  3. getting ready to send my package tomorrow........ but a few quick questions......

    1) Children - we have one child together - born after I moved to the US so our daughter is a USC - do I have to list her? Also I am pregnant and due the week that my green card runs out.....will I have to reapply then too?

    2) Criminal History - I am the GC holder and have never had any issue with the law in any country. My husband the USC has a criminal history from long before we met. Do I need to include that?

    3) payment - Do I send one check for $590 or one for 505 and an additional for the $85.00 biometric fee?

    I'm not a lawyer/immigration expert, but I think this is right based on my experience:

    1. The section on children asks you to list all of your children. So yes, you should list your USC daughter. You may want to include information about being pregnant and your due date, but as the child isn't born at the time of the application you wouldn't include them on it. I can't imagine your new baby will be any sort of issue for the application.

    2. There are no questions specifically pertaining to your spouse's criminal history on the application, so I don't think you would need to mention it. It would have gotten brought up during your previous petitions more than likely, and already known/covered then.

    3. You can send one combined check for $590.

  4. Getting ready to send in I 751 to remove conditions for my wife and stepson. Can someone who recently filed just clarify one thing for me. The fee for wife and stepson who will be included on the same I 751 should be 505 which covers both wife and stepson and then 85 x 2 for a total of 675 to submit with the I 751. They make it so confusing. Thanks for the help. Good luck to all.

    Didn't see this get answered yet, so I looked it up. This is from page 1 of the I-751 instruction PDF:

    If you have dependent children who acquired conditional resident status on the same day as you or within 90 days thereafter, then include the names and Alien Registration Numbers (A-Numbers) of these children in PART 4 of this form in order to request that the conditions on their status be removed as well.

    Also, under 'What is the filing Fee?'

    The Filing fee for a Form I-751 is $505.

    An additional biometric services fee of $85 is required when filing form I-751.

    Each conditional resident dependent, eligible to be included on the principal petitioner's Form I-751 and listed under PART 4 of Form I-751, is required to submit an additional biometric services fee of $85.

    So yes, it appears to me that $675 is the correct amount. $505 + $85 + $85.

  5. Could anyone give me an estimated waiting/processing time for

    1. NOA
    2. Biometrics appointment
    3. Interview (if needed)
    4. New Permanent REsidency Card?

    I sent my package yesterday at the California Center.

    Unfortunately, there's no great answer to this question.

    Any information from the timelines is just an average and can vary quite a bit from case to case depending on circumstances.

    So please don't take any of this as definite, as it's all just guess-work based on current timelines, information, etc.

    1. NOA - It's an average of 5 days from sending the application to the NOA1 date, based on current information. Which means you may receive your NOA1 letter as early as next week.

    2. A quick eyeballing of recent timelines shows 3-4 weeks wait between the NOA1 and the biometrics appointment. Not sure when people received their letters for that.

    3. I can't find any recent information about interviews, so no clue there.

    4. They are processing October applications right now, so I would estimate 5-6 months based on the current rate of approvals.

  6. Apparently not! I forgot to write "Attention: I-751 petition to remove conditions of status" in the address I wrote on my package. oops8rh.gif

    I just wrote down the USCIS california center address!! Do you guys think this would be a problem? Is there anything I could do now?

    We didn't put it on our packet, either.

    A quick search through the forums shows plenty of people who forgot and had no issues.

    My understanding of the process is, the P.O. Box in the address is specifically for I-751 applications anyways, so it shouldn't matter that much.

  8. Our package was sent out yesterday. Due to arrive on Wednesday.

    I haven't added us to the listing since it wasn't working right for me, so if someone could add us to the list, that'd be great.

    Going off of memory, I think we sent:

    - Affidavit outlining our housing situation (we live with family and pay a share of taxes/utilities).

    - Pay stubs from both spouses showing shared address.

    - Bank account statements from both spouses showing shared address.

    - Driver's licenses showing shared address.

    - Joint checking account statement.

    - Joint savings account statement.

    - Joint credit card photocopy.

    - 2011, 2012 tax transcripts, 2013 tax return.

    - 401k beneficiary form from my work.

    - Life insurance beneficiary form from my work.

    - Insurance enrollment from my work showing medical, dental, and vision insurance for both spouses.

    - Car insurane showing both spouses as named driver.

    - Two affidavits from our closest friends, personal letter from his mom.

    - 7 photographs photographs from 2012-2013 (we aren't big 'photo' takers)

    - Celphone record showing both names on separate phones under the same account.

    - Joint membership cards to the local Zoo.

    The last additions might kind of be 'fluff', but I wanted to just include whatever I could find just to be 'safe'.

  9. Funny my friend files and has no income or job and gets money back from the school stuff. Whatever.

    There are certain types of credits that you can get some money back even if you haven't paid any into it. Like the 'American Opportunity Credit' for education. My friend doesn't qualify for any of these (we already went through tax prep software and such which would find that sort of credit). Those are the only exceptions that I know of.

  10. Yes he should still file, he may be able to get some money back.

    He had no tax taken out, thus he couldn't get anything back by filing.

    If I remember correctly, IRS does require individuals to file for tax returns even if they did not have any income.

    Once he/she files, your friend can send it with a letter explaination stating there was no income.

    There's nothing in there about permanent residents, which was why I was asking if there's anything specific for them requiring them to file. I think the letter attached to the n400 sounds like the best idea.

  11. Asking this on behalf of a friend of mine who wants to file the N400 this year.

    He has five years of residency.

    However, this past year he was a full time student with no income.

    1. Should he still file a tax return even though his income is zero?

    2. What, if any, documentation would he need to show he did meet the tax requirements for this past year?

  12. TwoCats, I doubt they were sending you the EAD cause the I-765 and I-485 strictly depend on the biometrics. Without them you can't be approved yet so probably It was the bio appointment letter. Did you try calling USCIS?

    Yeah, unhelpful as ever.

    We gave them our address, which was right on all the NOAs, and they're supposed to re-send it.

    But if it's the biometrics, it'll probably be too late and we'll have to reschedule.

  13. Honestly not sure what's going on with my case right now.

    We got transferred to CSC on 11/15 and got the receipt notice at CSC yesterday.

    However, we got a notice from the EAD saying that a notice from /that/ was returned as undeliverable.

    We called to correct the address and get it re-sent, but I'm worried that it's our biometrics since we haven't gotten one yet.

    Does anyone know if biometrics is attached to the AOS or the EAD or what?

    Also, totally confused on how the NOA1s (all three), and the transfer notice all got to us with no problem, but something /else/ failed to get to us. Kata thinks that they probably printed/put it in the envelope wrong or something and the post office couldn't read it.

    Bleh.

    We are ready to send our package (!!!) but we noticed that there is a bit of confusion concerning the actual amount of the fee to include in the package (with a cheque or a money order). On USCIS they say 350 USD.

    Is that correct?

    I think you're confusing two very separate things.

    The I-129F, which is your Petition for Alien Fiance(e) form costs $340.

    This is NOT the same thing as a 'visa fee'.

    When your petition is approved, it will be sent to the embassy in the beneficiary's country.

    When the beneficiary is preparing for the interview, they will have to pay the $350 Visa Fee.

    Two separate fees at two separate times.
