  1. NYC

    Filed November 01 2013

    Interview scheduled for 03/ 2014

Interview Cancelled for unforeseen circumstances 03/2014

Made numerous calls and had info pass

told in October 2014 that file was at the filed office and in line for interview

Did another info pass January 2015

Got letter March 2015 that security checks pending?

Could it be that security checks are still pending? Would the file be sent to the field office without the security checks being completed?

I have been given the run around, I really don't know what to do now, this last letter received about the Delayed security check had no timeline, just that I have to wait.

Please let me know what's my best option at this point.

    Thanks in advance.

Jimmy is right, please follow the steps he provided. If I didn't listen to him, I would still be waiting until today but he gave me brilliant advice and I followed through. I am happy to sign a completed my oath Jan, 2015!!

    Good luck!!

  5. Called the USCIS. They said your case is out of the 120 days pending date and therefore, we are going to put an request for Oath letter or any update on the case. You should receive a response or letter within 15 days to 30 days!!! Waiting game starts again!

    Hey Worried Joel,

I am not sure if you had a chance to check out April 2013 thread but I am one out of two applicants (Canadian Wife) is the second still waiting for our oath ceremony.

After filing in April 2013, I completed my bio in May and was interviewed in Sept 2013. After 120 days, there was no update. I called more than 5 times and all the service requests were answered as my case was pending adjudication.

Now, I filed N400 after filing a I-751 waiver since my USC wife and I divorced around April 2010. I wasnt sure if this was the reason why my case was taking too long or not.

I attended 2 infopasses to check status and my second one, I was told it was the name check that was taking too long.

Well, I decided to wait it out until last Sept 2014 when Jimmy Hou advised me to reach out to my senators or congressman. I searched from my senator the filled out the privacy form online. I sent the signed privacy letter and copies of the N652 I received after the N400 interview stating I have passed my civic test and a decision could not be made. On the copy I attached, I highlighted the bottom where it says a decision should be made in 120 days.

I mailed all these documents to the senator.

I received a notice from senators office saying they have received my paperwork and have reached out to USCIS. Well, about 2-3 days and I receive a response from senators office with an email attached from USCIS. The to & from was deleted from the email and the subject was my last name and A#. The body of the email said they didn't know why my case has been pending for so long but it has been recently assigned to an officer and that my fingerprints had expired so I should wait for the notice and retake.

I got the fingerprint notice in about a week and went and did them for the second time. This was around Oct 21. Well, I gave it 8 weeks (Dec 16) then contacted the senators office again. I received a response from the senators office that included an email from the USCIS. The email stated that my case has been assigned to an officer but it will not be completed before the end of the year.

Early Morning of Jan 5th, 2015 low & behold I get a text & email stating my case has been approved and I have placed in the oath que to be scheduled for an oath.

3 days later, on Jan 8th around 6:30pm; I received an email saying my oath letter has been mailed and I should receive it by Feb 7th.

So as of right now, I am waiting patiently for the oath letter.

    I hope this helps!!

  6. Well, I finally got some good news to share!!

I received a text and email saying my case was update on 01/05/2015. Upon further reading my email, it stated I have been placed in line to be scheduled for oath.

I don't know how much longer I will have to wait to be scheduled but this is far the good news I have heard since April 2013 when I filed. This means I have been approved and I am one step closer to the finish line.

Thank you for all your encouragement but without contacting my Senator, I don't think I would have been at this step.

  7. I am even sure if anyone still follows this thread except me but I think my application is moving..

I called USCIS yesterday and spoke to Tier 2 and asked he if I am being scheduled for the biometrics since I was told my fingerprints had expired. She told me that she couldn't give me the date for the biometric appt but if I don't receive it by 10/17 to call back with a fax # so they can fax me the request.

I feel like some movement is better than nothing.

Much thanks to JimmyHou for encouraging me to follow up and not continue waiting. By the way, I contacted the senator not congressman like my post above said.

  8. I disagree, I think this is good news! Your file was clearly forgotten and now it's been found. If you hadn't acted, you wouldn't have heard anything from them for years, if ever. I think they honestly just made a mistake and lost track of your case, but you've forced them to go find it. The fact that they know that your biometrics have expired means that they actually located your case and looked at it. It's annoying that you may have to do your biometrics again, but at least you know what's going on. Please make sure to follow up with them and if you don't get some information from them soon, contact your representative again. It may take them a while to send you a new notice, but I'd say that if a month goes by, you should act again. Best of luck.

Well, I really hope you are right. So, I think I will continue to do as you suggest. I will wait until Nov for the biometrics notice and if I haven't received it I will contact the congressman's office again.

    Thank you for the advice.

  9. I'm glad to hear that you're not stressing out about it.

If I may offer a suggestion, you could try contacting your congressperson's office and ask them to look into the case. I've read about this proving helpful for several people. All they'll do is send a request for information to USCIS. The difference is that USCIS seems to take those requests a little more seriously.

I've read several cases where the congressional office got the exact same "background check" response, but then the applicant was miraculously scheduled for an oath within a couple of weeks of the inquiry.

I think it just makes USCIS actually go out and find your file and look into it.

    JimmyHou,

Thanks for your advice. So here is my update:

Well, after I hit the 1 yr mark on Sept 12, 2014 I decided to reach out to Congressman Isaackson.

I printed the authorization and mailed it last week. Yesterday, Friday 10/3, I received a letter stating they have received my signed release and the have sent an inquiry to the Atlanta USCIS.

Well, today in the mail, another later from the congressman with a copy of en email from USCIS to the congressman office saying that they have no idea why my case has been pending for so long but has been recently assigned to an officer. It also says the fingerprints I took last yr have expired.

So, now I feel like I am back to where I started.

    More waiting..

  10. I remember reading about your case on the April 2013 filers thread. All I can say is that I've read about several cases like yours where people waited months or years and nothing happened. The only thing I've realized is that if you continue to wait, nothing will happen. There's an applicant who posted on another website that he was waiting for two years.

In about half the cases, when the applicants contacted their Senator or member of Congress, they got a reply from USCIS within a month. The applicant who was waiting for 2 years suddenly got scheduled for an interview. He was told it was a coincidence... yeah right!

So if you haven't done so already, look up your congressperson and write to him/her for fun. Some politicians will have an immigration specialist on their team. Write to your two senators as well. Even if they only send an inquiry to USCIS it will force someone to go look at your file, which may be all it takes.

    Best of luck.

    Jimmy,

After your response last week, I did go ahead and check my case status on the USCIS website. I got an automated response that I should receive a response by Oct 2. So I am waiting for that response right now. In the meantime, I am checking my congressman and senators to see what kind of help they can provide. The only dilemma I have, is having a very common last name which I think it's what is delaying my case.

I will update as soon as I get a response.

Thanks for your time & suggestions.

  11. I thought I'd check in with you two to see of you've heard anything. It's been so long.

April 2013 was the first thread I started following when I found this website so I was following your ups and downs and I kept my fingers crossed for you.

Interestingly, I've found two other applicants who have been waiting for an oath ceremony for over a year (one on VJ and one on another website) and you guessed it, they're both in Atlanta.

So have you heard anything? What sort of action have you guys taken? Calls, letters, info passes, contacting congresspeople, lawsuits?

Thanks for sharing and good luck!

    Hello JimmyHou,

Thanks for checking up on us..it's been really quiet over my end. Ever since my interview on Sept. 12, 2013 I have not heard anything. I did go to two infopasses but I was told they are still waiting for my background checks to clear. I have not taken any other action as I am in no hurry. I decided to just wait until they make their decision. As long as I have my GC am able to leave the country and come back, that's all it matters right now.

    I appreciate you checking!

  12. Here is your options

    1. contact your Senators Office

    2. Contact your Congressman Office

    3.Contact

    Ombudsman - Case Assistance

    https://cisomb.dhs.gov/oca/form7001.aspx

Next step to file the Complaint (sue) USCIS under 120 day rule

Will cost you about 500$ if you do it yourself or from 2000$ -3000^$ if you use attorney

Thank you very much for the information.

Have you decided what your next step is?

I will wait and contact either the senator or congressman on Monday.

  13. Hello VJers,

Can you please advise me on the next step to take? I filed N400 based on 5 years since my wife and I divorced in 2011. I successfully removed conditions with a divorce waiver in May 2012.

    I filed N400 April 2013

    Completed biometrics May 2013

    Interviewed Sept 2013

The interviewer told me I passed the civic test but a decision cannot be made.

I have called and spoke to a tier 2 twice which I was told that my case is still pending adjudication.

I had an infopass on Monday Feb 10 and was also told that my case is still pending and the officer has not made a decision yet.

Please tell me what my next move should be.

I am not sure if I should contact my congressman, senator, ombudsman or file a writ of mandamus.

    Thanks for your suggestions!

  14. Well, I think there is some kind if misunderstanding..

You cannot apply for a passport until you become a US citizen. Once you take the oath to become a citizen, then you can fill the US passport application, with 2 passport size pictures and the correct fees to either a post office which has a passport acceptance center.

A lot of post offices nowadays require you have an appointment to submit your passport application.

Secondly, when the post office told you that you need a US birth certificate that's only a requirement for US born applicants.

Also, they may have mentioned a drivers license since that is used as a secondary identification. But if you do not have a US drivers license, you can use your foreign passport or a state issued id as an identification.

On your second post about SSA and drivers license --I didn't understand what you mean so i can't explain.
