  1. Wow this is annoying. I went through something similar. I had the one year extension letter and the DMV person would only extend my DL for 5 months. So back I go 5 months later with the same letter and the DMV person said she had no authorization to extend me DL and she would have to fax it to USCIS. Ummm ... ok. I was very polite and took her name (I told her in case I had to come back). A week later I received an extended drivers license. Phew but annoying.

    Just take names with all the DMV. Document everything.

  2. Why are you worried about the interview?

    I was on a TN and married a USC and adjusted status. He asked why we waited 1.5 years after the marriage to adjust status and I told him it was because we only decided to adjust status once I got pregnant as I may not go back to my job. We had planned to immigrate to Canada (my country) after my 3 year TN was up. So that was my reason to adjust.

    And quit your job once you get the EAD if you want. You're not stuck to your job once you get the EAD. I'm not sure why you would think it was a bad idea.

    My IO focused on when I had last entered the country and did I have proof of legal entry (stamp in my passport, which I had). Just be honest.

    Is it something in particular you are worried about? Did you marry a USC?

  3. No you don't have to leave, you can continue working on your TN while your husband (I know you're not married yet but when you do get married) can petition to adjust status for you and your son.

    I would highly recommend not leaving the U.S. like you used to on your TN as they may ask about your last entry. WAit until you have AP or your GC. Also, your TN can be pulled at any port of entry and if they know you're engaged/married to a USC and they feel you have immigrant intent, they'll pull your TN.

    My husband (a USC) and I travelled married while i was on a TN however we always intended on going back to Canada to live, so I didn't have immigrant intent. I never had an issue at the border or at the GC interview (we only adjusted status because I got pregnant).

    You can leave the U.S. and apply for a fiancee visa if that is your wish. You'd have to give up your job and find something in Canada while you waited.

  4. You can adjust through marriage to a USC or through work sponsorship. I did the TN to GC through marriage to a USC and once we filed for AOS, there was no more travelling outside the U.S. unless i had AP (which I didn't apply for). You can still work at your TN job while your application is being processed. If you plan to stay at that job, you don't need to apply for your EAD. If you don't want to stay at that job, then apply for the EAD and once you receive it, you can work anywhere you please.

    I've never heard of applying for AOS through a consulate though.
