  1. Since my husband will be entering the US in a couple of weeks, I thought it might be helpful to start off a topic that talks about everyone's Point of Entry experience.

Anyone want to start off by sharing their experience?

  2. Congrats, if it is on the Visa then no need to worry!

    Thanks!

    yeeeeeeeeeeee haaaaaaaaaaaaaaaaaaaaaaaawhr !

    Congratulations !!!!

What are you cooking, to celebrate? :D

I'll leave that for my husband's arrival!

Thank God this journey is over.

  3. POE officer can do other things, also, when prompted/asked by a human standing in front of him.

Sorry, I think this thread has run it's course - we have huge language problems, all the way round. Sorry.

I am pleased to announce that my husband's visa is finally issued!!! DoS said its an IR visa!!!!!!!!!!!!!!!!!!!

  4. although you and I know that VISA type directly corresponds to green card type,

the folk that answer emails at GUZ IV are not so bright -

so with that prior email? I can understand how the responders that work there (Chinese Nationals) get confused.

However, this last answer was correct also.

You have two chances to have IR-1 category and be in line for a 10 year card:

    1. visa printing date or

    2. POE date

Good Luck ! Your marriage date is listed as 2009-08-11

so lets see if the folk on the visa printing machine have the right instructions, aye?

I just sent them another email confirming what they said:

    "Hi,

I just want to confirm. Because the Singapore police certificate is within one year, my husband does not need to obtain another one? Also, we were married on 8/11/2009 (married for 2yr 7 month) his visa will be upgraded to IR1 at the time of issuance?

    Thanks"

    And they replied:

    "Thank you for your inquiry.

    Yes, your understanding is correct.

    Sincerely,

    Immigrant Visa Unit

    U.S. Consulate General Guangzhou

    1 Shamian South Street

    Guangzhou, Guangdong 510133

    PRC"

So from their reply, it seems like they will upgrade it to a IR1. If that is the case, he does not need to worry abou the POE officer right? Also, from their first email, it seems like the POE officer makes the decision on whether or not he gets to enter and not the type of visa.

  5. As Darnell says at POE your wife will need remind the CBP officer, the officer may overlook this and if he does then you get the CR1 and not the IR1.

They already told me he will be getting the IR visa so does my husband need to remind the POE officer again? From the very first email they sent me, it seems like the PEO decides whether he gets to enter, not the type of visa. It is the consulate who makes that decision.

"Once your husband's case is ready for issuance, he will receive an immigrant visa. An immigrant visa is a document issued by a U.S. consular officer abroad that allows the immigrant visa applicant to travel to the United States and apply for admission as a legal permanent resident (LPR).

An immigration inspector of U.S. Customs and Border Protection of the Department of Homeland Security makes the final decision as to whether or not to admit the immigrant visa holder as an LPR. "

  6. ya, sorry, visa is not a green card.

Ultimately, the answer lies at the POE, at which date he comes over.

Remind your spouse to have a convo with the CBP human, to MAKE SURE that the CBP notes the 2 year anniversary mark on the marriage date and makes the appropriate entries in the computer.

Good Luck ! Coming off an international 12 hour flight, and talking with a CBP officer to get what you want, is really troublesome - most folk are still kinda asleep and not paying attention to stuff.

Yea but I was referring to the type of visa which correlates to the type of green card. IR = 10 yr vs CR = 2 yr right?

Well, I sent another email to Guangzhou and this time, I specifically asked about the type of visa that will be issued and they replied:

"The visa category will be upgraded to IR1 if your marriage is over two years by the time when the visa is ready to be issued. You don't need to worry about it. "

So hopefully nothing goes wrong and he gets the right visa.

  7. i love how this answer not clarify IR-1 or CR-1 visa type.

Stupid Chinese Workers at GUZ IV.

So, with that as the answer, what was the question?

    This was my question:

    Hi,

My husband will be mailing in the China police certificate and medical report. Singapore will mail his Singapore police certificate separately. I do have a question regard my husband's status. Will he be issued the CR visa that corresponded to the conditional green card or will he be issued the 10 year green card?

    Thank you very much,

    Anna

  8. have you guys traveled together? Do you have hotel receipts, air plane ticket stubs? You could try to get call using skype because it records phone numbers and stuff. For the previous calls, you could have your wife get her phone record from china mobile because it shows the incoming call history.

The last time I used money gram was couple of months ago and it was 9 dollars and took 10 minutes for the other party to receive it.

  9. Yes the packet is normal.

My POE was Boston and my husband was with me, one Officer asked him to go thru the US citizen line while she sent me to the other line,,Later after the other officer took the envelope from me, she asked me where my husband is and when I told her, that he is waiting for me outside as they didnt let us go through the same line, she got so mad and said that they are not supposed to separate Couples...and He or I should have gone with him on the same line...So even if someone else asks you otherwise, Insist On staying with your spouse. It's wont be a big deal.

    Interesting... I didn't know that!

  10. Removal of Conditions on the Permanent Residence Card (CR-1). If you and him have already been married 2 years before his entry to the US he should receive an IR-1 visa and you will not have to worry about ROC.

Sorry... I just re-read their response and they are saying they just issue a permanent resident visa and it is the officer at the POE who decided whether he gets ADIMITTED as a legal permanent resident. (This makes much more sense)

From their response, it seemed to me that after my husband enters the US, I should contact USCIS regarding the type of green card.

    This was their reply...

    Thank you for your inquiry.

Once your husband's case is ready for issuance, he will receive an immigrant visa.

Once applicants are admitted as an LPR, they generally have the right to live and work in the United States permanently. U.S. Citizenship and Immigration Services of the Department of Homeland Security will mail the permanent resident card (often called a “green card”) to the applicant's new address in the United States, usually within three months of applicant's entry into the United States.

If you have any questions regarding green card, you should contact your local USCIS office.

    Sincerely,

    Immigrant Visa Unit

    U.S. Consulate General Guangzhou

    1 Shamian South Street

    Guangzhou, Guangdong 510133

    PRC

  11. Removal of Conditions on the Permanent Residence Card (CR-1). If you and him have already been married 2 years before his entry to the US he should receive an IR-1 visa and you will not have to worry about ROC.

I see... I emailed the consulate yesterday but they said they just issue a visa and it is the officer at the POE who decides which type of green card gets issued? I am confused...

  12. how did it go ? any result ?

Sorry for the late reply. Although I wasn't able to speak with anyone at Guangzhou, however, our visa did get approved a week after I left Guangzhou. Not sure if my appearance made a difference or maybe it did...

I guess a good thing that will be happening is that my husband will be receiving the 10 year green card instead of the conditional green card. Due to this hold up, we rolled past our 2 year marriage mark.

  13. ACH (American Citizen Hour) - that time slot where USCitizens talk with a Visa Officer about stuff related to visas, is no more.

ACS (American Citizen Services) MOSTLY have no Visa Officers there, unless you are LUCKY to get an appointment right after the IV unit handles their time slots for IV interviews. Study the scheduling of IV stuff vs ACS stuff, you should see the two edges on the timeslots..

You might want to visit at candleforlove.com and study a bit on how to 'get in' - also noting the methods have changed over time.

    good luck !

    Hi Darnell,

Where can I find more information regarding the time slots? Its my last day in Guangzhou and I will make one last attempt today.

  14. Hi,

For those of you who went to the embassy in person and was able to inquire about your spouse's immigration case, how did u do so? I made an appointment for American Citizen Services but when I go there, the Chinese officer at the window would not tell me anything. They said they only do passport services which is totally separate from the immigration unit. I asked to see an immigration officer but they said there is no such thing and I would have to send all inquires by email. I seen it in the forums that some people were able to get some useful information when they appear in person. I would appreciate it if someone can tell me where should I go and who should I speak with.

    Thank you very much!

  15. Great news!!!!!! We received final approval letter today. Is was actually approved on Nov 17th......A little less than 90 days since interview and blue slip.......my love will be with me for Christmas :) Thanks all for the help and support.

    Congrats!!!

Aye... it seems like everyone is getting approved except for us...

  16. Thanks Darnell. Yes, when I call the hotline they give me hardly any information. All they say is still pending additional information. I'll hit up the "the IV 'contact us' web portal" more often I guess......In the meantime just trying to wait patiently, well sort of........

    Are you guys still waiting?

  17. Since I am really upset about this stuff and I have no clue where I should head to. I decide to hide the lawyer. Luckily

Marc Ellie has accept my case. Hopefully He can help me. I dont think what I can do next step no more...

    Pay money, let someone help.

    Hey Chris,

I did a little research and it seems like Marc Ellis is really good with cases in Vietnam. There are a lot of topics posted by Vietnamese petitioners and someone even mentioned he lives in Ho Chi Minh City and that he "knows" people in the embassy. Just make sure he is also familiar with cases in Guangzhou.

  18. Thank you ! Ryan!

By the way, What is the best way to do for me right now for stop transfer back the file to USCIS??

    Any good suggestions? Lawer?

One of the side story, My Antie highly suggest me use "Chinese agency" to help me. They said they can help us to appeal "fast!" what's the price! $20000!

I immediately said No! I got visaJourney! Not gonna spend that money for the process that I can do for myself! But My wife hates me now because She think I should spend this money make her can come fast. Sigh, Very stress these days!

Do not use that agency! Thats way too expensive!!!!!!!
