    It would drive me crazy. I would want all cards on the table. After going through all of the immigration hassle there should be no secrets and to me it is inconsiderate of your feelings to make you worry without telling you what is going on. You can only fill in the blanks with your imagination at this point. The person is a millionaire? The person is transgender? The person has a disease? Who knows?

    To me your use of all caps is not nearly as annoying as the people who focus on that rather than the substance of what you say. We were all new once. Good luck.

  2. In some states the day your divorce papers are signed by the judge and filed is NOT the day you are free to marry again. You have to consulte the marriage requirement. Many states have a period of months before you are free to marry again.

    I was surprised when you said in some states one cannot remarry immediately after divorce is final. I did look it up and you are right. As of Sept. 2011:

    Alabama - 60 days

    Kansas and Texas - 30 days

    Nebraska, Oklahoma and Wisconsin - 6 months

  3. I'd like to hear from people to whom this happened rather than people telling me what the law says or speculation about what will happen at ROC or the citizenship interview.

    Did you call USCIS and they sent you a new one? (also, how did they do that? She mails her 10 yr in and hopes it does not get lost in the mail while they prepare her new one?)

    Did you apply to remove conditions as if it were a 2 yr card and if so, what happened?

    Did anyone let this ride and if so, what were your consequences?

    I would appreciate firsthand knowledge of this. I have seen on here where this has happened to people but not seen follow-up as to how they dealt with it later or what issues arose because of it.

    I was able to make contact with a few others who have been through this so that was accomplished. I'm glad I gave some nice fodder for some to give moral advice. Thanks for taking the opportunity to let me know what you (and probably Jesus) would do with no firsthand knowledge of my situation or anyone else who has been through it. Regardless of what decision I make I'm not going to judge how others dealt with it. For some but obviously not all there are conditions in life that would make a person take advantage of a technicality if you could. My reasons would mean nothing to you as you don't know if I am thinking the way I am because I'm lazy and don't want to get off the couch or whether there is an ill relative accross the world that could get treatment sooner, whether I'm rich or I'm broke or whatever. And I get it. Do the right thing and do it immediately.

  4. Are you close enough to the local office to make an Infopass appointment? Not to sound like a broken record but an I-551 stamp in your passport Is the same as a green card and can be done at your local office.

    Thank you very much. It looks like a couple of those people are still around and even active so I sent them messages. The local office is not that far away so I could go there if need be. If it turns out that there are no consequences I probably won't post a follow-up either as I know what that will cause here.

  5. So just to confirm you're not going to correct the card and instead are going to keep the 10 year card and see what happens when you try and ROC in 2 years?

    I should stick to that just to get a good moral judgement as I am sure some would love to tell me how dishonest that is. At this point I still don't know for sure what I am going to do because I have yet to hear from anyone who has been in this same situation and even then I am not positive I will base my call on one person's experience. I don't feel a sense of urgency to call USCIS as we are no where near removal of conditions anyhow. I am definitely hesitant to just put the GC in the mail without having a replacement in hand. It may be that they just send you a new one making the other void--like they do the EAD that they just ask you to destroy.

  6. For "right counsel" I would go to an attorney not to a website. Taking responses here as "right counsel" is more dangerous. I take read this site for anecdotal value not for legal advice.

    You are right. :lol: That is why I had hoped to hear from someone who had been through this i.e. a person to say "It happened to me and the results were..." rather than something someone heard happened to someone or moral advice but hey...I know how forums work. If you don't want answers ya don't ask questions. It's also really cool that this board is so active and you can at least get some amount of input and most people are well meaning.

    I will endeavor to tell you what happens when we try to adjust status in 10 years.

    I'm kidding but I seriously was tempted to leave that without saying anything just to keep things lively. I'm still calling USCIS as if it was a 2 year just not doing it tomorrow.

  7. I see what you mean. The wording of your post appeared as if you were not interested in what the law states but what others have done. I would ask USCIS how to go about doing this. Make a copy of the GC as well. Did she get an EAD? Maybe she can continue using that until her GC is mailed out. All the best.

    She still has her EAD-- did not destroy it once she got the other green card despite being instructed to do so when we were at the AOS interview. I am guessing as far as USCIS is concerned the EAD is invalid because she has been issued a green card. I'll find out what they say at USCIS. I am curious how they do it logistically as it would seem they would not have you mail it in leaving no evidence they can legally work but I'm sure they would also want to be sure her erroneous 10 yr green card is not in circulation. Thank you very much for your input.

  8. The best thing is to know what the law states rather than what others have done. Asking others not to tell you what the law states is knowingly refusing right counsel. While others who had been dishonest may not have had any repercussions from not mentioning it, you may. It is better to be honest about it than rely on the action of those who knew better but may have chosen not to do better. It's best not to feign ignorance. Be honest and let them know. Don't count on others to be your conscience based on what they did. Also, if you had gotten a 2 years conditional when you should have gotten your 10 years GC what would you do? Keep the two years or return it for the correct one? Think about it. It's a no-brainer. Be honest and let them know. Return it.

    There is MASSIVE amounts of what the law says on here and tons of anecdotal information. It's not a matter of refusing the right counsel--I have read it all over the place on here. I plan on calling USCIS--was just hoping to hear from someone who had been through this including how they return it as at the point we send the card in I am not confident she will have evidence she is able to work here legally or that USCIS will promptly handle the situation. I know there was at least one person on here in this situation that had their check and app sent back to them because they were already listed as a permanent resident. I was wondering what the end result was.

  10. came in on k1 visa and got married on august 19 , i already applied for ssn and started some CNa class but havent started working coz they need EAD but since my husband is a lil broke right n ow paying off the credit cards used for my fare and other stuff just for me to get here, i dont think we can file AOS till next three weeks for we need to save up a lil to pay 1010 dollars for the AOS , will i be ok becasue my I-194 will expire on november 2 ....PS we already gathered our papers just havent sent it coz we dont have enough money to pay for it yet ....

    We are in the same situation here except that I was able to borrow $1000 off of a buddy to send in the AOS packet. I think there are alot of us operating pretty tight these days, upsidedown on our mortgages, taking on credit card debt etc. Just got to stay positive, make good choices, know that things will eventually get better and you will see that month where you actually take in more money than are your expenses. I sometimes long for a month where you don't make a cash advance off a credit card to put in checking to cover a bill. It bums me out that I was not in better financial condition on her arrival 6 months ago.

  11. Hello to everybody! Me and my favourite we wait visa К1. He has children. And 13 years ago he has made vasectomy. He is US citizen.

    I don't have children.

    This fact will be a red flag for the consul? What could i to expect on interview? How to be prepared in this case? I very much nervous. I will be glad to any advice.

    I would guess they have an age also where they figure a filipina will not want kids. We have a 19 yr age diff but she is 35. Along with the vasectomy I also have 3 divorces which I am surprised did not make their red flag top 10 list. Proof of a bonifide relationship covers a multitude of sins. There are women out there that are content to be wonderful step-mothers or adopt children. If you can prove time together and communication consistent with being a couple I think you are set.

  12. Hi all. Sorry for starting out with what may be an odd question, but let me try to explain. I only just filed the I-129F, for my fiancee from the Philippines, so we have a while to think about this. We both agreed that we don't need a big wedding in America, just something simple, like eloping.

    I'm divorced from a Filipina (10 years of marriage), and the new fiancee is also a Filipina. (I did not plan it this way, it just sort of happened ... we love each other very much so I can't use the oddness of marrying a foreign Filipina twice in a row dissuade me from doing it again.) For my first marriage, I did have a big wedding (well, not all that big... I don't know that many people... but as many as I could get to come that I knew). So, that's the main reason I don't want another big wedding... the first one was already stressful enough, where I did 95% of the planning too (she had no idea what to do), and I feel odd about calling everyone back to a wedding again, just with a different Filipina in place of the previous one. My mother and other relatives have already indicated they would not accept the invitations if we did. So, big wedding pointless... we'll get married anyway then they can deal with it when we show up for holiday gatherings... they won't ban us entirely from their presence, just won't come to ceremony.

    TV and movies often have people doing the "get married in Vegas" thing. I suppose that's an option, but I'm not sure I like it. How do you find someone nearer by, maybe in my state (MA) or near it (NH), to perform a simple ceremony with no other guests? Are such people always judges? We are both Christians, so I'd prefer whoever does the wedding actually be one as well... I view marriage to also include a covenant with God, so a secular guy performing the ceremony would leave me uncomfortable about that. I don't want to ask my own pastor, since we have a temp at this time, and he'd insist on months upon months of pre-marriage counseling before being willing to do it. (Always a good idea, but not really an option for us due to the time constraints.)

    Should we also try to have a ceremony in the Philippines, either before or after she enters the US? I realize if it is before, then it can't be a true "marriage" although I'm fairly sure it could be a "marriage ceremony" if we never sign anything or turn any papers in. If after, it'd be a while before we could return to the Philippines to do the ceremony, like a year? AOS takes a while. I think a ceremony in the Philippines, if we had one, would be more meaningful to her since the others there would be her family and friends. If in the US, she doesn't really know anyone yet anyway. I'm trying to think of what's best for her and for the relationship in general. Although, she has not given me any strong indication that she'd like such a ceremony in the Philippines, when I've brought it up with her.

    Thoughts? What do other people do who don't do the big ceremony thing? I bet it must be common with K1 visas since the time constraints make big wedding planning more challenging.

    Sorry if I seem like I'm rambling. :-)

    I've been divorced 3 times and I would not think of troubling anyone to come to a big ceremony. I have a buddy who has one of those online ordination cards. Crazy as it is, he legally performs marriages and has clergy priveleges. I may use him for a quick and easy ceremony.

    keith&jezyl, CFO can be completed in advance, but you'd still have to go back after the Visa is issued to collect the stamp.

    My fiancee just had her interview yesterday and intended to take the CFO seminar but was told she needed to have the visa in hand. Has anyone got the CFO early then gone back for the stamp or is that an urban legend?

  14. i hope my wait time doesnt go beyond 7 months...... each day passes like a month.... i check my status twice-thrice a day..

    I feel your pain. After our long wait it got even longer as the medical exam led to a 2 month delay due to the sputum test and culture. It sucks...totally sucks. Her 2 month culture was negative yesterday so she should be cleared to interview after getting her vaccinations today. (fingers crossed)

    Hang in there and try to keep focused on the final destination cuz the journey is painful and aggrivating at times with the endless delays. After awhile I stopped checking the site having gotten sick of initial review.

    Good luck to you. I'm sure it's worth the wait and it WILL happen eventually.

  15. I had a long journey of this Medical.

    Feb 07 - I went there becoz they said there is already results for my culture. But none yet.

    Feb 09 - i was present again at St lukes---- CULTURE NEGATIVE. i WAS SCARED FOR THE XRAY COZ THEY SAID IF IT IS GET WORST I WILL REPEAT THE WHOLE PROCEDURE...like getting sputum test again and it will take time again....huhuhuhu...well i hope not that worst..Pls Lord!!

    The 24th of February came with so much nervous all over my body. Repeat xray was finished in the morning and i was told to make a call at 4:30 in the afternoon for the results. When i called them i was instructed to come back the next day Feb 25...for the evaluation...my goshhh..this is killing me softly....i dont even know what to think...am i passed or what! But all of my friends here said...everything will be fine...you'll gonna be passed...i wish that easy to convince your self if you're the one on that situation. But i am very thankful with them for always there with me for giving me strength.

    Feb 25 7:30- i was really nervous what will doctor will gonna tel me. Wow! I am FINE! They said i can proceed to my immunization today. I was so so so happy and relieved. They called my name for U.S counter for Physical Test again. Then re-peat urine test before getting the vaccine...and finally at 2pm my name called at releasing counter. Now i am sure that i am good to go for my interview. they get my passport and appointment letter to be forwarded to US Embassy Manila. I am so happy and a big smile on my face while i am walking on my way out..and i told to my self "this will be my last day and i have no business with St Lukes any more"

    I know this is not easy....I know how it feels....I just want to tell you all guys... always be strong and keep praying.

    He has plans for all of us.

    I was so disappointed when my gf had to do the sputum test. We were psyched to have here here in a couple weeks only to be thrown into the 2 month delay as spit hit the fan. Well...this friday (March 18th) she is supposed to call as her 8 week culture is up. I will let everyone know how it goes so you have an idea of how it goes currently in this process. She thinks they will say all is good, come get your vaccinations. She thinks they will schedule her interview appt a few days from her vaccinations and have visa in hand in less than a week. (yeah I know...in a perfect world) I have heard that but some things have an urban legend flavor to them and who knows-- I will let you know if it really can happen or not. I kinda hope it happens quickly before the air fares peak.

    If you are reading this because you got dinged on the medical and have to do the 2 month culture--bless you. I looked for whatever I could find about this too and alot of it is several years old. It sucks to have the delay and really takes the wind out of your sails. It does, however, go fast and you eventually start getting that same rush you had after you got NOA2...the feeling it will actually happen soon.

    How did this end? Did you get your Dec interview? Hope so. I was reading this because our 2 month delay is almost up (Mar. 18) and I was wondering how soon after the result you could get an interview. Seems sometimes it is weeks. I was hoping days. good luck and hope all went well.
