  1. Hello, i need help, i'm kind confused.

    My maiden name is Elizabete N. S., and when i did the k-1 visa, i put both N. S. like my last names (it's cultural in Brazil). But, when i got married, i got rid of the "N"(my mother's last name) and put my maiden last name "S."like middle name and my last name is my husband's. So, my married name in our marriage license is: E. S. A. , and when i filled the forms and filed for AOS, i put my married name E.S.A.

    Ah, when i arrived, i could not get my SS card, cuz in the port of entry, the stupid officer typed wrong my name, and dropped the last letter, so they informed me, that i just could apply after file for the AOS. So, i want file after i receive my EAD. Because, i'm without the SS card, i can't get driver license, Michigan ID, and etc.

    Last tuesday, i had my biometrics, and when i arrived i filled the form. Even, took with me my passport (maiden name) and marriage license. When i filled the form, i put E.S.A, and like i said, the "S", like middle name. After some minutes, the supervisor said they could so considere my name, like E.S.A, and in the AOS interview, i could change and let like E.S.A. So, i got my biometrics, but in their system is just E.A. Now, i'm confused and don't know much what to do.

    Will my EAD comes with the name E.A. from the biometrics or Elizabete S.A, like on the forms?

    And for example, if my EAD comes like Elizabete A. If i apply now to my social security, can i change there my name and gp back to E.S.A, just like in my marriage license?

    I can't wait anymore for the green card to apply for the social security. But, i'm worried with this confusion of the names. And if they put my social security like E.A., and in the AOS interview i get back to E.S.A, can i go back and update my name in the social security?

    I also have a good education background and recently, got my MBA degree.And i could do good in my own country. But, i´m getting married with him, cuz i love him and can´t live without him.

    I don't think you will have any problem, coz my fiance was 50 and I was 30, and I got the visa just fine, the IO just asked me one question that pissed me off a little bit, he said "Well, considering from your education background and his, and the age gap, are you sure you're not marrying him just to go better yourself in America?" I asnwered "Of course not, I love him, that's why i'm marrying him, how come you make an accusation of me like that?" He went quited and wrote me a visa pick up appointment paper. So I'm sure you'll be fine, just be confident. Good Luck :)

    So long as the rest of your petition is in order -- i.e., nothing flawed, incorrect, or suspicious about the relationship -- then age will not matter. Keep in mind, you will not be the first couple where a middle aged man seeks to marry a younger foreign bride.

  3. My interview is getting closer, and even with almost all documents already well organized. I´m kinda nervous with the interview.

    My fiancé is older almost 24 years than me (he is 52, i´m 28), and he is retired by total disability. He won´t be abble to come to my interview date, but we have lots of documents (like copy of wedding rings warranty, over a year skype callings, several pics, many e-mails, hotels accomodations when he came to visit me, etc) that prove our bonafide relationship (2 years and half together).

    So, would our age gap be a problem during the interview?

    What are the typical questions?

    My fiancé receives SSDI + VA Retirement. What are the specific documents we´re suppose to submit attach with the form I-134, like proof of financial support?

    He already sent to me the documents that shows his receipts from SDDI and VA, and bank statements too. Are these documents enough?

    Yes, he makes over the 125% poverty guideline.

    Through the government website i found this instruction for the form I-864:

    "" What does the sponsor do when he/she was not required by law to file an income tax return during a given year?

    If you did not have to file a tax return, attach a written explanation and a copy of the instructions from the IRS publication showing you were not obliged to file. For general information on income tax obligations, visit the IRS website".

    So, does he need send a written explanation letter why he doesn´t file a tax return?

    Beyond it, it´s requested a copy of the instructions from the IRS Publication. What´s the specific IRS publication about SSDI?

    Any help will be great.

    We gotta organize the documents.

    If he makes above the 125% he should be fine using his tax return plus a few check stubs. If his retirement / disability checks are direct deposited just get a few bank statements showing that this money is consistently deposited into his account. His tax return will show that his anual gross income is high enough and this should be sufficient evidence for the consulate. My wife went through the London Consulate, but they're known for being sticklers for financial evidence. They kept my tax return copies, pay stub copies, and my letter from my employer, but didn't need any of the other evidence we sent. Good Luck! -Rich

    My David and I, we skype everyday,daily phone callings and textmessagins, almost daily lovely e-mails, some gifts and letter through the mail sometimes. And it´s been working good to us.

    And remember, the point is be always focus together.

  7. In my opinion, i think you dont need thousands of pages to them.

    But, you could send some of the pages of the chat history, and some pages of phone bills.

    About the engagement ring recceipt, it isnt really necessary. But, if u have, send a copy of it.

    About pics, my fiancé sent around 50 pics.

    Beyond pics, i´m going to take with me e-mails and phone records from skype, to my interview date.

    Hi everyone,

    I was wondering if anyone knows how many pages do they need to prove ongoing relationship. I do have about 12800 pages of chat history from OCT 2007 till FEB 2009. So could I cut and paste samples from every month? about few lines from everyday we chatted?

    And what about the phone bills?,,,I have about 2000 pages just for 7 months. I think thats a lot to submit with the I-129 form.

    Do they need an engagement ring receipt?

    If we are going to file the petition by the end of DEC 2010,,,which tax return? for which year? 2009 or 2010??

    How many pictures do they need??

    we don't have a lot of emails,,,about 6 or 7, is it going to be a problem?

  8. Through my researches, i read that from NOA 1 to NOA2 is between 3-5 months. And after you get NOA2, it´s between 2 weeks - 1 month and half to the interview date.

    Well, i sent a e-mail to the consulate here asking about it. Waiting for their responses.

    The I-864 and the I-134 both have poverty guidelines that have to be met.

    On the guide it actually does say active duty military so i dont think he qualifys for the 100% and he will need to make the 125% mark but he seems to make the mark!

    I realize he doesnt need to file them but the embassy may need to see a reason as to why he doesnt file because you are to include a copy of your taxs for the last 3 years including W2s.

    Why porvety guideline? He makes over 50k a year.

    And he got 100% disability through VA. He has MS - Multiple Sclerosis.

    And since he got 100% disability, he doesnt need pay taxes.

    But, i´m in doubt, if these documents are enough.

    Does he meet the requirements of the poverty guidelines?

    for a house 2 people its $18,212.

    Im not sure if he qualifies for the military 100% because hes retired, you may need to call the military hotline and ask them.

    He may also need to provide proof as to why he doesnt have to file taxes.

    My U.S. Fiancé is Navy retired, and he got retirement for disability. So, since then, he hasnt been paying tax returns. He receives his retirement tho SS and VA (Veterans administration). So, he´s about to fill the I-134 form, and like part of the attached documents, to proof enough income, he wants send these documents from the retirements, beyond the amount informations of his bank account. Would it be enough?

    I also have the same doubts, just like you. My U.S fiancé is 51, and Navy retired for disability. He receives Social Security disability, and he also receives V.A. Disability (VA = Veterans disability), and just like you, he does over $50K a year. So, since he got his disability, he hasnt been paying taxing returns. So, beyond the amount in his bank accounts, he´s planning to send me these documents, that proves how much he receives from the SS and VA Together. Couldnt it be considerated proofs of financial support?

    I am getting ready to start filling out form I-134. I am on Social Security Disability soon to become Retirement Benefits since I am already 65 As you know, Social Security benefits are not considered income when I filed my Income Taxes last year. Some years I have not file at all, but I filed last year to receive the stimulus for buying a home

    last year. This year I also plan to file because I made some energy efficient upgrades to the house. I do not have W-2 forms either since I am retired. Is form SSA-1099,

    Social Security Benefits for the year 2009 enough evidence of income? Somebody suggested going to an accountant to write a letter stating that those benefis were my

    sole income.

    I also own the townhouse I live in with absolutely no mortgage and can provide deed. Finally, I have a savings and checking account with substantial funds in excess of

    $50,000. I also was told in the past, but cannot recall that if I am short on the income, my bank account are considered for the amount I am short, to provide for 5 years

    supplement to the amount I am short to support my fiancée and her daughter.

    Oh Dear, The K1 Guideline instructions said " Mail the package with return receipt requested / delivery confirmation. Send via USPS".. I hope you made a copy of the entire packge... I hope you get good news about your package
