I'm in the K1 process waiting for interview dates for Nairobi Kenya.

I was denied a visitors visa 2 years ago and I'm nervous because I answered something wrongfully. I was asked if I have relatives in the US to which I answered NO. Truth is I do have a sister in the US . How badly with this affect my K1 embassy interview and how can I fix it? Thanks

    I think you’ll be ok.

How long have you been waiting for an interview date? Asking for a friend whose petition was just approved. Thanks!

  2. Really unsure now. I thought they were emphasising alot on it too, but still did not send them. We have all returns since '06 still in our files.

Should I wait for a RFE now or can I send additional information in earlier? And if so, how? I'd figure, I need my case# first and foremost. So, probably awaiting the NoA and then call them. As they charged my CC, I am fairly certain that a NoA should arrive soon.

I'm chiming in to hopefully put your mind at ease. I'm not sure at what stage they send out RFEs, but I did not send tax returns or transcripts and I just received my in-line notification. Hopefully that means we're good but I'm not entirely sure. For what it's worth, I agree that the "or" wording makes all the difference. Nowhere does it say that tax transcripts are a requirement. Good luck!

  3. So sorry to hear about your situation. They can be very tough! The CO studies his case and picks questions intentionally that may trip him up. Obviously they have written in his file that he stated he had a son at a previous interview. That seems really really strange that they would have recorded that while he says he never said it. All I know is that many applicants for tourist visas in Kenya will claim that they have children or spouses even if they don't, so that they can better 'prove' ties to Kenya so they are not denied. I hate to admit it but my husband actually contemplated it when he tried to come to the US for a conference. Using better judgement, he was honest and was the only member of his committee denied for the conference. But now we are thankful and sure it was the right decision. It's got to be one of two things, either your husband mentioned something about a child, or there was a huge huge misunderstanding at one of his interviews. If the latter is the case, it is going to be tough to overcome this denial and prove that he never said that, because 1: the CO is always protected and 2: 'lying' during an interview can result in a permanent ban from the US. I think you have the best idea in mind; consult with an immigration attorney for advice and assistance. Definitely try to get a government official or someone with some authority on board, someone with a good deal of clout, and ask if they can get more specific details on his denial. I have a feeling that an email from you to the Embassy will only result in a generic response informing you that "Section XXX of the US Government immigration law yada yada states that blah blah blah." Some auto answer garbage! Use every resource you can think of and try your best to stay positive. Good luck with everything. I'll be praying for you both!!

  4. That means he has to go back, eh? And probably have another interview...

When I was at the interview with my husband, every one of the 6 applicant before us were denied, except for one that was given the sheet for missing evidence. I think it was for missing a copy of some document, so on the sheet it told them to come back two days later. In other words their interview was rescheduled at that moment. Your case seems similar. He clearly was not denied or they would not be requesting the certificate, which makes me think that it will be rescheduled (however they will not repeat the entire interrogation) once he gets it sent back in. They probably couldn't give you an exact date to come back because the time it takes to get the certificate can vary greatly. I think you will be just fine!! As Jill said, emails work well to get a little info, so maybe a quick message asking to confirm that his case will be reviewed again once the certificate is submitted will work to ease your mind :) Hope it all works out. Best of luck!!

  5. Just an uptade on our status:

Our case was transferred to California service center on May 16th. On July 1st we received email notification that the petition was approved and the production of the card has been ordered. Hopefully the card will arrive soon.

Congrats! Short turnaround for you guys compared to us! March 24- July 5th! So crazy! But at least we are both approved!

  6. Congrats to all the recent activity! I was wondering if anyone has gotten their GC approved who has been transferred to CSC? Seems like those with interviews are making out better than the transfers. Just called USCIS and they said CSC is processing from November- I know that's not true because so many feb filers were already approved and I think a couple march as well. Oh well....Thanks guys! Congrats again!

Everyone filing from k-1 should be posting in the other adjustment of status forum, i don't mean to be rude, but this forum is for people who are adjusting from work visa, tourist visa etc..so when you post about getting your AOS approved without an interview it confuses others (who are adjusting from work or tourist visa) and tend to build their hopes up of not receiving an AOS interview also, when it is highly unlikely. Thank you :)

Well us being transferred shouldn't get anyones hopes up. Lots of people who are having interviews are getting approved faster than those of us who may not. Also-- getting transferred does not guarantee no interview, and a handful of people adjusting for your types of visas have been transferred too, so you can't really predict the progress of your case based on anyone else's. But anyway, if it is upsetting you or getting your hopes up, then no problem, I won't post here anymore. thank you for your input and best of luck to you. :)

  8. I am a March filer (March 4th) and my AOS was approved a few days ago!

I applied to the Vermont Service centre but was transfered to California after my biometrics (March22 nd) and approved 2 weeks later with no interview.

I am waiting for my card now.

    Good luck everyone!!!

Wow that's crazy!! Congratulations! We were transfered to CSC on March 24th... Hope we hear something soon, too!!

  9. Ironically I'm not sure that the walk in biometrics has anything to do with it. While I know it can affect some cases, I have heard of several people who have gotten their interview appointment date before their biometrics were even taken. They just need them at some point in time before the interview. Again though, you are moving very fast, so regardless of whether it played a role or not, you should be happy :)
