  1. Ok thank you. I just re-read the 90 day filing requirement. That is a relief. I am a Pilot on contract and still residing in USA with my wife. The minimum physical presence requirements is a tough one for me because even if I am at work, I could be out of the country most of the month. It is a job requirement. Not sure how the USCIS will look at that but customs does not seem to think its an issue and have spoken to Customs multiple times on the phone and they said it was alright as well.

    Its been a while since Ive posted on here but my 2 year GC expires in Jan. I have made the mistake of not filing 6 months before to remove conditions as Ive been working alot and dealing with other big life events. I am also in and out of the country alot due to work and may have to do this from Canada as my job brings me here often. Any tips or concerns I should have?

  3. I interviewed and passed 3 days ago. No updates, nothing has changed. The girl who interviewed me told me they would send my passport back the same day due to my job requiring me to have one. I called the DOS just now and the lady takes my case number and puts me on hold. She comes back and says you can't contact me for info you have to contact Montreal Consulate for any info. What is going on?

  4. So I'm waiting for my passport to be sent back to me. The interviewer told me they would try to send it out the same day. I am tracking the reference ID on loomis and nothing.

    As for the main point of my discussion... I plan on entering the USA the day after I get my passport and then returning to Canada to give my company a month or so notice to leave. How long until I receive my greencard and SSN?

  5. Sure, it's allowed. No problem. The problem occurs when you leave the USA for more than six months. You are free to travel back and forth as soon as you have the CR1 visa endorsed at the POE.

    That is great news. I figure it is better for me to come to the USA with a job rather than leaving a perfectly good job to be unemployed...I would hope they wouldn't force you to do that considering there is no guarantee as to how long the visa process can take.

  6. So my interview is coming up in Jan. My wife is living and working in the US. The issue is I do not want to move right away until I have secured my job in the US. My job in Canada makes me travel to the USA up to 4 times a week. I Imagine this will pose a problem if I plan to work in Canada an extra month or so until I secure my US job and move my stuff down.

    My thoughts are to get the passport back and drive to the nearest border crossing and go through the entry procedure then come back to Canada.

    Now I don't know if I am allowed to do this. Does anyone know?

    When I go into the USA its on a corporate plane (for work) and I do not want to enter for on a business trip and have them see the stamp and start the process.

    What do you suggest?

  7. No. And it is not a false RFE

    The RFE is sent by mail with return documents and instructions and a return envelope. Telling people details by email would inevitably result in people sending RFE responses to the wrong place and make things a big mess.

    I'm not sure about that. There are numerous people on here who have received their RFE via email if you search it.

  8. So Ive been waiting, calling, waiting, working, and finally get a day off again to call the NVC to see what's up and forgot that today is a holiday and no operators!

    Well the avr confirms I have an RFE for financials. My aft of support (spouses parents) scanned things crooked and refused to fill out ALOT of optional financial info m the 864 which I thought wad fine. Guess not.

    I won't know exactly what it is about until it shows up in the mail I guess.

    I thought they would email the rfe info since I was under electronic processing?

  9. So you sent the package after you got the optin acceptance. In the subject line of the email, you put your case number, correct?

    You might want to try re-sending the package again. And add a note in the body of the email that you sent the original email on so-and-so date. I had to re-send both packages and this is what I did.

    I've just called the NVC again this morning. They show all fees paid but show nothing received. No DS-261, DS-260, I-864, etc. I have sent them all and he gave me the standard "please allow 20 business days..."

  10. I sent my I-864, DS-260 and Supporting Evidence all between Oct 21-25.

    When I called the NVC this week to check up on things they seem clueless and say "allow 20 business days for us to process what you have emailed us, blah, blah, blah".

    Here is what the AVR says when I have been calling it for the previous week up til today:

    "a packet of information and documents was generated on oct 20/2011 and will be sent within the next few weeks please follow the instructions carefully and return the information to the address provided if 6 weeks have passed since the nvc sent this letter and your agent has not received this information please press 0"

    What does this mean? RFE? for what? What could they possibly RFE prior to OCT 19? Why are 99% of people CC after 6 days of sending everything in? What am I doing wrong? I have been lagging behind people every step of the way (USCIS, Transfer to NVC, CC) even though I should be done by now.

    I know you are all going to say contact an operator and I have and I will again tomorrow but I have been travelling for work for 6 days straight and this was my first day to track things down. Also note that I received all confirmation emails from NVC that they had received everything (such as when you send the I-864 they send you an email a couple of days later confirming it).

  11. So I was born in Quebec and recently realized that I had to get a new long form Birth Certificate because I was born prior to '94.

    I am awaiting the Birth Certificate which will be here late next week but I am wondering since I have paid the IV fee can I start filling out the DS-260? It is available and Im just not sure how it works. Can I email all of the civil docs next week? or everything except the birth certificate and risk an RFE until I send it in?
