  1. I've read your posts but must have missed this exact part with being able to omit the photocopy. Your information has actually been very helpful to us, so thank you. I just assumed that we probably were going to get an RFE since there was no DS-3025 or copy of it. Thanks again!

I've posted it a gazillion times, but a K1 who is up to date at their medical with the AOS required shots, the results are completed correctly, and signed/dated by the doctor are approved for AOS based on the DS-3025. Being from the UK, you wouldn't have been able to get a varicella shot, but probably had VH marked on your sheet showing you had chickenpox. Most send in a photocopy of the DS-3025 but your case shows that photocopy is extraneous because it's the original in your medical file that counts, as explained in the I-693 instructions.

  2. Oh wow, I wish I'd known that! Wouldn't have changed what we sent in but would have definitely relieved some stress! So then K1 applicants don't have to include any vaccination records with their AOS package if they had all immunizations completed by the time of the K1 interview?

The original DS-3025 was in your medical file. That's all they need if it was complete. (p.4 of the I-693 instructions mentions the DS-3025 must be included with the original medical records to count.)

    Congratulations!

  3. We received Nick's green card in the mail yesterday and are overwhelmed with happiness. Just thought I'd update for timeline purposes as well as a bit of other information. Despite Nick's criminal history, we did not have an interview. We also didn't include either the DS-3025 OR the I-693 for Nick's completed vaccinations (at his K1 medical exam.) We couldn't find the DS-3025 from his exam so we just wrote on the cover letter for the I-485 that we believe they were forwarded at the border upon his point of entry and included copies of his vaccinations printed from his local GP. We were definitely waiting on an RFE for this but it never came. I'm sure it'####### and miss for that and we may have just gotten lucky but I still thought I'd update whoever would be interested.

  4. Thanks for all the help! The bank I'm a member at says a person without a SSN cannot open an account with them. I'm going to check around now though. Does the I-94 expire when you get married or just by the date written on there (in our case, August 23rd) ?? Either way, I think we may just go ahead with everything else (adding his name to household bills, getting his driver's license...)

  5. Hi everyone, just had a few questions...

We are currently adjusting status from a k1 visa and are trying to understand how we are to go to our future interview with a bank account in both our names without being able to open a bank account together since my husband doesn't have a SSN. I called the Social Security office today and was told that a Social Security number was only to be used for work purposes and since he does not yet have his EAD, we aren't able to apply for one.

  6. My fiance's interview was 4/26 and even between the Friday royal wedding holiday and Monday bank holiday, he got his passport/visa yesterday, 5/4. Even so, I wouldn't purchase a plane ticket or anything until the visa is in-hand. The interview was extremely smooth for him even with a few minor crimes on his record. Good luck, you'll be fine!

  7. How were you able to get an interview that quickly in London? We've mailed our packed 3 since early April and we still don't have an interview!!! Congrats btw :)

I believe London is currently very quickly processing packet 3's and everyone I have seen has gotten interview dates around the same timeline as I did. I think it depends on the consulate. Good luck with a speedy date, soon!!

I was looking at your timeline nice how did you get your NOA2 so quickly?

We actually didn't get it fast at all, it took us almost the entire alloted 5 months! We were hoping for sooner the whole time! But it all comes together and is totally worth it in the end :)

    Thanks everyone!

  8. I just wanted to say a huge thank you to everyone who has assisted us on this site- we could never have done this without you. Nick's visa was approved this morning in London, even with his two small crimes on his record. We were extremely nervous but it was a very smooth process. He will write up a review in a bit but just wanted to let anyone know that has a similar situation that they can feel free to message about what was talked about and questioned. Thanks again to all!

  9. Again, I'm not an expert, but if I was doing it, I would probably consider what you have to be complete enough documentation of the facts.

I will only add that your fiance should probably prepare himself to answer questions about the events. He should be honest, but stick to KISS - answer the question which is asked, and don't ramble on. I'm not sure how your fiance feels about all of that, but he'll need to speak about it neutrally and without evasiveness.

You're definitely right about answering the questions asked and being totally honest. We'll definitely update everyone on how it goes!

  10. What about his subject access? Worth getting, I'm sure, since his police certificate will/ should have come back "No Live Trace".

No, the police report came back with his two crimes on it. One for "using harrassing language" & another for "assault on a constable." He got a fine for the language charge and 8 weeks probation for assault on a constable. It also has the sentence listed on the police report.

  11. Do they list the charges as well as the sentence?

It may help to understand what they are looking for in order for you to determine if you have the appropriate documentation. They are looking for crimes which would make your fiance inadmissible. These would include crimes of moral turpitude (Google it for a list) and I think some certain drug related crimes. There is also a minimum sentence (I think it's something along the lines of 5 years in prison, certainly not 8 months probation) which raises flags. Even then, if enough time has passed, the inadmissibility goes away for some things.

I'm not a particular expert, but interpreting what I know (listed above) it is my understanding that if your records include Dates, Charges & the outcome, it should be enough information for the consular officer to make a determination on your fiance's case.

Thanks so much for your detailed response. The court records do list the sentence imposed as 8 weeks probation and the date of the occurrence, just very little else. We were thinking they would have a little more detail on the actual crime. Obviously, we want to have everything possible lined up for the interview as we are a little nervous. The laws are a bit vague on moral turpitude in general but yes, as far as the sentencing goes, 8 months probation is very little. Thanks again!

  12. We have the certified court documents for my fiance's two previous minor crimes, one of which he had an 8-week probation for. Is this enough for the consulate? The court documents don't list any real details of the crime, just the punishment imposed. We requested all related documentation from the court but this is all we got back. Do we need anything further for our upcoming interview on April 26th? We just want to be as prepared as possible. Thank you!

  13. there are a few things which are all slowing it down

i)i have a common Muslim name

ii) my mum was born in a T country (but she has been a uk citizen for over 50 yrs now)

iii) 9 yrs ago (as a 14 yr old) i went on holiday to the middle east

iv)i have a physics degree and mentioned in my interview i would love a job in research

I was born in the uk n have no criminal record so it must b one of them that is delaying it.

I have visited america several times now n there was never a problem so these must just b taken into account when ur trying to get over there permanently.

    Hope you find this helpful

Thanks so much for your reply- it's very helpful. I hope you are out of AP soon, I'm sure it's awful :(

  14. Just wanted to let everyone know that I called the DOS this morning, they said our packet 4 was sent out this morning and our interview date was on April 26th at 9am. Packet 3 was signed for in London on Monday afternoon, the interview was paid for Monday evening and the medical appointment was 3/29 (will update timeline soon.) I just thought it would help people to know where the London embassy is sitting as far as time goes.

On a different note, the court records for my fiance's crime (certified) do not detail what actually happened, just the punishment imposed and dates. Is this ok? We asked for every document they had relating to the simple assault charge (including the memorandum of conviction) and all we got back was a signed paper with the disposition, but no circumstances surrounding the crime. My worry is that "assault on a constable" has such varying degrees and with nothing explaining the events that occured, how will they know whether this was a crime of moral turpitude or not? There was no weapon or depraved motive, it was a brush-off and he got in trouble for it. I suppose the sentence of 8 weeks probation might be an indicator? Just want to make sure we have our ducks in a row.

    Thanks for any help offered!

  15. The intention of the medical is to determine if there are any health related inadmissibility issues. They don't care about the criminal history - that's up to the consular officer to evaluate. Having a drinking or drug problem would be a health related inadmissibility, and having a criminal history that included alcohol or drug related crimes would be a pretty solid indicator that the applicant has a problem. This is why the medical examiner focused on this. It sounds like your fiance's answers were fine. I wouldn't worry about it.

Thanks very much for your response!

  16. Thanks for the reply! That makes me feel better, although not sure how it could be listed on his police report as "alcohol-related" and he wasn't questioned on it?? Lucky I guess! Nick's truly wasn't alcohol-related and we don't supposed he will have any issues at the interview, just wanted to check around I guess. 5 beers in a week to a Englishman is nothing, but the same can't always be said for Americans!

  17. My fiance had his medical interview in London last week, where I attended as well. Nick has two minor past crimes on his record, one involving simple assault. The medical interviewer was questioning him heavily on if this was an alcohol-related offence of not. He answered truthfully that it was not. His court records do not have toxicology reports on them, but he wasn't drunk at the time and the court records do not mention anything regarding that. The interviewer asked about how often he drinks now and he answered about 5 beers a week, which is truthful. He has never had an alcohol-related problem. 5 beers a week is clearly not a drinking problem, but he wanted to be honest instead of saying he never drinks, which would have been a lie. My question is if anyone has had experience with this? The interviewer seemed satisfied that he had answered all questions in the positive. We aren't expecting any problems, but I wanted to see what everyone thought. Thank you!

  18. Im sorry to scare you but im a british born citizen who has now been in AP for over 4 months. We had our big day planned too but as we have now missed that were jus gonna fly over to vegas and get the legal ceremony done there.

Im sure u wont have to go through it though, i have several things going against me which means my security checks will take longer.

I am curious as to what things you have going against you? I understand if you don't want to share but if you do, it would be helpful. My fiance has a minor criminal record (no crimes of moral turpitude) and we would like to hear from anyone else who does. What sort of security checks are you referencing?

  19. My fiance has two previous minor crimes on his police report, neither of which included jailtime. I am told we need the "Memorandum of conviction" records, which is what I believe to be the disposition for each case. My question is do these have to be the official ones that cost 60 pounds each or is it ok to order the 5 pound version? I'm not exactly sure of the difference & what is necessary. The last thing we need is to get to the interview, have them ask for a certain type of document and not have it. It would be helpful to hear from anyone who has gone through something similar in London. Thanks so much!
