  1. Not very much $.... I don't see a problem with this as long as they aren't racially motivated in a negative or extreme way.

    Based on trends white men will be a minority in the future. I wonder if they will become protected minorities constitutionally when they actually become minority population?

    Until we have eliminated all racially based qualificiation criteria or quotas ( which we should for jobs, degrees, college admissions ) then all people of all backgrounds should be afforded the same opportunity without scrutiny.

  2. wait until they ask for more evidence they mite send you a RFE see what the rfe letter will say first. have the proof for your brother in laws citizenship ready copy of passport, or copy of his birthcertificate, you sent it wih the rfe letter the instructions for the address is there.

    That's what they sent me... it says I MUST SEND THAT INFORMATION.

    What I'm asking is how do you package the information for one of these? Should I write our name on each page, etc??

  3. It's been long time. We just got moved and I'm looking for work. We've been 1 month in our place and internet just got hooked up!!! Yah!!! Now for the boo...

    apparently I made 1 single mistake on the AOS paperwork. I missed the part where I had to provide proof of citizenship for our joint sponsor.

    So, I've got this yellow sheet sitting in front of me... a copy of my brother in laws drivers license and birth certificate.

    How do I send this? What details do I need to know?

    Is there a link about responding to Requests for Initial evidence? I'm searching and coming up little short...... maybe I'm over thinking it.

  4. Hi! I was looking at your time line and I saw that you also applied for a waiver to remove the 2 year home return. Did you apply for AOS just with DOS favorable recommendation or you got the waiver?

    Sorry... long time! We moved at the beginning of the year and just now got internet! I've been job searching. Cross fingers that's tough.

    We submitted and received a letter back with a finding that the 2 year Home Requirement was not required! So, we kind of dodged a bullet there.

    There is a way to submit to see if the 2 year HRR is really required (shorter), but... I would do both at the same time. I'm not sure what the official answer here is? Had we submitted to see if it was required and waited before trying the waiver we would have ran out of time.

    Okay.. we did receive an RFQ that I'm getting the information ready for.

    I didn't include the proof of american citizenship for my joint sponsor. WHAT!? They have a social, etc... crazy.

    That's okay. Guess, it was the only mistake I made?

  5. You can get a positive mantoux skin test if there was a previous BCG vaccine administration. You can do a secondary chest xray test, but those are not very sensitive. I know many practitioners have started using the Quantiferon-Gold TB assay to determine if there's a latent infection or just a false positive. I believe the new USCIS guidelines for civil surgeons reflects this and adds this assay as an option for screening of latent TB.

    Yes.. she had the BCG vaccine... which resulted in a false-positive.

    After running back and forth to the Doctor.. the Doctor now want's to send us to County to run a blood test EVEN THOUGH THE CHEST X-RAYS ARE NEGATIVE AND CLEAR. When I called county to book the appointment they refused and said your doctor needs to sign you off based on the X-Ray. 2 more rounds of calls with County and the Doctor to find that the Doctor is stubborn and will not budge. Fired the Doctor, go to a new one on the list.. way nicer office, way better technology, Doctor agrees with county and says she has no problem signing off. WHAT A MESS!!!! First Doctor has no clue about CDC and USCIS guidelines.. and I'd like to get our $ back.

    So... packet is almost done!! It's amazing how many people that help you that you have to educate yourself to inform them!!???

  6. Hey everyone... thanks in advance!! We're sitting here together working on this packet now.

    I need some help about some details... please answer what you can. :)

    1) Last name change - I came to the conclusion that the Marriage Certificate is an instrument that changed my wifes last name and that the USCIS is understanding that a womans name will be different. So I am filling out the I-130 and she has my last name. However, on the certified translation of her birth certificate she has her maiden name listed and signed. I can't imagine re-preparing the document as I had to save it as an image to get it to print, etc..: Do you think this is okay? We want to be sure to be consistent. I would assume that they are going to be aware that these documents will have both her names.

    2) Address: We have a long distance relationship and I am moving to her city and she is moving from the families house where she is currently residing. The packet will be filed on 12/15 while we move on 12/18. In the documents where it ask where you live together I am putting the new address as the current location as 12/2010 - current. Any thoughts on this? I want to receive all correspondence from them at the new address. Again, worried about consistency.

    3) Original documents: I am wanting to send copies of everything, for example: marriage certificate, her original birth certificate. I'm pretty sure I've read that you can send copies, but that they may request the original.

    4) Proof of marriage: What should we be providing? I could send a copy of the new lease... ( or hold it if asked ), I could have some friends write some letters that we have had a serious relationship since May, we could send actual photos. Please advise. I had settled on sending nothing and letting them ask.

    5) TB test: We are waiting for the I-693 to go through because of a hold up making sure she has TB. As of right now it looks like a false-positive or even TB. What should we do? I know I had a vaccine a few years ago for TB and we are pretty sure she has many vaccines with documentation to prove. We just don't have documentation to prove that she's had the TB vaccine. There is a possibility that I can't get this document signed off from the Doctor for awhile. I've read that the doctor can prepare it and say the person is undergoing treatment and not a threat, etc.. ANY ADVICE APPRECIATED. We were a little worried they would boot us out and deny us just because of this reading... but, I can't see how they don't get MANY false-positives from immigrants because of vaccines.

    6) Sending the documentation: Would you feel like you had to send this on 12/15 or would it be okay to wait a little? What should she have on her persons to avoid detainment if it isn't filed yet?

    7) Is it okay for copies of passports, etc to be in black and white?

  7. The EAD is "free" if filed in conjunction with the AOS. If you haven't filed for it, you will need a copy of your NOA when you send in the EAD application.

    As stated in the above post, work is work, income is income, regardless of it's source, all income is to be reported to the IRS (this is where they take the tax from it), even it's illegally gained.

    I wouldn't start your journey here working on the "side" imo.

    The EAD is free if filed? REALLY!!!??? Where is this written!!!! :D

  8. Thanks for replies. We are trying to change her name. When she went to the DMV today the lady took her drivers license and told her when she could come back and prove that she was going through AOS she would reissue it.

    I was like what the hell??? She had to kind of argue with the lady ( marriage license in hand ) for a temporary license. I guess I'm getting used to it, but I really hope people are going to be nicer going forward than this.

    I'm worried about her going to the social security office tomorrow.

    Is there anything I should know or be concerned about??

    And I think we're going to just avoid the small chance thing. We're going to file the documents before the 15th as if we have a name change while it's in process. We will have kicked off the social security name change, etc during that time... from what I can tell this is the proper way to do it.?

    Does anyone know if they give you anything to prove you are in AOS process so you don't get deported. My guess is you would provide the AOS case number.?

  9. As you just got married, you or your wife can change your last name to that of your spouse, if that's what you want. Usually that name change would be on the marriage certificate but if not, you should make the change now as you would want the Green Card to show the correct name right from the start. From a purely legal perspective, your wife can change her name to yours in a few months or a few years from now, but immigration paperwork requires additional consideration. A new Green Card reflecting the changed name will cost you over $300, so either do it now or hold your horses until she becomes a US citizen.

    So when we provide documents... such as drivers license, copies of her passport, etc.... does it matter that those documents refer or have her maiden name??

  10. Thanks in advance. Hey guys... we just got the certified marriage certificate and ( I think ) since Noemy's visa expiration date is 12/15 that we have to submit before then? Anyways, I don't know if we have time to do or wait for the name change process before the AOS.

    What does that mean? Can we change it shortly after? Would you be stuck with your maiden name until your green card process was finished? If the US government allows us to wait until after 12/15 to submit the packet I think we could do it.

    2.) This sentence is causing me a few challenges. If you can give it your best translation.

    3.) Alcaldia Municipal - municipal township, city hall, , town hall, or mayors office?

    4.) RUBRICADAS - I'm guessing to translate this as: signed and initialed, signed with a flourish, signed and sealed, formally signed, or marked. Do I need to put in " "?

    5.) Jefe del Reg. del Est. Familiar. - this is obviously the abbreviated version of #1.

    6.) Confirmo: - then there is a guys name and signature. I'm guessing to translate this as: confirmed by, examined by, or witnessed by.

  12. Hello and thanks for everyones help. I'm working on translating our El Salvadorian birth certificate now and just wanted to ask for some help translating and maybe other options for getting it done. I'm stumbling through the process myself so that we can save much needed money. The document is pasted below with some changes to identity number and names blanked out to protect identities. I've also included my incomplete attempted translation below that. If you can correct or complete anything much thanks. I am curious about the numbers should they be translated at 21-8-000 or twenty one- eight- zero zero zero??? Also, does anyone know what a Canton is?????? Is it a town??

    If your waiver is in order, then you get married and file the necessary paperwork, I-130/I-485 and related forms... once you get your initial acceptance letter (NOA1) after about a week or so then she is legally able to stay and await the decision. Should all go smoothly. Best of luck.

  14. Can you explain why?This is the 2nd time I read this today. I'm just curious, one of my very good friends got married in Vegas and it was never an issue for her to adjust status.

    I have no idea??? I read this some where.... and I remember it being heavily emphasized.

    I think it's because you can get rush license and married during the weekend. Where as in my state for instance, you have to go together get license, wait 72 hours, come back and marry in front of JOP with witness.

    Personally I don't understand why it would be a red flag? I don't want a big wedding and I'd like to go somewhere other than the Dallas County Courthouse.

    Hopefully someone can shed some light on this.

  15. I was an Au Pair as well, but I must tell you, I always had that form DS-2019 with me. I wasn't a subject of the 2 yr HRR though.

    You need to understand that what she is doing is her right, but it's definitely something that is against the Au Pair agency's policy. At the end of the Au Pair program, everybody is supposed to return home, especially when you have the 2 yr HRR in your passport. Applying for a waiver is not a desirable situation that the Au Pair agency would want to deal with and they will never encourage their participants to apply for it either.

    Hopefully things would work out someway. Keep us posted!

    I think you are very correct. In fact, based off the drilling police like response they had on the phone wanting to know why and what she was doing I would fully recommend for anyone else in this situation to simply request your papers and keep any intentions secret. Just simply say that you need them for your records. If they ask questions about legitimate and acceptable things such as what we were asked: But, where are you traveling? Simply tell them that you don't know and that you haven't decided yet. Do not take no or dragging their feet for an answer. Since we had paid $ for them to overnight the DS-2019 it started to make them look bad 2-3 days later when they are calling us and wanting to know why and hadn't sent what they agreed to send. Just state that by law you are required to have these papers and you want them now.

    To avoid getting to this point... hold on to all your DS-2019's and request the final one extra early.!!

  16. We are working through the getting married part. :)

    She's talked with her family and I have to sit mine down. We are deciding if we are going to JOP or destination to some place like Vegas or Reno. I really love Lake Tahoe and would like to spend a long weekend there. It's just that I've heard Vegas chapel weddings are red flags. So, that kind of disappoints me. I'm not the big wedding with my family type of guy. I'm the I got married and cousin Sam finds out about it a year later type of guy. ;)
