got the noir. they use the same processing times,like you were starting over. Our congressional rep kept saying we were going to have to wait the full 5 months. luckly we only waited 4. I would think your getting pretty close to that time where you should be getting the NOIR.
