  1. Spouse I-130 approved with her Maiden Name & it is at NVC. PD is not yet current but NVC asked for IV fees/documents including for new born son. While applying for son's passport in India it is required parents passport with spouse's name included. So requesting wife's new passport, so I would like get it changed to married name. Spouse will have both passports new with married name and cancelled previous passport with maiden name. Would this be issue since I-130 is approved with maiden name. NVC is fine as long as produce copy of new passport with request of name change.

  2. Hi,

    Probably a dumb question- but my husband qualifies as a nonresident spouse as well and I'm thinking filing as head of household might be best for us tax wise. Do you still have to file as married head of household, or do you file single head of household since you are considered unmarried? Thanks!

    I checked with my tax filer. He said when spouse is not in US and do not qualify for SSN or ITIN. So it should be Tax return filing as single. This is just for filing tax as single nothing to do with your actual marriage status. Marriage status is where you will declare as married and marriage certificate is document for it. Also, when you see W4 form it says if your spouse is non resident & not living with you currently then select as Single option for tax withholding. It only for tax withholding purpose. There are criterias for house hold consideration and unless you meet you should better get a advise form tax consultant.

  3. Just got the IV Bills today, I filed for I-130 for my wife and daughter only last September, so there is almost no hope right now, I will be eligible to apply for US citizenship November 2012, chances are I will have to become citizen first.

    So my questions are,

    1)does it make sense to pay the bills now? Do I have to pay the bill again once I become US citizen?

    2)since my wife is the principal applicant, do I need to just pay for her only? the note on the website said have to pay the principal applicant's fee before completing the processing(what does THAT mean?)

    you got that through email or in actual mail. Same situationn in my case too. I should also be getting it soon. I would suggest pay it as you never know how it turns. they may move all again when oct approaches.

  4. Well, when your case was approved at the time your PD was current, thats why NVC computer generated AOS fee bill. NVC only process for the month of current visa bulletin.

    Also we would greatly appreciated if you add your timeline.

    Is it. I hope then next step is to pay immigrant visa fee & relevant docs. That will be cool and would keep hopes high..

  5. There is two way you can update your email communication with NVC.

    1. Email to NVCINQUIRY@state.gov. and write your USCIS case number as Subject line.

    OR

    2. Call to NVC at 1-603-334-0700 and listen to prompt voice and enter your USCIS case number, you can get the NVC assigned case number, or you may press 0 to talk to operator and update your information.

    Note: Now adays it will take atleast 12-15 days to receive your case at NVC. please call after following days.

  6. Thank goodness that it takes only 3 months in your state to process the naturalization. For me it took whole 6 months from application sending to Oath ceremony.

    I also feel very bad for all of you guys who waited years for your priority date to become current and had to face this friggin retrogression after almost being done with NVC. So frustrating. I can understand how you guys feel :( coz I am in the same situation.

    Hey Malvika. Good that you are going to be Citizen soon so you are not affected by F2A dates. My I-130 approved 10 days back. So can you please refresh the memories - how do I know NVC received my case. The PD dates are not current but atlease I can get my case number and emails updated with NVC for future communication.

    You can add as derivative with wife's petition at the time of immigrant visa either during NVC processing or

    at the time of Consulate Interview.

  8. Hi Dear VJ friends, How are you all? I was out of VJ for few days !

    What's going on homer4all, ekto, rajalucy, smile99, khanl, perriteyl, lynn12 and all !

    My update:- Finally after two months and 10 days of approval, I received an email from USCIS that my case was sent to NVC yesterday. Hopefully NVC will receive it next week and assign me a case number.

  9. Will my minor child be automatically included with my wife s petition as a derivative beneficiary? I am a green card holder and I already received the DS 3032 and affidavit of support invoice from the NVC but I dont see my childs name in all of NVC correspondence. Does my child automatically gets a visa when my wife gets one and theres no need to file a separate petition for my child? Is there a form to fill up to inform NVC to include my child?

    I guess your child is born after you were filed your I-130. Now you call NVC and tell them you have child to be included, they will ask you to fax birth certificate of child, You need to include child name in DS-230 visa application form which you will be sending to NVC once you complete your avove step i.e. DS3032 & AOS. Thats all it and your child will get visa with your wife. Good luck.

    So happy today.. day arrived for which waited for 1 year...

    Finally got my I-130 approved.. status changed on uscis and it says approval notice sent.

    Still waiting for approval letter..

    My question is who all will receive letter.. petitioner or beneficiary or NVC?

    I am beneficiary and recently chagned address.. but haven't updated on uscis...

    Do I need to do that or should I only update with NVC once I recieve my case number?

    Congrats. If you have recently changed address you should have been updated it to USCIS. Now your approval notice will go to the old address which you have specified in I-130. Hope you have US Postal mail forwarding requested.

  11. USCIS cashed our cheque yesterday, so now I'm waiting patiently for my receipt #.

    Got today NoA in postal mail (03 Sept).

    Filed on 19 Aug to Chicago

    Text/email on 24 Aug (Receipt number)

    Check Cashed on 25 Aug

    Depend on your address location and Service Center location you should be getting your Receipt in postal mail within week of check cashed. In my case it took a 4-5 days to get mail from california to east coast.

  12. Nope.I sent them a certified check..so It is still to be cashed..

    Just another lingering doubt..the Part c employment section ..is it pertaining primarily to the US employment if existing? my wifes never worked in US.Shes worked in India only that to self employed so I have put that in..

    You can find I-130 filled sample form as an example on (website removed by request) . It is very helpful and will clarify most your doubts.

  13. Thanks every 1 I will crosscheck again be4 sendin the packet. One question though the return packet was minus all the tabs I had put in..and stapled in a different order than one I had sent in ..wonder if they associate it better the way they have it stapled??

    Swap, Did they cash your check and did they ever send you receipt. Or it has got rejected straight away.

Im having same problem mine was rejected also for this reason but they do not tell me if i can redo the whole thing again i even made mistake of using wifes maiden name instead of married name and now I dont know how to fix cause case number is filed to that name but I was told here by others if the adress wont fit or they dont have an address to write it on another paper and atach it to the I-130 explaining why no address or to fill in the missing part. I also found many mistakes and I need answer also can I just redo the paper and send back in cause the name is wrong also

    Maiden name in I-130 application is not an issue it is optional which way you want to use and as long as it is in line as mentioned in your marriage certificate and her passport.

  15. I have filed i-130 for my wife(indian) and got a rejection based on the part c question. In the 797 it says name-XXX

    dob-XXX

    country of birth --Unknown..

    and the description for rejection says Part C Address

    So i checked the i-130 and since i had filled it and saved electronically, The state/country field it did not print "MAHARASHTRA/INDIA." It printed just "MAHARASHTRA" I could see this as the only possible mishap in my application.

    can I reprint a new i130 and send the old support documentation?. Also I had included a certified check which is stamped by "US Dept of Homeland Security Citizenship & Immigration Services"..Can I still use this?

    If you are talking about Part C & #2 address - Then put only as India and Zip/Postal Code will make it out is as Maharshtra state. Apart from this you will also mention spouse oversea address in #19 there you can give it complete address state/country.

    Even for Place of birth question you put name of city and India as state/country of Birth.

    I did same.

  16. I know that spouses, also in F2A category, have to mail their DS-230 and evidence to NVC.

    Do children in F2A category have to mail anything, beyond the DS-3032, AOS and paid fees?

    This is what I have gathered information from forums through the others postings.

    When I130 is approved and transferred to the NVC. NVC contacts you when date become current. Lets say at this point you are still green card holder and have new family member now. Then you need to mention it to NVC and NVC will ask you to send them birth certificate and ask to add name in DS-230 form and pay additional $404 IV fee for baby in addition to the spouse IV $404 fees. Thats all about it and baby will get visa same time with spouse at consulate as derivative.

    Now lets say baby is born after file transferred from NVC to consulate and then I guess need to have new DS-230 form filled for baby at consulate at the time of interview and then child will get visa as derivative.

    You know what, when I applied my I-130 on Dec. 2006 CSC was the fastest service center, I was like why mine didn't go to CSC, but now things have changed and CSC has become the slowest service center. They are 1 yr. behind, but does'nt neccessarily mean that it takes whole 1 yr. to approve your case, it can happen way earlier than 1 yr. too. Good Luck

  18. I sent in my daughters I-130 Monday 23rd August to the Chicago Lockbox. Does anybody know the approx timeline that I should hear something back? Or what actually happens from there? From what I gather, from Chicago its sent to the nearest Service Centre, which for us should be either Nebraska or the field office in Kansas city. Is it processed in Chicago or not until it reaches the next service centre?

    Or will I know nothing at all until I get a 'Notice of Receipt'?

    PS-my american citizen husband filed for her as his step child.

    I did send mine I-130 on 18th Aug which reached Chicago on 19th Aug. I got Text message & email about acceptanc yesterday evening i.e. 25th Aug. And it is sent to California center though I am east coast resident.
