  1. Hello VJ friends! I would like to share this complicated problem of my cousin and we need your advice...here's the story..

My cousin came to the US on tourist visa and married her American boyfriend whom she met online but she did not tell her American boyfriend that she is still married in the Philippines and was planning to get an annulment with her first husband.....Her American boyfriend ( whom I considered innocent about her background) all the while thought she is single.

He actually pursued with all the paperworks for her but the Immigration Officer at the USCIS office found out about my cousin's dishonesty and sent her back to the Philippines...

Now, my cousin is trying another visa ( either student visa or H1-B ) so that she can come back.... Will she be able to come back with a different kind of visa?

We adviced her to proceed with annulment first and then re-appeal to the USCIS ( which will cost a lot ) so that she can be legally married to him...is this a good decision?

Thank you VJ friends for any advice!

  2. are they from the Philippines as well? any one of the petitions will take a very long time so I'd say that she file for them. for siblings the wait is over 24 years.

oover 20 if his mom files for him as a USC.

so the wait from his mom would be around 26 to 27 years. until your cousin files for her, she gets a GC and has to wait 5 years until she can apply for citizenship. and she can only file for her son once she becomes a USC.

Here is the link to the visa bulletin the category F3 is for married children of a USC and F4 is the category for siblings of a USC. check under the column for Philippines the dates they are working with.

    http://www.travel.state.gov/visa/bulletin/bulletin_5664.html

Yes Aleful, they are all from the Philippines....I'll just tell her that she should file for both her mother and brother at the same time...So sad to know that it's a very long wait for her brother..... Thanks a lot for the link!

  3. Well, your mother will be considered an immediate relative which means she won't have to wait for a visa number and the whole process should take between 9-12 months. Your brother is a whole different story because he does have to wait for a visa number under an F3 (Married Sons and Daughters of U.S. Citizens) or an F4 (Brothers and Sisters of Adult U.S. Citizens) category. According to March 2012 Visa Bulletin these are the processing timelines for the Philippines:

F3 = 7/22/1992, this means there's almost a 20 year wait for a visa number. Plus at least five years for your mother to become a U.S. citizen, so at least 26 years total.

    F4 = 12/22/1988, this means there's a 23 year wait for a visa number.

Thanks Diana! So if my cousin decides to choose either one, it will actually take more than 20 years

  4. Hello everyone... I would like to inquire on behalf of my cousin. She is now a US citizen and wants to know the best and faster way to bring her mother and MARRIED brother,35 years of age, here in the US.

Is it better if she petitions her mother first, once her mother is here, becomes a US citizen after 5 years then mother petitions her brother (mother to son petition)?

    OR

She should petition both her mother and her married brother (35 years old) to come here in the US?

    Thank you VJ friends!

  7. Hello VJ friends! I am preparing now for USEM interview.. I would like to know the right answers for these questions..

    1.How did you meet?

2.When and where did you meet? -------------------------> Is it about the website or place and date where we first met?

3.When was the last time that you have seen your fiance? -----> I'm confused here., my fiance' came back for the second time (and it was his last visit )on Oct.22.2009 and he stayed until Oct.31.2009, which date is the right one for this question?

  8. Hello VJ friends! I am new to this forum..with some inquiries..

I was diagnosed with chronic Hepa-B but according to my doctor, it is non-infectious and he issued me a medical certificate stating that I can travel out of the country..right now, I am just waiting for my appointment letter for my medical exam and interview..

Should I tell the physician during the medical exam that I have hepa-B?

Do I need to present this medical certificate during my interview at the Embassy? Does my fiance' need to write/email a letter stating that I have informed him already about my situation?

I received packet 3 last July 22, do I need to email any DS-form back to the Embassy before my interview?

Will it be fine to bring money transfer receipts during the interview?

What does an appointment letter contain?

Thank you and may God bless everyone!
