  1. I petitioned for my mother. She was approved and came in to the US on 3/13. Now I am trying to figure out the next step. I have paid the $160 GC fees a month prior to her trip to the US. I called the USCIS and was told it could take up to 120 days to receive the GC. Is that time frame right? Should I do anything else or just wait and see?

    She wasn't given a I-94 upon arrival which makes me nervous!!! just a stamp on the passport.

  2. I am getting ready to file the I 130 for my mother. According to the guide the items below is all I need. I was just wondering if I really don't need to send any photograph with my application?

    Can someone who has gone thru this process tell me a little be about the steps what happens after it's approved by the USCIS?

    ball.gif Form I-130, Petition for Alien Relative (if you are filing for both parents, you must file a separate petition for each parent)
    ball.gif A copy of your birth certificate showing your name and your mother’s name
    ball.gifIf your name or your mother’s name is different now than at the time of your birth, you must provide evidence of the legal name change.
    ball.gif If you were not born in the United States, a copy of either
    ball.gif your Certificate of Naturalization or Citizenship or
    ball.gif your U.S. passport

  3. My wife file for 751 to remove the condition on her residency back in March. She has already done the biometric and received the one year extension.

    We are planning to travel to Canada by car since I leave in NY state. She normally only use her Green card but it is expiring on May 3rd.

    I went to the USCIS office they suggested bringing her passport so that they can stamp the green card extension.

    Since nothing comes easy in my life once I got home I realized that my wife's passport expires on May 10th.

    Now here is my question. I am planning to go to Canada for a wedding on May 20th. Should I go to the USCIS office and get the stamp (even though the passport will expire soon)? or should I just use the expired green card and the one year extension letter to cross the Canadian border?

    Getting another passport is not an option because it could take up to 2 months.

  4. I am very confused I hope someone can help me here!!! I filed for AOS for my wife and daugther after they joined me on a K1 and K2 visas. I just received a letter for the Green Card interview but some of the items they are asking me to bring to the interview are a little be confusing. They are asking my wife and I to bring our birth certificates.

    I lost the folder that had my wife's birth certificate when I moved her to the US from Canada a couple of months ago. I never tried to replace it because the USCIS already has a copy of it. As far as me I am a US Citizen thru naturalization I thought I didn't need a birth cerfiticate for my wife AOS interview but apparently the USCIS wants me to bring my birth certificates as well.

    The interview is scheduled for May 3rd. Our problem is we are from a part of Africa where getting a birth certificate is hard and can take a couple of months.

    My question is should I go to the interview with a copy of my wife's certificate or does she need the original. I did bring the original at the K1 interview.

    Second why does the USCIS need my birth certificate. I am mean I am a US citizen and I am not the one applying for the AOS. I went thru my AOS process a few years ago they didn't even ask me for my birth certificate then. Do I really need to bring my birth certificate as a petitioner?

    I am asking this for a family member who is shy about joining the VJ community. My cousin is ready to apply for US Citizenship. He has a wife and 2 kids. The wife is a French citizen who has been in the US for over 4 years so obviously overstayed. The 2 kids are US citizens because they were born here. He is filling out his N400 application and there is an area where it's asking for the spouse name and address. He is afraid the USCIS may deny his application since his wife who lives in the same address as him overstayed. Is that gonna be a problem or no? if it is what's his options? He already understand that legalizing his wife will be a problem because she overstayed however he would like get his citizenship first before dealing with his wife's case. FYI they got married while the wife was visiting the US a few years ago.

  6. My fiancee and daughter joined me on a K1 and K2 visas. They did all the medical exams in Montreal prior to the interview. I have the vaccination book but I don't have the DS 3025. The physical exams were done at

    Do I really need to submit the I 693. My daughter was born in Canada 2 years ago and raised there until they joined me and my fiancee took all the shots that they asked her to take in order to get the visa.

    Can someone please clarify this for me? if I don't submit the I 693 form is the RFE going to delay the process significantly?
