If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. If it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date announced in this bulletin.

There are 3 possibilities:

1. IF the USCIS office decides that Visa Officer was wrong, and the entire content of the casefile was sufficient, then the I-130 petition will be re-affirmed by USCIS, sent on to NVC with the re-affirmation, then NVC will send it on to the IV Unit for another interview.

2. IF the USCIS decides that they MIGHT re-affirm the petition if the USCitizen Petition sends in more information, then the USCIS office will generate a letter to the USCitizen Petitioner, asking for more things. There will be a list. If , the stuff she returns to USCIS is found to be sufficient by USCIS, the petition will be re-affirmed, sent on to NVC, who will in turn send it on to the IV Unit. OTOH, if, what she sends in is found to be insufficient, there's great chance that the USCIS office will uphold the Visa Officers decision, and the Immigrant Visa Application will be sent on, with a recommendation to deny the Visa Application and Petition for Application.

3. If the USCIS decides that in the totality of the casefile, including the casefile notes from the Consulate Office, warrant a denial, they will write the USCitizen Petitioner with the results of their findings.

im marry to amricain citz 3 years go ;;;;; and last years my wife try to fix my papers for me to be with her and start our life like &ny husbnd and wife in this land ; papers is fix by one laywer and consulat send me letter for test phisico and time for intrveiw . i past test and intrview very good but this CO told me that thry will send back my papers to immigration with out let me know why ??? now is more then 3 months we dont know where is papers , my wife try to call immigration and they told her that process is finsh and visa is apporved !!!!! i send letter to consul only to know why i dont get visa but no answer??§§§§!!!!
