Excuse me for my language. But how in the hell they would be missing documents when we submitted all that is in the checklist including the I-864, tax returns and w2's both of my sponsor and co-sponsor? Me and my hubby are almost losing our minds! Hubby called NVC and without even looking the operator said "Oh we don't have that document, just send us a new one". Wow! Another delay. Omg...my hubby is having countless sleepless nights waiting for me to be there. It is not easy being across the miles away from the love of your life. Even though we chat in skype/yahoo, call each other on the phone, and send SMS daily, none of those communication methods, however, can compensate for the lack of physical contact and being with your partner.
I know EXACTLY how you feel. I miss my wife so much! It's so hard and draining. Everyday just feels like a waste without my baby. My documents have been sitting at NVC for almost 6 weeks now and I haven't had any updates in month. Operators just keep telling me it's under review.

Ugh. Both my NVC packets arrived at NVC on June 20th. On July 08th, I received an e-mail from NVC saying they received my DS-230, but were waiting on my Affidavit of Support. On July 11th, I got sign in fail and the automated voice recording said they received my checklist letter (which I am assuming was my Affidavit of Support). I have called like 4 times since then and they keep telling me they have all the documents they need and that it is in final review and don't need anything else from me right now. I'm so frustrated, I hope everything is ok.

Well, if I were you, I'd start looking for a joint sponsor. The most likely scenario is that they will tell you that you need one when your wife goes for the interview. I've been working since November 2010 making $50,000/yr at a secure federal job and they still are requiring a joint sponsor and my 2010 tax return was above the poverty level (however not by much since I worked out of the country for the majority of 2010). Start considering your options now. At the interview, if they tell you need a joint sponsor, you have 1 year from that interview date to submit more information. I don't know if that includes submitting 2011 tax returns or not. Good luck, and keep plugging along.

Not sure... we were told we needed joint sponsor on the 221g form but the CO also said that if we could get a clear statement saying our oldest child is 18 and is majority in our state and not living with me etc (so that he was excluded from household).. then he could approve my i 864 but thats a diff circumstance... (we did submit clear statement and they did approve)
We were a little concerned that the 221g didnt' say either/or but only said joint sponsor.
Good discussions here. I have submitted my Affidavit of Support to the NVC about June 20th, it is in final review right now. My income for the past 3 years has been below the poverty line because I worked only part time(I was living at home while I finished college). 2010's income was only $9,500. However, since May 17th I have been working with a salary of $30,000. If they say that last year's income was not enough or that I have not worked at my current job long enough and I need a co sponsor and I cannot get one, what are my options? Can I have them hold my papers until I have worked there long enough (6 months?), or until January 2012 where I can show 2011's income statement where I will be above the poverty line? How long will they hold my papers? I don't want to start the whole process over again or something, I miss my wife so much...

Hi everyone... Nice to know that we have the same embassy "Manila" well, I hope you can help me w/ regards of gathering NVC stuff... I just want to know what will it be needed for our aos packet? My husband's stepdad is our joint sponsor they live on the same house so, aside from the the I-864 form for my hubby and I-864a for his stepdad and their tax transcript, employment letter and recent pay stubs, what else does they need to submit? do they need some documents to proof their relationship to each other? I mean the relationship of my husband to his stepdad do they need to establish it? I also understand that the joint sponsor must show proof of their US domicile and proof of US citizenship, what else do we need and what exactly are needed in the aos packet? please help we don't have noa2 yet but we are trying our best to gather things as early as possible... I hope u guys can help me THANKS =)
Some one can correct me if I am wrong, so here it goes...
I don't think you have to prove the relationship, since the joint sponsor can be anyone. As for joint sponsor's citizenship and docimile, you should be able to provide his birth certificate or scanned front page of his passport. As for docimile, any house / rent bills in his name, or even his pay check stubs should do it.
Documents you need to send from the NVC shortcut page:
BARCODED Cover Sheet (to be printed from web when your status is PAID online for AOS bill)
Your OWN cover sheet listing what documents are in the package, so they're easy for the reviewer to locate
Completed I-864 signed
Original Employment Letter
Most recent tax return (all forms)
Copy of PAY STUBS for current year (showing how much money you have made year to date)
Last 3 years Tax transcripts, W-2 and/or 1099 (any source of income) OPTIONAL
SPONSOR: I-864 + all above documents for sponsor. Each sponsor that lives in the same household as the petitioner, should use I-864a, instead of I-864
Make 2 extra copies of this package. Send 1 copy to the beneficiary

I submitted my documents June 22nd 2011. I received an e-mail from them on July 8th saying they received my DS-230, but are still waiting on my Affidavit of Support. For the past 2 weeks when I call, they say that they have "received the checklist letter..." on July 11th, I'm assuming that means my Affidavit of Support. I mailed both the same day, but in different packets since the addressee was different on the cover sheets. Anyways, I have called them twice, they have told me they have received all the documents from me and do not need more documents at this time, and another operator told me on like the 13th that it should be done in 4 - 5 days. I'm just hoping everything goes smoothly from here. Also, Sign in is failing for me. What does the AVR system say when you guys call? I guess from what you guys are saying we are looking at September interviews.

I called the NVC to check on my case status cz we got RFE then we submitted again all the documents and evidences theyre asking and so im checking whats the latest status after they received our checklist, then the AVR stated that after a review of the submitted documents theres still missing blah blah..and they mailed us a checklist last Jul 18, 2011 but we havent received any mail...and so im freaking out what seems to be lacking again, we did submitted evrything they asked for and now what somethings missing again...and so i log in to NVC website and i got an error message :
Sign In Failed
- Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error.
from what i heard this error message is a good sign....how true?...please i need advice.....hoping this is a good sign please God intervene plsss....
I mailed my documents middle of June separately (Affidavit of Support, DS-230) on the same date. Apparently they processed my DS-230 on July 8th, which they e-mailed me saying the DS-230 was processed, but they are waiting for financial proof. I assume they have simply not gotten to my Affidavit of Support yet. Sign in has failed since then. When I call the automated voice message system, they say they have received my checklist letter on the 11th (not sure what that means). I talked to an operator on the 12th and they said my packet was in final processing and should be complete in 4 or 5 days, but I haven't heard anything since. I hope everything is going well, I want to know my wife's interview date. I miss her so much.

I will be filing my Affidavit of Support package very soon. I want to file form i-864EZ. It says on the form:
"Check "Yes" if you are using only your own earned or retirement income that can be documented with an IRS Form W-2. If you are self-employed, you must check "No" to the question and you cannot use Form I-864EZ."
Can I use this form if my previous W2's are not sufficient? I have a letter from my current employer stating my income and check pay stubs.
The previous 3 years I have no made above the poverty line on my income because I was in college working part time. I graduated last summer and worked full time at $12 an hour at an entry level job from September - March (Snowboard shop - they close in the summer). Then I went to see my wife for a month while waiting for the papers to process. Came back and started working for a company making $30,000 salary full time (been there 5 weeks now). I have written a little to include in my package explaining my situation. I am including a letter from my current employer and all my check pay stubs from since September. Will I qualify?
P.S. My chances of getting a joint sponsor are slim, so please don't just say get a joint sponsor. That is my last choice, and the person may not sign.

Hello,
My case was approved by USCIS and sent to the NVC. The NVC sent me a letter with my NVC case number and Invoice ID. I have already paid my Affidavit of Support Fee. I just paid the $404 visa fee online 10 minutes ago. I have two questions:
Do I need to wait for the NVC to send me some barcode cover page or anything, or can I send in the two packets once it shows paid online for both fees?
I've gone through some of the guides and searched the forums on this site, but I was also looking for guides / tips / examples of the two packets (Affidavit of Support, DS-230).
Thanks in advance for any help, I appreciate it.

How does one go about doing their state taxes if their wife doesn't have an SSN? Do they need to request an extension and use the ITIN they receive from the IRS? How are you all doing your state taxes? Thank you.

Our taxes was done by HR block, as married filing jointly, but we have to go thru the whole process, from w7 >> passport notarization >> statement that my hubby would want to be considered as resident for tax purposes >>to form 2555EZ(to exclude my husband's income from the phils.) and I noticed that im getting more in return than filing separately. I did not know how to go about this whole process before, so most of the time I call IRS and franchise tax board (state). When I called franchise tax board, they mentioned about the 540-NR for a non-resident alien spouse, but that did not apply to me. Try calling them magic_knight, if you are not satisfied with their answer, just keep calling them until you're satisfied.

This is seriously pissing me off! I guess I have no choice but to get an ITIN number? Once I get that from the IRS taxes, do I use that number as her SSN for my state taxes? Someone please let me know! Thanks.
Edit - I also need to ask, can I get her passport notarized at the U.S. Consulate in Cebu, instead of the Embassy in Manila? That would be silly.

I called the toll free number and they wanted a notarized copy from the US Embassy in Manila.
How is everyone filing for their state taxes? I downloaded the software and did married filing separately, printed it out and put "NRA" in my wife's SSN field. I am going to send that in soon, but want to know how to do the state taxes. I live in California. Thanks!

To file married seperately, follow the guide, but under SPOUSES SSN, enter NRA. You will have to WRITE this in after printing, but the IRS WILL process it.

My wife is from the Philippines. If I download the Turbo Tax 2010 software, can I file Married filing separately, leave the SSN field blank and print it, putting NRA in her SSN field, that way I can avoid all the W7 and notarization and stuff? Just want to get this over with already.

Courts exercise the I-864 125% poverty level all the time in divorce cases. I know that isn't the means tested portion but it is just as relevant and just as financially destructive in case of marriage failure.

Note: In all the time I have been participating on the forum, I have yet to see the government exercise the I-864.
I'm kind of in the same boat as the original poster. Does anyone know if the government has ever seeked repayment for means tested benefits? I have never heard of a single case.

I only made $9,000 -ish in 2010. I was only working part of the year since I was finishing my last quarter in college and went to go visit my wife for 3 months after I graduated. I graduated now and have been working full time since September 2010. Will I have any problems if I show them my current level of income and pay check stubs, even though I did not make enough money in 2010 according to my tax return? I am an October Filer.

Okay i have read through the forum and i am still confused. Here is my situation.
I'm a US Born Citizen and i am also a Nigerian citizen (i have a Nigerian passport). My husband is currently living in Nigeria. We got married last year August 25th 2010 I have been travelling back and forth between the united states and Nigeria for about 3 years now. I usually go twice a year. I have just graduated from university here in the united states so i plan on relocating back to Nigeria to be with my husband very soon. My question is can i file the CR-1 spouse visa before and wait it out in nigeria?
Yes you can. Keep in mind you will have to still show financial support for your husband (about $19,000 a year) later down the line, unless you have a sponsor.

We are going through this journey 2nd time because our first case was denied after the 2nd interview. So, it could be our old record that USCIS might be able to track down and approve this new case.

This is scaring me now. For 2009, I filed as single, since the tax person my mom usually goes to said I could file single that year, and had 3 years to amend it. So that's what I did and was planning on doing again this year. I am an October Filer. What should I do? Amend my 2009 return now? I don't want my wife's visa to get denied. This is a stupid predicament if it's true. Has anyone filed single and and received a visa still? Thanks.

Do you (petitioner) have any other assets such as bank balance, home etc.?
Does your beneficiary have any other income such as rental etc. and that income would continue even after her immigration to the U.S?

My bank balance isn't anything worth making note of, I don't have any major assets besides a car. My wife works at a call center, so nope.
