  1. Just starting the AOS process and i'm confused about the "Application Type" in Part 2 of the I 485 form. I see a place to check for K1, but not K3. If I am applying for my wife, how do I answer the "Application Type" question?

    Yes, you have to check the box C,if you entered as K1...for further question, download also the instruction to be sure you answered it correctly.Goodluck!!

  3. I bought a house a year ago for a rental property. Unfortunately, my tenant has not paid me since July. I am in the process of evicting her, but it is taking a long time, and is getting expensive to keep paying for the house with no rental income.

    Somebody told me that if I lose the house due to foreclosure, my wife could be denied a visa. Is there any truth to this?

    My income is around 80k per year.

  4. At the bottom of the G-325A there is a question that says...

    "This for is submitted in conection with an application for-Other (specify)"

    Here I put I 130 (K3).

    Was this the right answer, or should I have said I 130 Cr1/Ir1.

    Should I change it, or send it in the way it is?

  5. Can you take the CFO seminar before recieving a visa? I will be visiting my wife before she has her interview, and I wanted to get the seminar out of the way if possible.

    Do I have to wait until the visa has been issued?

    no you dont have to wait for the visa to have a seminar or before the interview. although you'll have to wait for the sticker stamp from them after she gets the visa which is not of a big of a deal... i have my seminar before my iterview since my fiance and i happened to be in manila that time. but when i got my visa i went back to the CFO Quirino to have the sticker 2 days before my flight to the US. good luck!

    Thanks for the reply...since she will have to go back to get the stamp anyway, is there any real advantage to getting the seminar done early?

  6. I have kind of an unusual situation. I had a big wedding and reception on a Sunday in the philippines. It was a civil ceremony, performed by a civil servant, so it was not official. (civil servants in the philippines are not to do official business on sunday). The next day, on Monday, my wife and I went to the Municipal office in her home town, and were married by the mayor.

    We really considered Sunday to be our wedding, but our marriage certificate says we were married on monday. All our pictures, our wedding announcements, receipts etc say our wedding was sunday april 22. Our marriage license says we were married on april 23.

    I am about to send in my I 130 package. I am thinking i will just write a letter explaining why we had two ceremonies, submit my wedding pictures from my sunday big wedding and reception, some affidavits from three of my wifes family members, reciepts and other evidence and see what happens.

    On the other hand, I could just submit my marriage license, without any pictures from the sunday wedding and without the proof of reciepts etc and see what happens. Basically just send in the bare minimum...and not even mention our big wedding and reception with all the bells and whistles.

    I don't have any pictures of us at the civil ceremony that was the "official" marriage.

    Does anyone see any problem with the fact that we had a wedding on sunday for 150 people, but then had to have a marriage ceremony the next day to make it legal.

    I'm really confused....HELP!!!!

  7. I am assembling my I 130 package...and am putting together my evidence of bonifide marriage. So far I have three afidavits from my wife's father, mother and sister. I am also sending some pictures of the wedding. I have all my e mails, Instant messages, phone bills, e-tickets, reciepts of wedding stuff, etc etc etc.

    How much should I include with the I 130. I have tons of stuff, but how much is necessary?

    I have visited my wife on 5 separate occasions, but we were not living together.

    I answered the question by saying "I have visited her 5 times, but we have not shared a residence."

    Is this a good answer, or would something else be better?

    Reading that leaves the reader confused and wanting more information...

    There isn't room for more information...So any ideas for a better answer?

    You only need to answer and/or explain any previous visa applications where applicable on your current forms. It would also be prudent to inform your wife should she be asked at her interview.

    I would also suggest that you hold off on taking this wife to Disney World.

  12. I was married by a representative of the Mayor of my wifes home town on a Sunday. Civil sevants are not allowed to perform official business on sunday, so the marriage was registered the next day....on monday. My wedding invitaions and receipts say I was married on april 22, but my marriage certificate will say april 23.

    Will I encounter any problems because of this?

    I took my vows on Sunday, but the marriage was officially registered on Monday.

    How should I explain this?

    The wedding was in the philippines.

  13. I had my wife get stamped authenticated copies from the Local Civil Registrar. These allowed me to file the I-130 and I-129F for my wife.

    The US embassy requirement is a copy of MC from NSO printed on secpa. RobinAtAileen posted this process in one of my threads to speed up the process:

    We were told to contact the NSO to expedite the process by asking for the marriage cert. to be "Endorsed." This puts it on a fast track process.

    My wife's mother took an original certified copy from the local registrar and personally ran it up to Manila NSO. They said to come back and pick it up 2 weeks later. This is because she pre-paid for the copies when she dropped it off. I believe she could have simply dropped off the marriage cert. and requested it be "Endorsed" (or fast-tracked) and then ordered the copyies online.

    I'm not sure what you mean by stamped copies from the local civil registrar...Are you saying the municipal where the marriage was registered can give me something to get the process started? And if so...what would I ask them for?

  14. Hi everyone...I was married in the Philippines april 23 2007. I still have not been able to get my NSO certified copy of my marriage certificate. They say it may take from 3 to 6 months to get one.

    That's a big delay in the K-3 process, and I wanted to get advice whether I should submit what I have, or wait until I have the marriage certificate before I begin.

    I know I would probably get a RFE if I began the process now, but at least I would be in the system.

    Would it be better to be in the system, and get a RFE, or would it be better to submit everything when I have it, even if I have to wait 6 months to get it?

  15. After the initial excitement of getting transfered from the blackhole a.k.a VSC to CSC and a couple of touches in May - that sinking feeling is setting in again !!! This def sucks and I hope June doesnt go by without the darn NOA2 .

    Based on another forum thread out there - I know a bunch of ppl with NOA1 dates after me got approved . Anybody else out there who got x-fered from VSC to CSC and waiting on a approval ?????????

    I'm done with work for today ....I'm heading out .........oh wait...its Friday and I-95 is a going to be a nightmare . I'm not liking anything that begins with a "I" all that much. I-130's ..I-95 ...bump the darn "I" :angry: !!

    I hope you were more careful with your I-130 than your timeline...you were married Dec. 21, 2007? :whistle:
