  1. If you didn't send a response to the RFE, and only sent the withdrawal letter instead, and your online case status shows "RFE Response Review", then I think it's safe to conclude they got the letter.

    The petitioner will usually eventually get a notice of action saying the petition was withdrawn. It won't have any automatic effect on your ability to visit the US using the Visa Waiver Program. However, a CBP officer is free to conclude that you still intend to immigrate. Some people withdraw an I-129F petition after they discover they can marry in the US and file for adjustment of status. If the CBP officer thinks you're one of those people then they'll deny you entry, revoke your ESTA privilege, and tell you to get a B2 visa to visit the US in the future.

    I know that its all up to the CBP officer. When I fly,Í will bring tons of binding ties. I just want to visit my friends´over there for like 2 weeks.

    I don´t want to give up the ppl I met there just because him and I didn´t work out, even though it makes me really sad.

    But what would happen if they deny the petition? I just want to know how things will be than just in case.

  2. I believe if you do nothing, your application eventually expires, and that is the end of that. You can also send a letter requesting to withdraw your application and close your case.

    It seems to me you should still be free to visit with the VWP tourist visa at any time in the same way you have in the past - maybe bring some proof of ties to home, which is something that can be requested any time you come.

    Well thee petition just expires after it got approved. Its a different thing iff it got denied. We sent in a letter of withdraw, but Im not sure if that ltter ever made it.

    Well I guess all I can do is wait an see.

  3. Hi everybody, its been a while.

    So a lil backround info to my case.

    My boyfriend and I got engaged and filed for I-129F. In Dec we got an RFE, but by the time we got the RFE him and I split, so wie decided (better he), not to sent in the futher evidence. We sent in a letter saying we want to close our petition.

    On the USCIS update it says now RFE reponse review. My question is how do I know the case has been closed, will we get a letter or anything, or will they just leave it the way it is?

    And what would happen if the deny the petition just hypercatically?

    Can I visit agian on VWP or do I have to obtain a visa?

    Im thinking about going to visit my hostmom ind friend in Jersey April this year, can I do that or should I refrain from it? I still have a valid ESTA for Visa free tarvel.

    Any productive advise would be highly appriciated

    Ok. My ex fiance and I recieved an RFE from USCIS on dec 7th, we have until Jan 6th to provid the information they r asking for. Unfortunately him and I splitt, so we no longer want to go on with this petition, therefore we sent in a letter stat#ing we want to withdraw our petition. The problem is we sent this letter to the US from Germany this Monday and I´m a little concerned that it won´t arrive before Jan 6th,and than the USCIS will denie the petition, because we didn´t sent in the requested information or anything else.

    I just wanted to know if the worse case cenario will happen, what can I do about it. Can i still travel on VWP, or do Ive to obtain a touristvisa etc.

    Our petition never made it to the NVC or embassy, its sits still t the USCIS.

  5. Depends on the reason for denial. It's very unusual for a petition to be denied, as the qualifying factors are only that the petitioner is a US Citizen, they are both legally free to marry and they can prove they have met in person at least once within the past 2 years.

    If you've changed your mind as the beneficiary, you can simply not respond to the invitation from the US Embassy to submit your application. It will expire if they don't hear from you within a certain time frame (if memory serves me right, it's 4 months) from petition approval. If the petitioner wishes to stop the process, they can notify the Service Center that they are withdrawing the petition.

    As long as you meet all the conditions of the VWP, then you can still travel on this, even with a lapsed or withdrawn K-1 petition.

    What was the reason for denial and at what stage?

    Well it isn´ dieneld yet. We got an RFE last Monday I was visiting my fiance( petitioner), things didn´t go well so we broke up. He don´t want to send in the requested evidence because he said, he sent all in what they are asking for, besides passport stamps to proof we met. We decided to withdraw from the petition. I mailed the letter today (from Germany). Im just not sure if it will arrive in time. So i was just wondering if they don´t get the withdrawl letter before Jan 6th ,and therefor deniel the visa, what will happen in the future, when I want to go to the states to visit, or apply for another visa?!

  6. Yes I received the hard copy in the mail yesterday. They are asking for proof of US citizenship for me (the petitioner) and "circumstances of meeting" and "last personal meeting." Apparently my birth certificate wasn't good enough. I suspect its b/c its not a "civil registered long-form" it says that it has to be this type of birth certificate in the documentation they sent me with the RFE, so now I'm going to send in copies of my passport. Your fiance should get a passport. He can put a rush on it and get it pretty quick, although its a little more expensive. They only give you a month to respond to the RFE too so that might cause a problem for him. He could apply for the expedited passport now and try to find this specific birth certificate they require. That way if you get another RFE maybe in that amount of time you would already have the new passport. Hmm...I'm not sure. Hopefully someone else can give you more ideas.

    The problem with the passport is they won´t issue him one, he applied in June for a passport and didn´t get it because of child support debt, aand this is in Jersey and Jersey law says u´re balance on that has to be 0. Im just parying that his birth certificate is not the issue, because if he has to obtain another copy ,that will def take longer than a month.And he was born in Jersey and now lives in CA.

  7. I got an RFE today :( my NOA1 is July 16th. These people are the worst!!! I submitted my birth certificate and they aren't even accepting that!!! Now they get copies of my passport and ALL pages (even if blank). Cheers to front loading!!! They want proof...I'm going to be sending them ALL the proof I have. I suspect my RFE requests have to do with my fiances home country being a fraudulent country, so much for case by case processing w/o judgment! We lived together for 6 months, and I still have to show more evidence of having met in person? REALLY? Ok, they want a war of paper evidence then they got one coming. I will print anything and everything and submit it, costs me nothing to print document after document. Any advice for me? I submitted my birth certificate as proof of my US citizenship. Possibly it wasn't the "long-form certificate," whatever that is!! My copy showed my parents name and birth place plus all the other expected information about my birth and they still requested further evidence for this! Also, they want further evidence for the "circumstances of meeting" and "last personal meeting"...UGH this process...now I have copies of boarding passes and air fare receipts as well as copies of my passport w/stamps from early Nov 2010, of course more pictures, skype chats, emails, phone records, wire transfers as proof of financial support!!! WHAT MORE DO THEY WANT???!!! I'm open for any suggestions for further evidence I can send them. I will send them anything and everything I have! Anyone have ideas about what else I can send them?

    I feel you, we got an RFE too yesterday and our NOA1 date is July 12th. Do you have already the hardcopy? What exactaly do they want to have from you? I figure too its probably his birth certificate and us have been meeting within the past 2 years.

    But why wouldn´t they accept a birth certificate? My fiance doesn´t even have a passport!

  8. There are 21 applications just on VJ with 12th July as the NOA1 day (God, that must have been a busy day at the CSC!). Only a little more than half of them are already approved, I can see why these people want to be in touch with each other.

    Thank you, thats exactaly the reason I opend a threat for th particular date, so we can see how it moves along. I´ve seen a few July 12 application being approved but also, a few past July 12.

    And this Sunday it will be 5 month!

  9. Just to let you know, my NOA1 was dated July 12 and has since been approved (on November 18th). I received one touch on the USCIS website, also on July 21st. I signed up for emails, but I didn't receive anything from them. I didn't know we were approved until the hard copy came in the mail on November 23rd. So just so you don't lose faith, it's entirely possible for you to be approved without hearing anything at all from the USCIS (other than the hard copy in the mail).

    I hope so much we´ll hear something soon. But I think we´ll get an RFE because we just sent pictures as evidence that we met in person, nothing else.

    Will at least the RFE show online at USCIS, or could it happen that we´ll just recieve that, as well in the mail?

  10. Hi I thought opening a threat for all couples that recieved ther NOA 1 on July 12th 2010 and are still waiting. MAybe we can cheer each other up and exchange experience and knowledge about that whole process.

    Me and my fiance recieved our NOA 1 July 12th and since than we are waiting. We were touched 7-21, 11-2, 11-3, 11- 23 and 11-24, but no change on the USCIS website or anything in the mail.

    So feel free to post in this threat what ever u like to share how u feel etc.

    I hate this whole process it annoys the f... outa me, but thank god I will c my babe in one week, if I make it through Costom Boarders.

  11. i got an email notification when we got RFE, but no email n text notification when we finally got NOA2, it was in the mail, it was a nice surprised :)

    my case status on USCIS website still "request for evidence respond review" :)

    think the last touch is ur noa2 :)

    I hope so much its ourr NOA2, but to b honest I think we´ll get an RFE, because we just sent pictures as evidence of meeting in person,and I read that this is just secondary evidence. Unless the USCIS has in there computer somewhere that I was an au-pair from 07-09 which I doubt. :)

    If we get an RFE could I coontact you for futheer questions and advice?

    Im just asking, because my fiance and I got our NOA 1 July 12th, we had a touch on 7/21 on 11/2 and 11/3 but that was a change of address and than agian touches on the 11/23 and 24th. I was just wondering if the last touch was maybe our NOA 2 or even an RFE, but nothing showed online and my fiance didn´t say he got anything so far.

    For the K-1 u have to get a medical in your homecountry prior to even get the visa.

    And than u have to get a medical agian?

    Why? That doesn´t make sense.

    Can someone explain that to me, please.

    But the to ge back to the topic the Doctor doesn´t do misconduct or anything. He has to sign a paper that you are healthy and no harm to the United States puplic, if he doesn´t examen you properly how can he tell you are health?! Just because another Physician did it 6 month ago!?
