  1. miss monkey .....I am now waiting for my peruvian financee to have her interview , and if all goes well , she will be here in july . I worry that she will be in same situation as you . She is from Lima and I live in rural Georgia . A big difference all in itself. Maybe a Peruvian group from visa journey could be started where all concerns can be discussed as well as anything else you want to talk about to help each other and to socialize or get togther or whatever . Just a thought .

    You mean that you didnt ask for a K2 visa for the minor child? or the mother doesnt have the custody? :blink:

    in answer to you questions ... the beneficary and the father of the minor child have joint custody. it was agree that the best place for him (age 9) would be to remain with the father and to keep attending the same school (navy school ). there he has all his brothers and sisters and extened family . At some time in the future , we will apply to get him a visa. This was no easy decision on his mothers part, but it was decided that his place , for now , is in peru , and her place is with me in US.

  3. I, like you , had a charge from 1982. Mine was for trafficking drugs. Pled under first offender , received probation. Probation ended and records were expunged. And , Yes , I was worried that I would be found ineligeable. I answered truthfully on 129 question , which was yes . I also obtained a statement from the court where this took place ton that effect , and included it with my 129 petition.I also included a brief statement saying all this . My noa 1 date was nov 16, 2010. Checked immigration web site and saw that I had no2 last friday . no hard copy yet . I think that you will be ok . Just wait . I know it is hard but you answered truthfully . good luck .

  4. Except the oldest two are over 21 and not eligible for visas. I do not see it as a problem at all. Be prepared to answer just in case and YES you will need documentation for the younger child if the child is to receive a K-2 visa. You will not need it for the petition, only for the interview.

    thanks all! The minor child's father is in Lima. No child will be coming to US.

  5. Only if you divorce in Peru.....

    The US laws cannot force legal binding agreements that were established in another country unless it is agreed upon under the THE INTERNATIONAL LAW OF TREATIES.

    The US can not en- force Pre-nuptial or child support laws from other countries.

    So what do you think?

    Ok ...so i file for a k-1. She comes to US.....Would her signing such agreement before marriage ...and before becoming a US citizen be legal in US ?

    ........situation is ...I am USC....she is peruvian

  6. would a pre nuptial agreement signed in Peru ...be legal in the US?.......this may be a deciding factor in which country to get married in and therefore , which visa type to apply for . If so ....would I need to get a visa in Peru that allows for the signing of contracts ?
