We asked our immigration lawyer (not our real estate lawyer) about this. We asked if it's going to be a major ding on the application and he said, "If both of your names are not on it, don't send it."

No, I have not heard of a similar case. I have read posts about unable to send proof that they live in the same house because they live in their parents' for economical reasons.
