    .... An applicant or petitioner may withdraw an application or petition at any time until a decision is issued by USCIS....However, a withdraw may not be retracted.

    On March 2, 2010, the petitioning spouse submitted a writting notice requesting the withdraw of the petition. In accordance with that request, the petitios is withdrawn and the conditional residence status is concurrently terminated. Futher, all rights and privilages derived fro the conditional residence status, including the right to reside and work in the United States, are also concurrently terminated.

    All USCIS action in this matter is termingatd as of the date of this notice.

    This decision may not be applealed. However, the conditional resident may request a review of this decision before an Immigration Judge per 8 C.F.R. 216.4 (d) (2). Please note that a NOtice to Appear before an Immigration Judge will be issued and forwaded to the conditional resident.

    The conditional resident is hereby direted to immediately surrender their Alien Registration Card to their local USCIS Office.

    This decision is withour prejudice to the filing of a new Form I-751 if the conditional resident spouse believes that he or she meets the qualifications for a waiver of the joint filing request.

    I am scared and not sure what I should do now

  2. I am sorry about the confusion I've caused. My husband and I applied to get the conditions removed on January of this year and of February I went to my biometrics appoinment and two weeks after the biometrics appoointment we filed for divorce and schedule an appointment with immigration and gave them a written statement that we were getting divorce as well as a copy of the filed documents. Two month later immigration send me a letter that I didn't know of until two months later that says the following:

    This decision is in reference to Forn I-751, Petition to Remove the conditions on Residence, jointly filed by the petitioning spouse and conditional resident on January 13, 2010.

    In order to withdraw a petition, the petitioner must request a withdrawl in writing. 8 C.F.R. 103.2 (b) (6) states in part that:

  3. we filed together in february to remove the conditions on my temporary residency but two weeks after he filed for divorce. After that we tried counceling and tried to work things out. He also told me that he had withdrawn the divorce and I was waiting from a letter from court that suppost to come in the mail so we can both re-file the 751. things didn't work out and now its been a long time since my temporary residency expired and i never got my permanent residency

  4. I am going thru divoce myself and my husband went out of his way so I don't get my papers accusing me that I was with him just for the papers. I talk to couple of attorneys and they say that as long as can prove the judge that it was a good faith marriage it should be ok. I think they have a time minimun of 2 years that you have to be marry in order for you to file by yourself. I have a very similar situation to yours, we bought a house about 2 years ago and now he want me out and we want to move on...don't be scare of anything if in fact it was a good faith marriage there is nothing to worry about. How long were you married before he filed? Keep writing about your case. Good luck

  5. I understand that sometimes lawyers can be very expensive and most of the things I can do myself but in my case I think I have to seek for their recommendation. When my husband filed for divorce he also made an appoinment with immigration to let them know that we were getting divorce and show them the filed divorce papers (according to him) Not only did he do that he also hide a letter form immigration in which they were asking for me to return my GC. It has been 9 months now since my temporary GC expired. He first told me that we had withdrawn the divorce which I found out he never did. Now I don't know where to take it from here....Any recommendations?

  7. My GC already expired in January of this year. Do I have to wait for the divorce to be done before I can apply for my residency? And would I apply for a GC or a work permit I already had my GC for two years and we filed for the permanet GC unfortunatelly I never got it because my husband filed for divorce and went out of his way to go to immigration too.

    Any recommendations for an attorney? I live in Orange county (california)

  8. I would like to know if someone has a recommendation for an immigration attorney. I am looking for an affordable attorney I would appreciate your recommendation.

    Little about my case:

    My husband file for divorce made an appointment with immigration and let them know we were getting divorce. I received a letter stating that I needed to return my GC but I didn't know about the letter until couple of months after. We bought a house about 2 years ago and now that he want to get divorce he wants me out of the house and I don't have enought money to do the move right now. Thanks for your help.

  9. From your statement it seems that its not a mutual and friendly seperation and he is out to get you. Otherwise he would not have hidden your GC, went out of the way to personally go and explain the divorce scenario to the USCIS, to further complicate things for you. What I don't understand is that why would USCIS ask you to send your GC back. Haven't heard of it till now. The normal course of action by USCIS should have been to deny your case and initiate removal proceedings against you. You should speak to an attorney ASAP.

    He didn't hide my GC he hide the letter from the USCIS saying that i need to return my GC. Why would the USCIS want my old and expired GC?

  10. Why is USCIS asking you to return your green card?

    What is the expiration date on your green card?

    After he filed for divorce he also made an appointment at the immigration office and gave a writing statement that we where getting divorce and a copy of the documents he filed (according to him). My visa expired on January 30 of this year. He filed for divorce about 2 or 3 weeks after we had filed to remove the conditions on my temporary green card. I don't exactly remember what the reason why the immigration office wanted my old green card because my husband took the letter after he had hidden it for 2 1/2 months. But I haven't sent my green card and I haven't done anything because I'm little scare. :(

  11. I've been marry since april 2007, my husband file for divorce in february of this year 2 years and 10 months after we were married. He has not serve me the divorce papers but he hasn't withdrawn the divorce either. I received a letter from immigration that i have to send back my green card. I don't know exactly what to do because marriage is not working out but I want to stay in the US.... Help please
