Since 2000, I had been in the United States on a student visa (F-1).

I found a job in my field after receiving my Masters degree. The company then filed an Immigrant Petition for Alien Worker that is currently pending and simultaneously I filed Application to Adjust to Permanent Resident Status Form I-485. I have never been out of status and have always maintained legal status.

My application has been pending since May 2010 and USCIS Texas Service Center has passed the processing time of the I-140 application.For unknown reasons my I-140 has not been adjudicated nor has my I-485 Application.

The unexplained delay is risking me losing this job opportunity as well as other big opportunities I was offered with different Fortune 500 companies.

I have been outside the United States since February 2012 on AP document. My AP document will expire on September 2, in less than a month.

Can you please answer some of my questions below and provide me with any suggestion?

1 - Can the petition for Alien worker and the I485 application stay pending indefinetly?

2 - Can they be approved while I am abroad ?

3 - If I let my AP expire while Im abroad, does that mean I abandoned my application or it's still can be in process?

I was thinking to stay home overseas even if my AP expires and not return the United States unless I get an approval for my GC.

Hello - I have an advanced parole which expires end of August this year. I already applied for another advanced parole 2 months ago but havent received it yet. The thing is I need to travel begining of September. By then, my current AP will be expired and probably I wont have my new one.

The thing is I am planning on staying abroad for few months and asked my friend to bring me my Advanced Parole once issued.

What are the risks here?

I am just waiting on my adjustment of status (green card) from work.

Thanks for responding - I forgot to add, according to my immigration lawyer, my case has 95% chance getting approved without an interview. Regardless if an interview is scheduled, the interview invitation will be sent to my lawyer office. Im sure I can arrange to come to the states before the interview.

Hello - Please help me clarify few concerns. My adjustment of status (Green card) has been pending. I got it throgh a job opportunity.

I am currently waiting my advanced parole renewal application. Once it's received I am planning to leave the US to live with my family for few months. Usually the Advance parole is given for a one year period. My questions are the following:

1 - Can I sty abroad for as long as the Advanced parole permits?

2 - Will my adjustment of status application be still processed while I am not physically in the US OR processing will only resume once I am back?

Hello - I have a question. My I485 application was received on May 27, 2010. I already received my travel document and my 2 year EAD permit. According to the INS website, the last case for I485 applications (emplyment-based) was processed on March 30,2010 (as of July 31,2010)at the Texas Service Center.

Do you know how much longer it may take to hear the final decision?

I filed for AOS based on employment and two applications were filed concurrently (I485/I765). I had my biometrics taken on Jun 22, 2010 and received my EAD card (I765 approval) already. On August 28, 2008 I received my travel document (Advance parole).

My case is being processed at TSC. Do you know when I should expect my I485/GC decision?
