    My wife just received an interview letter for a US Citizenship and ask us to bring a lot of original documents which we have but I am not sure what are these items they are asking for.

    1. What are some examples of marital union and proof of residence?

    2. What is evidence of Selective Service Registration?

    3. An orginal IRS Form 1722 listing tax information for the past three years?

    3. Proof of the termination of all previous marriages for both you and your spouse. We don't have any previous marriages before and how can we get any proof of documentation?

    Most of us have a previous history with the USCIS, either USC or LPR trying to bring our spouse or intended spouse here, adjustment of status, and removal of the conditional residency status. You go all through this again for citizenship. Proof of residence is sharing your dwelling with both names on the lease or home deed, joint ownership of vehicles, insurance, bank accounts, and any legal piece of paper that shows you share the same address. If either of you are a male between the ages of 18 and 25 even as a LPR, have to register for selective service, if not, you don't have to register, can do that online. USCIS requires three years of IRS tax forms filed both from you and were spouse, either filing joint or married separately, we just brought in our original returns with 1099's and W-2's attached just like we submitted with the copies of with the application. But some wrote off to the IRS for transcripts. You also had to send in a birth certificate of proof that one of you is a LPR or USC, they want to see all of the original documents you enclosed with your application. Applicant has to bring in their passports as proof of what you wrote for trips outside of the USA is correct.

    We had to show proof that both of us were free to marry at the AOS, have no idea why they wanted to see that again, my wife would have never received her conditional green card without that proof, we were both previously married, so had to dig out those damned divorce papers out again. But you don't have to if you were never previously married. Also wanted to see our marriage certificate again that made me wonder why my wife even got a green card with marriage to a USC.

    Other crazy stuff, wife wrote down on her employer application she was a LPR, so they wanted a copy of her green card, but if she checked she was a USC, didn't want to see anything, same with her drivers' license. If she did not check she was a USC on her voters' registration, would be told she could not vote, if she did check it, could vote. No proof was required.

  3. So long as your wife did not spend more than 5 years in jaila nd it was not a crime of moral turptitude she will be fine.

    Just submit the final dispostion of the case and all will be well.

    My wife received a "yellow letter" Case File Review Notice stating that she needs to bring a document of her shoplifting arrest to the interview. And by the way she haven't receive the interview letter yet. I heard that they will send the interview letter a few weeks later. Is that true?

    Here is what I am worry about. I am worry that she will be denied for a citizenship due to her arrest for shoplifting (less than $200 of stolen goods). She have the all court document that her case is dismiss.

    Do you know anybody who was denied for a citizenship because of shoplifting?

    Hi hchhon,

    The yellow letter is quite a common thing - some people receive it, some don't. And the interview letter does indeed arrive a few weeks after the yellow letter, so everything is normal - no need to worry.

    I can't imagine your wife is going to be denied for a shoplifting arrest. She should bring all the paperwork about the incident to the interview in case the officer wants to see them. But she should be fine.

  6. I want to end the marriage and she doesn't know it yet and I am not sure if she wants it.

    Well - she'll find out eventually won't she?

    You'll still need to file for divorce through the court system (whether or not you do it yourself or use an attorney) - Her being 'the immigrant' doesn't matter (besides, you're an immigrant too if am not mistaken).

    The court will have the final say as to the child's custody although you two can come to an agreement to offer the court - their final say though. Unless you can prove she is somehow unfit, count on at least joint-custody.

    What do you mean if she is unfit? Is it mean financial or physical unfit for a custody?

    No I understand that, and I am sorry for you! I was just trying to understand because you first say that you want to end the marriage and then a few lines later you say the she might want to end the marriage - you'd probably get different answers depending on which case is yours?

  9. Hire an attorney.

    A divorce mediator is much cheaper if it is an uncontested divorce with few assets at stake.

    Does she want to take the kid with her, though? You would have to agree on the custody of the child, of course.

    I haven't mention anything about a divorce to my wife. I am keeping my cool and do some thinking in my head.

    I am thinking of a divorce mediator too but not sure that is the way to go if a child is involved.

    I am not sure if she want to take the child or not.

    You should consult a divorce lawyer to determine your options. This has nothing to do with immigration and a divorce will not effect her status.

  11. If she is a fit mother and wants custody of the child, it's highly unlikely that you will get sole custody. Joint custody is much likelier.

    I have a few questions:

    Does a join custody mean that I will have to pay for a child support or alimony?

    Does she have the right to have a sole custody of a child if I file for a divorce?

    What is here immigration standing after a divorce? Does her 10-year green card still valid?

    I had to reschedule the fingerprint appointment to any available Saturday afternoon by checking off the box on the I-797 form and sent it to the address provided on the form which is at USCIS DENVER, 15037 E. COLFAX AVE, AURORA CO. I didn't write any letter explaining why I want to reschedule the appointment. Do you think it's OK?. I sent the reschedule form on 7/20/2009 (they received it on the 22th) and I haven't receive the new appointment notice yet. How long should I wait before contact them to see what is going on?

    How many times have you been married (including annulled marriages)?

    I had never been married before and this is my first marriage to a US Citizen. Do I answer 0 or 1?

  15. It means that they have received and accepted your I-751 application and are reviewing it. It has not been approved yet. Several other things must happen first. You will receive a second notice - an appointment to have your biometrics (fingerprints and photograph) done. Once they have completed the security check based on the biometrics and reviewed your application, they will notify you that a) they wish to see more evidence (an RFE); b ) they wish to see you for an interview and will set up an appointment, or c) approve you without an interview and will send you the 10 year green card. There is no saying how long - or how short - a time this will take:-).

    Carry the notice that you quoted above along with your expired green card - together they prove that your green card is extended for a full year while they assess your application. You can continue to work and travel the exact same as you did with just the unexpired green card. Good luck on a quick approval.

  16. My wife had her biometric yesterday and when we came back we found another letter for 6/3. One thing that I made sure was that check to see if our case was touched right after the biometrics. We did have a touch on the case so I know this went right through their system.

    I have asked my wife to show up anyway to the next appointment just to make sure. We also checked that all the information from both letters was the same so it may really be a computer glitch.

    Anyway, I suggest that if you went to the bio and got another letter make sure to check that your case is touched the same day which means that the prints have been inputed into the system.

    The system won't accept "bad" prints hence you are not allow to leave the place unless the prints are done properly.

  17. Hey, I am receiving two biometric appointments for the I-751 petition as well, received them about one week apart!

    The first appointment is on 05/30/2008 at 2:00 PM and the second appointment is on 06/06/2008 at 1:00 PM.

    Which appointment should I choose to go? Just to be safe I think I would make it to the first appointment.

    The biometric processing center is about 50 miles - about 1 hours drive and I would hate to go there twice.

    For those who are in the same situation and go to the first appointment and get the biometric done please let us know.

    I was trying to call this number 1-800-375-5283 but I got no where - kept getting recorded message instructions to here and there.

    Here is my update. I mailed the I-751 package on May 3, 2008 and received a I-797C, Notice of Action on May 13, 3008.

    Here is what the I-797C, Notice of Action says:

    Your conditional resident status is extended for a period of one year. During the one-year extension you are authorized employment and travel.

    In order to further process your petition, you will be receiving an Application Support (ASC) appointment notice with a specific time, date, and location to capture your fingerprints, photo and signature. You MUST wait for your appointment notice before going to the ASC for biometric processing.

    NOTE: Conditional resident applications, including conditional resident dependents residing overseas pursuant to military or government orders, WILL NOT RECEIVE an ASC appointment notice. To complete biometric processing, these applicants must submit the required items listed on the I-751 form instructions.

    If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. PLEASE INCLUDE A COPY OF THIS RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but is not limited to, the following items:

  19. The final disposition letter says that she was charged. It didn't say that she was convicted.

    The clerk told me was not convicted.

    Not really - conviction is the state of being convicted or pronounced guilty of an offence.

    The punishment (such as being sentenced to imprisonment) is a different aspect of it.

    I have heard that she has to wait for 5 years because of her shoplifting incident.

    My wife was ticketed for shoplifting and the police told her to go to court the next day.

    The judge asked her to pay fine and 16 hours of community service. She did not spent any jail time.

    The Judge gave her 180 days probation. After 180 days she was dismissed.

    We answered YES on I-751 but not sure how to answer these questions in section D of N-400 when the time comes:

    * Have you ever committed a crime or offense for which you were not arrested?

    * Have you ever been arrested, cited or detained by any law enforcement officer

    (including USCIS or former INS and military officers) for any reason?

    * Have you ever been charged with committing any crime or offense?

    * Have you ever been convicted of a crime or offense?

    * Have you ever been placed in an alternative sentencing or a rehabilitative program

    (for example: diversion, deferred prosecution, withheld adjudication, deferred adjudication)?

    * Have you ever received a suspended sentence, been placed on probation or been paroled?

    * Have you ever been in jail or prison?

    * Have you ever given false or misleading information to any U.S. government official

    while applying for any immigration benefit or to prevent deportation, exclusion or removal?

    * Have you ever lied to any U.S. government official to gain entry or admission into the

    United States?
