  1. My wife is a Brittish citizen and permanent resident of the US. She worked in the US for nearly for years. She has been working in Russia for the last year and one half and will be working there for another year and one half at least and perhaps for many years to come.

     

    For tax reasons, she is considering giving up her residency in the US. First question, is this possible and what does it involve?  If she does this would she be able to apply for and get residency at some future date.

     

    It is my understanding that if she is working out of the US for 4 of 5 years, her residency will be revoked. Is this true?

     

    When is it necessary to get a re-entry permit? My understanding is if she is out of the country for one year or more at a time. Is this true?

  2. My wife got her green card in Sept 2012. She got a conditional visa even though we were married for over two years. It was our understanding that if we were married for 2 years she would receive a 10 year residency. When she called the immigration service, one immigration person said it was a mistake, she should have received a 10 year residency, fill out the I-90. She started to fill out the I-90 and the online process asked her for $139. She did not go any further and then received an e-mail from an immigration officer in San Francisco saying call if you need help with the form.

    She called and he said that she could not use the I-90, that she should fill out the I-75 and pay the fee even though the immigration service was in error in the first place. He said that status was at the discretion of the issuing officer, despite the fact that we were married for over two years and the instructions state clearly that for people married over two years they are eligible for a 10 year residency?? Our dilemma rests in her job as a teacher. The immigration person said she could not submit her I-75 until June 5 2014...contracts are offered in April 2014, she will not be offered a contract if her status is in question and she will lose her job.

    What do we do?

  3. Hello,I am happy to report my wife's I-130 was approved last month and my stepson's was approved May 14 after a brief delay for more evidence request. Will the two applications join at this point? Will I do a single Affidavitt of Support? or do I do two?

    Wife and child are in Tanzania...is it best to be using my US address for her mail from the NVC "Choice of Address and Agent". and scan and e-mail her what she needs? The other part of this question is that my wife and stepson will be in transit from june 10 to August 1...then beck in Tanzania...she is a teacher and will be on summer holiday.

    Thanks in advance for any help on this.

    I am new to this and just beginning the process. My wife is British citizen, has 5 year old son. She lives in Dar es Salaam TZ. We are about to mail the first round of paperwork petition, bios, supporting docs etc and I am a bit confused. Do I file 2 petitions and send 2 fees for Wife and stepson? Also we are opting to go the consular route because my wife is a teacher and under contract so we have some time before she can leave Dar. One more thing, I will mail these papers then will be in Dar till March...will I need to have an alternate address in my cover letter? or have someone here in the US watching the mail?? Is there any way they can enter the US next summer during the process?
