  1. Go to the county building were the divorce was finalzed and ask for a certified copy of your divorce decree. This document will have a stamp on it that it is certified and will be a full copy of the divorce proceedings. This is what you need.

Since we are on the subject, The USCIS is not interested in the whole divorce package, are they? I suppose that they just need to verify that you are avail. to remarry, right?

  2. From what I have been able to find doing some research:

"Judgment of Divorce" means the final verdict by the judge for the annulment of marriage.

"Divorce Decree / Record of Divorce" is the decree granted by the court for the annulment or divorce is recorded by the clerk in the court records.

I think I suggested yesterday that rather than trying to argue that the document you have is the right one, you would be better off spending this time just going to the courthouse and requesting a Certified Copy of the Divorce Decree. This should be available at the courthouse where your divorce was heard. It should take you less than two hours (including waiting in line and getting through security) to have this done and over with.

You will have to pay a fee for the document, and an additional fee to get it certified.

Right, A very common mistake that many filers make. All they need is the very first page that says the date of the final judgement and court certify with a stamp usually less than $10.without the stamp u will be RFED.

  3. I disagree with them doing their best. First of all, this isn't our "tax" dollars at work. We pay, UP FRONT, the fee in which to process the application. They sure can cash your check within 2 days of getting it. The technology behind "criminal background check" is at the government's disposal within seconds. They can tell you when, where, and what you have spent your money on up to the minute because of the incredible technology called check/credit card.

Our tax records are a SSN# click away for them. The hardest part is to actually go over the application and check for clerical errors. They are trained for spotting errors. They do not have to see "bonafide relation". They have to see that A.. the applicants have met face to face within past 2 years. B. the sponsor is legally able to marry. C. they do a criminal background check. D. a US citizen E. 2 letters of intent to marry.......... Etc.... This isn't a lot of "investigational" work to be done.

If they are indeed "overworked" then they should hire more people. They surely have the money that we pay them for the service. If this were a mainstream business, there would be thousands of complaints to the Better Business Bureau. But, because we do not have any legal ramifications, they can say what they want over the phone, take their time approving applications, and in general, not providing a service for which (again I reiterate) we, the US citizen, pays for.

But, I do not think it is "one" individual, but a severely flawed bureaucratic process that needs to be examined by whoever is in charge of overseeing the system. We are attempting to do things "legally" and by the Laws set forth by our lawmakers. Why would anyone that has come here illegally get priority of one of our petitions? I am not against those individuals, I am just saying that maybe they should take a backseat to our petitions rather than ours taking a backseat to theirs. If we meet the criteria, then approve the application. If not, send the RFE and we either correct it... or forget about it. If they want to slow immigration down, (and let's face it... WE ARE ALL IMMIGRANTS TO THIS COUNTRY) then change the laws to establish a different procedure. But, the truth is, we are such a minority that we do not have a true voice and there isn't much we can do about it except vent a little on VJ.

Just my humble and probably aggravated opinion......

Thank you for taking the time to write those lines down. Very deep!!

  4. I check it daily. For some reason, I am not upset with VSC like most of you are. They are doing the best they can to do their work. I am pretty sure they are not sitting down playing solitaire... They are human, just like us.

Positive attitude is the trick to happiness. If you don't have it, find it.

Are you saying that they have good intentions, but somehow do the wrong things or maybe they just don't see us as human as you say they are.

How could they hold someone's application for so long, finally approve it, then decide to change their mind and now file is waiting for further review?

  5. should i say FORTUNATEY nobody replied..lol...coz guess what everyone??? my fiance just called USCIS and he was told that they decided to put aside the APPROVAL NOTICE and subjected our application for further review to Administrative Appeal Review and that they will inform us if a decison is made! isn't that sweet? how could they play on people's emotion like that? approve your application then take it back later on...arggggh! really hurts!!!!

I'm not suprised at all, they have done worse...Much worse.

    Sorry about your trouble!!

  6. Six a day does not get rid of the backlog. It keeps it from getting worse, but it doesn't make it any better.

So at six per day, the backlog stays where it is now, 6 to 7 months. That was why I labeled it as fair but not good.

In order to get the backlog back down to 5 months (where they claim it is now but are quite full of bunk), they need to do at least 10 a day, every day. That would be good.

And to get it to where it used to be back when the system actually worked well, they would need more like 20 a day. That would be great.

I can not ask you to have the same expectations as the next person. The truth is, Vermont has gotten themselves in a biG hole that only big steps can get them out. While the other guys are content with Vermont's current sign of life , as oppose to the last few months, you just expect more...That's not a crime. Infact, I too would like to see this five months thing abolished.

  7. You have to admit, this day started off looking really bad. Zero by lunchtime! This was the first zero by lunchtime day this year that did not turn into a total zero day.

I am glad it finally got to the fair level, not good but at least fair.

As for my theory that these things get processed over the weekend and entered on Mondays, I think that theory turned out to be a dud.

We at least got enough that the backlog will remain the same and not get any worse.

I agree. I take back what I said earlier about disappointment.

  8. this is why i started the thread in the first place, it was pretty obvious it was coming to this, like i said that huge volume done at the end of last month was simply to pad the completions for that month and make it seem liek they did more then they did. Im sure what ever contorl process they have is checked monthly and that is why you get 70 in the last week of a month and then 7 for half the month after.

And in 3 2 1 will come a swarm of optimists and finger pointers and finger wagers. duck and cover

Yeah, it looks like you're were right after all! what a disappointment.

  9. If you look at the charts, CSC and VSC have nearly the same percentage of petitions for August completed. VSC approving five petitions yesterday is not what I would call a "standstill" considering there was a time when they weren't approving five a week. Out of the last 15 petitions VSC approved 6 are from July, 8 are from August and 1 is from September. In a week, VSC managed to catch up a considerable amount. CSC is slowing down significantly from what they were doing recently.

If you follow my posts I am the one who asked that Vermont filers to wait 'til the weather changes up north before they confirm a "standstill". Also, the reason we get so nervous is that Vermont had totally stopped processing petitions for about three months in a row. We are afraid of this happening again!

I read some old posts of VJ from a few years back. I've found that Vermont has been the fastest among all the Service Centers, and I believe that was the reason they dumped all those TPS files on them. Yes, they may get ahead of Cali. but, no one can really tell what will happen because they are very inconsistent about everything.

  10. That is a good point but here is how people should really apply pressure. Do what I did: Call/write your governor, senators, reps and the USCIS over and over until they hear you. Once you get their attention just demand your petition be looked at. I agree that complaining on a forum won't do anything.

Right! we motivate each other here on VJ, then we push the avail. buttons. See, people here have to realize that the pressure we apply do benefit them.

  11. Yeah, but quit putting so much pressure on yourself. When I see a thread that is complaining about the low amount of approvals on what will likely be the highest output from either SC all year, I think there is a problem with this. Y'all get each other worked up because your own petition wasn't approved. Right? Would the OP be singing a different tune if his/her petition was approved?

I believe I was talking about Vermont and u r from csc. So this isnt for u.

  12. Okay folks!! what's the minimum number of approvals should be expected from Vermont on this thread?? I personally think if Vermont approves 5 a day, that should mean that they are working hard out there and will catch up soon.

In response to those who say 'relax and keep a positive attitude', I agree, but we can do all that and still keep the pressure. Never assume that applied pressure don't make a difference. I'm all for putting pressure, sometimes it's the only way to make a difference.

  13. I can't wait for next week. I really wanted to ask what was going on with vermont's sudden change from thursday (02/03). I had to hold on to my thoughts because I'm aware of the weather condition over there up north. I think we should all be fair enough and give Vermont some time before we judge them.

They have every reason to show some real actions, the few approvals from last week have not moved me. Especially when I saw a noa2 from july 3rd without any RFEs. Seven months is too long of a wait for processing an application, and then we have another Journey from the NVC to the ambassy and more. That could happen to anyone of us. So, let's

wait for next week or when the weather condition changes and then, give the verdict!

  14. Well, we are halfway done with VJ August members and the last remaining July are getting approved here and there. I'd say traces of September filers will get their NOA2 maybe late next week and October around mid-March.

Actually, they have the petitions mixed together. For instance, they were still working with July and August both.I was hoping they would get done with July and start to focus on August and September by now. Every time you see a july approval pop up, It shows how behind they are and how organized they are not.

One good thing is that, they are no longer dormant like they were for the last three months.

You are just about right, only it will be mixed between August, September, and October by late next week.

  15. I really hope they catch up and fast because i dont know how much more i can wait....im on the verge of moving over thier and saying forget the US

Atlest they seem to be alive again after going dormant for three months. There is some hope again although...a lot of catching up need to happen.

I would give them a few weeks to catch up and September will be soon getting approvals. So, don't give up just yet.

  16. That's the first time I heard them placing a service request before the five months time. They don't really have any standards nor could they meet them if they had any. The approved DR petition early makes things even worse.

All I expect Vermont to do is catch up and eventually do away with this ridiculous 5 months + wait.

I am currenly pleased with Vermont, but not overall. They still have a great deal to catch up; July and August are still passed due no matter how many they approve. September and late August should have been getting emails as of today.
