  1. Hello,

    Has anyone traveled while the I130 is in process.

    My friend is a USA citizen and recently got married to her Mexican citizen husband. They got marries in the USA when he came to visit her a few months ago. He was/is on a tourist visa. He left the country after they got married for a few weeks. He is currently here in the USA again. They want to mail their application. He has to go back to Mexico for personal reasons. Can he go back to Mexico and come back while the I130 is in process. Does he need any other forms?

  2. He applied for it. Got a letter through the mail stating that he was able to travel and work for an extra year. It also said that he was going to receive another letter with an appointment (biometrics). He received the second letter with his appointment. He went to his appointment and they stamped his paper and told him that he was going to get his new visa by mail.

    From what you wrote, he has not yet removed conditions on his residency.

    He has only applied for removal of conditions.

    Just to make sure if I understood.. He can go back to Mexico before his visa expires, right?

    His wife can stay here and start the I-130 process, correct?

    We assume he came to do touristy things, suddenly met someone, fell in love, and decided to get married.

    Generally speaking, goes to mexico when tourist purpose is over, does consular processing.. with his american wife filing a CR1 petition. Ideally.

    Or AOS. Up to them.

    I am an ESL instructor helping my student with her I-130. I am trying to avoid her paying an attorney 3,000.

    My student is a USA citizen and she wants to bring both of her parents to the USA from Mexico.

    This is the table of contents I created:

    Form I-130 for my mother (Beneficiary)

    $420 Fee

    Form I-130 for my father (Beneficiary)

    $420 Fee

    Mother’s birth certificate and translation

    Father’s birth certificate and translation

    Parents’ marriage certificate

    Copy of my birth certificate (Petitioner)

    Copy of my passport (Petitioner)

    Is there anything else that I need to include? Does she need to include passport photos (herself or her parents)? Does she need to fill out the G325 (biographical form)? Does she need to include any other evidence ?

    Any help would be appreciated :)

    You make the ASC and interview app online at the same time. Before you do the app. you have to fill out the DS260 online. This is where you make your appts... https://usvisa-info.com/es-mx/selfservice/ss_country_welcome You will need to create an account. You do not need to make an app for the medical.     Hi Charlie&Nellie,

    I am wondering if you could tell us how it went for you in Juarez. We just received a letter from the Consulate saying that my wife is eligible to make her appointment. I am unclear as to what we are making an appointment for. Is it the ASC, the interview, the medical exam or all of the above? I don't want to have to travel to Juarez more than once if it can be avoided!

    I plan to start gathering everything I need, but I don't know where to start :/ As of now, I am in the USA because I came to have my baby here :) I plan to go to Mexico in a few weeks so that my baby can meet her father and to get married by court. I do not have to attend the interview, correct? I won't be staying in Mexico for a long time :( I recently got hired as a sub which means I have to come back to the USA before school starts.

    Does anyone have an outline/ guide of what was sent? Any tips...

Hi Ximena, it sounds like you guys have a few options and need to decide what is best for you... but just to let you know that if you want to come back to Mexico, get married, and apply for his visa from here, you can do that through Direct Consular Filing (DCF) as long as you are a resident here in Mexico (not just on a tourist visa - but you have dual citizenship, right?). The DCF process is very quick if you have all the supporting documents. Some people have received their visas in less than two months. If you follow that route, you might need a joint sponsor (since you won't have a US income) and you will need to show that you have maintained or intend to re-establish domicile in the US. It's not too difficult and there's a lot of great info on this site for help along the way... and people who have gone through the process too... smile.png
