    You should get a police clearance from all the places you have lived in India for more than 6 months and all the foreign places where you have resides for more than 12 months.For India is valid 12 months.

    We were married less than 2 years when we applied DCF and got my Green Card last year I was expecting to get CR1 however in my GC my category appears to be IR1, also expiration date is 10 years from the date I got mine, Do you know anything about this kind of situation? please write..

    I see in your timeline that you got marry in 2012,and your POE is also in 2012.That's an error,they do mistakes sometime,contact USCIR,probably they will tell you to apply for your CR1 card.But don't make assumptions and just call them.It's been a while already.

  3. That's another case I read about,sorry to hear that sad.png.Do not sign a thing for her ,stay as much as you can away from her,she can accuse you of being verbally abused,and probably she can't wait to find something,anything to accuse you of.

    As someone said before,that's a reason why ROC exist,this is not only 'another' procedure, remember that this is another step of proving that she is entitled to refrain her permanent residency based on a BONAFIDE marriage.So,report her to immigration and DON'T let her go with this.I would get a lawyer if I would be you.

  4. dancin5hr.gif This helps soooo much, thank you everyone!!! It's one ticket., Ghana to Casablanca to JFK to Charlotte.

    He is just bringing a carry on bag (small book bag), no checked bags. His plane lands at JFK at 3:45pm and the flight to CLT leaves at 6:30pm. So he has 2hours and 45 mins to get through Immigration and customs. Not having to stop at baggage claim might save him sometime. Hope he makes it!!

    Couple more questions,

    What happens if he misses the flight from being stuck in line or something?

    When he get to Casablanca (Mohammed V International Airport) he has a 3 hour layover. Any tips for when he gets off the plane there?

    If he'll miss the flight,which is because of him not because of the airline,I guess he'll have to buy another ticket for the domestic flight.

    It wouldn't hurt to call the airline to see what,if any options are available.In same cases they will give him the next flight available with a fee but most of the time not,still it's up to the airlane and the type of ticket you have bought.

  5. You've been given some really good info - but here is a step that has not been included:

    Your fiance will get off the plane in JFK. First step will be immigration, where he will turn in his packet. Then he will go to baggage claim and pick up his luggage. Then he will have to clear customs (really be sure he knows what can be brought into the country - find the "Know Before You Go" booklet that Customs puts out).

    After he clears customs, he will have to "re-check" his luggage. If you have booked him on one ticket, and the two airlines are affiliates, then his luggage will be checked through all the way to Charlotte - so he only has to find the desk where they re-route his bags to Charlotte. It's usually just outside the customs desk. It was good advice to look at a map of whatever terminal his Ghana flight arrives at.

    If the two airlines are NOT in cahoots (I mean, affliliates!), his luggage will only be checked to JFK. He will have to find the check-in desk for his JFK-CLT flight and have his bagged checked from JFK to CLT.

    As long as he has his passport and boarding pass, that's all he'll need to board his flight to Charlotte. Most likely he will be changing terminals, which means he'll have to go through security again.

    Good point ,I forgot to mention about that.I booked 1 ticket but with 2 different airlines which were not affiliates,the first airline was an European one,the second one for the domestic flight from JFK to CLT was an american airline.So yes,it's really important to know where he will clears custom.After I was done with immigration I claimed my luggage in JFK,and after when I looked for my terminal for the domestic flight,I re-checked again and, yes,you have to pay the fee for bags when you re-check.I tried to pay mine online when I bought my ticket but they didn't let me and I had more than one bag.

    For sure he will switch terminals,because his flight is an international flight,so he will land at JFK to a terminal on an international flight(that's why all the planes landing in that terminal(and is not the only one for international flight) will just go straight to proceed through Custom and Immigration.When you switch terminals and you remain inside the country,what you do is to move from a terminal that receive international flights to a terminal that do domestic flights most of the time.This was my understanding about JFK after I checked the airport map and I saw that to the terminal that I moved at ,there were only domestic flights,and indeed after I got there I saw that all the flights shown were inside the country.I don't know if it's a rule,but this was my case.

    And by the way,if the gap between flights is big and he needs to spend hours over the night in JFK,you have to know that all terminals except T4 are closed during the night time between 12am and 5 or 6am.I found that when I arrived to my terminal and they were just ready to lock the doors because it was close to midnight.They told me it's only one open over the night and I moved there.In the morning I moved back to my terminal with my luggage!!!

    You should be just fine as time as she returns home after you'll get marry and she'll wait there until she gets her visa.

    IMO you don't need to spend your money on lawyers,if something will really come up you can hire one during the process.You'll find on visajourney all the info you need and a lot of people willing to help you with answers.Most people over here don't have a lawyer,you just need to read the guides.I was clueless at the beginning of this road and I learned a lot reading other topics and with some help from all this nice people around here.With the money that we have spent on a lawyer,we preferred to take our honeymoon in a nice destinationsmile.png.Happy wedding!

  7. Thanks so much everyone!! I called the airline and explained my situation. ((I could not find a flight leaving JFK late enough)) so they gave me a refund and I re-booked a flight where he can keep the same flight, yet end in clt.

    So when he gets to JFK he goes straight to his terminal, and will go through CBP at CLT.

    That's how it works right? If his flight on the same ticket ends in CLT?

    Port of Entry is the place where he lands his foot for the first time in USA which in your case is JFK as I understood,so here he will go through CBP,here is the place where he will let his embassy package,here is the place where they might ask him questions,here he gets his I94.

    If he would have a direct flight from Ghana or Casablanca straight to Charlotte then his Port of Entry would be at CLT.

    After he will deal with CBP in JFK,he will have to find his terminal and at the airport security to show his ticket and his passport for his domestic flight to CLT and after to find his gate,that's why he needs enough time between flights.

    He will not deal with immigration in Charotte at all.He will only have to pick up his bags at the baggage claim.

    I live in North Carolina and I followed the same route.I came from Europe to JFK(which it was my PortOfEntry) where I gave them the embassy package and after long 11 hours(I couldn't find flights with a shorter gap) I had to fly from JFK to Charlotte.No one asked me a thing in Charlotte because I had already my POE in New York.So I had flights with 2 different airlines.

    Just be sure you book flights with at least 4 hours gap between,because you never know how busy the CBP is and how long he'll stay there,it varies from case to case and more than likely he will have to switch terminals in the airport.If he is a first time flyer

    If the interview will be scheduled after 2 years since you got married,the embassy will issue her a IR1 visa,because her status will change,but anyway,even if the interview will be scheduled before 2 years since you got married, her status will change anyway at POE(at POE she'll need to bring your marriage certificate and she'll have to tell CBP that she is married already for 2 years,that's what I did).

    Then I suggest you'll be cutting it close , with a visa date of december 12,2012 ...

    is possible, but please consider the risk.

    Yes my timeline is correct.Marriage on may 6,2011.Visa expire on june 11,medicals should expire on june 6.I wish to go on may 8.

    I was issued a CR1 visa on december 12,2012.I intended to go on april 2,yesterday I wanted to buy my ticket plane and while I was trying to find if 3 hours between flights is enough time and I was ready to buy the ticket,I found by chance,that if you are married for 2 years,you can get a IR 1 visa instead a CR1 at POE!

    I never checked before this info and I always thought that the visa issued by embassy can not be changed,whether you celebrated 2 years of marriage or not between embassy and POE time.

    We will celebrate 2 years of marriage at the beggining of may and now we are thinking if is not a good ideea to wait 1 month more(what means another 1 month after all this long trip)..

    As I understand(reading the forum with very useful info from pushbrk and inky),no metter that CBO stamp my passport with IR1 visa or not,I can apply after I 90 form to USCIR and replace the CR1 green card with evidence.

    If we choose this way,will they ask at POE why I waited until we turned 2 years of marriage to go?They will have any problem with this?

    As i know,the visa expires when medicals expires which it will be on june 6(because they have 6 month valability ,right?I just want to be sure ).

    I also read that even CBO stam in passport IR1 visa,a lot of times people receive home a 2 years green card.Is there anyway this situation can be avoided?Is it a better ideea to call USCIR as soon as possible after entering the country and to talk with a human,explaining the situation and asking for the right visa on green card?

    Oh and one more question ,if I receive the SSN card can I work and get my driving licence while i wait for my green card(it might take months)?

  12. When submitting the I-130 petition, I the petitioner need to include a copy of my birth certificate. Does it need to be an original copy or can it be a photocopy?

    Will my fiancée (beneficiary) need to furnish her birth certificate at any point during the process?

    When we submitted our I-130 we sent a copy of my husband's birth certificate and a translated copy of mine(I'm the beneficiary).No, you dont need the original one.At NVC stage we sent my original birth certificate and our original marriage certificate(we sent originals because sometime people are asked for it and we didn't want to risk a RFE).When I had the interview,they gave me back our original documents.

  13. Up until abt 2 weeks ago no one but countries filling EP(electronic processing) got case complete.

    Think NVC tired of us calling. LOL

    U would not know when they approved AOS or IV bill or case complete. So hopefully they keep it up.

    Oh got it now,I agree..probably they are tired about people calling,we are only a case who called them 5 times in 1 week,lol...i wonder why they don't use or develop a system like USCIR do ,people just to login and to see the case status,probably is too expensive.

  14. Case Complete Congratulations. Now you wait for your interview date. Calling Consulate at this point they don't know about you. Since you are a IR1/CR1 NVC schedules your interview date.

    She said 2nd week of November because that is what NVC tells every one that they start scheduling for the next month (December) the 2nd week.

    So hopefully NOvember will be like they did for October they started the assigning interview on Oct 2nd. So hang on.

    Seems also they been sending sporatically emails of Case complete and Case sent to embassy. Weird. So keep eye on inbox also. But its a waiting game now.

  15. Hello my VJ friends,

    My hubby called NVC yesterday and they said our case is complete :) ,we were so happy to hear about it that he forgot to ask what we do next,she said my interview could be scheduled in the second week of november but most certainly it will be in the second week of december.The only thing my hubby could say the lady on the phone is that he loves her because she brought us such good news,lol.

    Today he tried to call NVC but he was put on hold more than 30 minutes,then he had to go to work,he will try tomorrow again.

    We haven't received any email yet,I still can log in NVC electronic system so now I don't know what to do.I should call the consulate or we call NVC to ask if the case was forwarded to the consulate or i wait NVC or consulate to send me(us) a mail or an email?

  16. Hi, all. I sent my package last month to the Phoenix office. That was around Sept 12th. Then it got sent to California and from there to Lee Summit, MO. From checking online and calling them, my package is under the initial review stage. My question is in regard to the bonified marriage part. I sent my marriage certificate copy, bank account statement with both our names on it, and renters insurance policy letter with both our names. From reading the requirements on this site, USCIS, and the Romanian embassy site, I've come to understand that photos were not necessarily required. I did not send any photos, except the passport ones on the G-325. Has anyone else done this? Will they ask for photos while in the USCIS offices? I thought that would have been more than enough as proof, since it shows joint financial mingling. I'm noticing that some are sending stuff like chat logs, flight itineraries, and passport stamps.

    I'm not too worried about my package, since I followed the guide on it to the T. I just now feel like I provided the minimum when it comes to proof.

    We sent photos last year with us together in some trips ,our marriage photos,chat logs ,flight itineraries,passport stamps,etc to be sure everything will be ok ...The thing is that you shouldn't be worry ,if they want some more evidence (which i doubt they will ask it for bonafide marriage)they will ask for it and at least you will know they are working on your file.We got our NOA 1 last year on september,14 and we had RFE in may 2012(after almost 7 months of waiting) -a copy of our marriage certificate-,which i am sure it was in the package because i checked 5 times if everything is in there before to sent it .The fact that they asked something didn't scared me because our petition was approved 2 weeks later after we sent our RFE ,what really made us feel very anxious was the looong time of waiting until they asked for something or till we got NOA2.

    I was married so do I put my ex wife last name of when she was married to me ( which is my last name ) , her maiden name , or since she is remarried now her last name as it stands now through her new marriage? Thanks for your help in advance!

    I know cases when people after divorce don't even know their ex last name in present ,plus there are some who can marry 2 or 5 times in a life ,so i would write her maiden name.
