    My fiancee's K1 interview is scheduled and I am getting worried about her past F1 visa issue.

    She had applied for F1 visa last year and it got denied because of potential immigrant reason.

    On that visa application form we hide the fact that I (as fiance) am living in US (question where you have to write if any immediate relatives living in US)

    Now if during K1 interview they pull that record how would that affect our chances?

    What should be the best answer in case interviewer asked why didn't you mention on F1 visa that your fiance living in US?

  2. I will share my experince very recently on local police clearance certificate. I too belong to Chennai embassy as my hubby lives in southern India. Here is the procedure.

    If you lived in a city more than 6 months after age of 16 then yes you have to get the local police clearance from each city.If the city falls under a commissionerate then you go to commissionerate office and get a form(worth 100 rupees), fill up the form and apply there. Commissionerate office will forward that to the corresponding police station you belong. Then the local police will do an enquiry about your criminal background in their record and clear you. You can get the cert. from commissionerate office.

    If you does not belong to a commissionerate then go to the district head office(usually SP office) and apply from there. Write an application to Superintendent of Police and mention the purpose why you need the certificate. They may ask you to do an affidavit of the purpose and a self declaration that no criminal cases pending against you. Then SP office will forward to your local police station and the local police station will check the record about you then will forward their inquiry to SP office. Then you have to go to SP office and then they will issue the cerficate.

    I am explaining you my experience on getting the certificate from SP office. Hope this may help you.

  3. Just wanted to share with all you guys that I received NOA2 approval!!

    Filed on 1st Oct, took exactly 5 month 10 days....not bad. (CSC)

    Big hurdle is over but got to prepare for next one now.

    I have couple of questions-

    1. Does beneficiary need police cert for all places she stayed after 18 yr?

    What exactly this cert mentions and how difficult it's to get?

    I am talking about Chennai embassy and its difficult to deal with police dept in India!

    2. Do I need to send my passport to fiancee to carry it for interview?

    It contains all stamps of my visit.

    Most of people have had this problem where we don't have last name.

    I am filing K1 for my fiancee who has only Given name and no last name.

    On her passport there is only Given name as (xxx yyy) and family name/surname is blank.

    I am wondering what should I put in place of Family Name on I-129f or G-325A?

    Also there is not enough space in both of these forms if I decide to put only her Given name as First name and keep Last name field blank.

    Any advice?

    Also you mentioned that DCF process takes around 3 months-

    6 - The time processing for DCF is around 3 months. It can vary from 3 months and some more days(like 15 days more).

    Now its 3 months after initial 90 days residency period?

    So total 6 months for file to go from Delhi to Mumbai ( it'll be my local consulate)?

    and maybe 1 more month to get Interview date.....am I correct?

    Anyone with experience of DCF at New Delhi for I-130?

    This option is certainly tempting but how safe it is? Is it worth risking K1 route?

    Here is my situation-

    1. I am Indian national by birth and recently acquired US citizenship through

    Naturalization.

    2. Ready to file K1 Visa (I-129F) with USCIS in US for my fiancee.

    3. Planning to go and stay in India for 4/5 months on Entry Visa.

    My question is-

    1. Whether I would be eligible to file for I-130 if I got married in India?

    2. What is the residency requirement? How many days?

    3. If I am eligible, how the residency period is calculated?

    (from date of marriage or my date of arrival in India or date of registration with

    Foreigner’s Regional Registration Office (FRRO) in India?)

    4. Do I need to be employed in India to be eligible?

    5. If I am eligible, when do I apply- at the end of my residency period?

    6. How long is the processing time at consulate?

    I really appreciate to hear back your feedback......
