  1. Hello,

Does anyone know where I could apply for an emergency advanced parole in Phoenix. There are two USCIS offices, one in Phoenix and the other in Tuscon...I have scheduled infopass appts with both offices but I want to make sure they accept applications for emergency advanced parole. I have my first apppt with Tuscon office tomorrow and it is a 2 hour drive one way so I want to confirm that they have the authority to accept and issue emergency parole. I tried to read up online but I could not find any such confirmation. I am on call with USCIS hotline to confirm it currently. If anyone has knowledge of this, I would greatly appreciate your help!. Thanks!

  2. Hi,

I believe we are in a complicated situation interms of our immigration. Any help by the immigration gurus would be greatly appreciated.

I am currently on H4 status expiring Dec 2011. Do not have a H4 visa stamp in my passport though...my husband's GC ( priority date - Apr 16, 2006) is in processing this month and we filed my I-485 and I-765 on september 1, 2010.

I received a job offer recently and they filed my H1 on a premium basis on Aug 18. I received an RFE on that on Sep 1 ( we dont know the nature of the RFE yet)

My husband and I have to travel to India from mid september to early october for an important family event.

    Here are my questions

    1. Will leaving the country automatically void my petition for H1-B?

    2. During my H1-B processing, if I get my H4 visa stamped in India, will that void my petition for H1-B?

    3. Can the company keep processing my H1-B while I am in India and send me the approved H1 package so that I could get my H1-B visa stamped in India and return on H1-B

    4. If I get my H4 stamped and if my husband's GC is approved while we are in India, what would be the visa status that I could return on?

  3. Hi,

I would really appreciate your help in this matter. Here are the details.

-- I am currently on H-4 status. I have recently been offered employment and the company has initiated H1 processing on a premium basis today (Aug 18, 2010) with a start date of October 1, 2010.

-- Meanwhile my husband's PD is current in September 2010. His I-485 is pending and in this September, I am going to submit my I-485 application.

-- We would have to travel to India from September 14, 2010 to October 1, 2010 for an important family event, which we can not avoid. I would have to go for stamping of my visa during this trip.

    My questions

-- Should I submit an I-131 (AP parole) as part of the Adjustment of Status process?. If I do, should I have to wait until it is approved before I can leave US?.

-- Are there any risks of going for a stamping of my H1 in September before the start date.

-- What are my chances of getting an EAD in September 2010?.

-- If I file the Advanced Parole document and leave to india before its approval, will it be valid. If yes, suppose I get the AP in September, can I return on the AP instead of having to get the H1 stamped?

Any further insight in this matter would be greatly appreciated. Awaiting a reply. Thanks!
