I'm submitting an I-90 for USCIS error today. I was issued a CR1 green card instead of IR1 even though I was married >2 years at POE and CBP officer stamped in I551 as IR1.
At any rate, I procrastinated way too long. My conditional green card expires in September (~6 months from now). I'm filing the I-90 to get it replaced with the correct IR1 LPR green card. But reading around it looks like it is a very slow process.
My question is, since currently my status is (erroneously) CR1, what happens if my green card expires before I get it replaced (or maybe denied, who knows) from the I-90?
I know I can get an infopass and get a temporary 551 stamp, but what is the expiration on that? Just until September, or does it temporarily extend it while the I-90 is being processed?
Many thanks!

Hello,
I would like to file an I90 to correct a USCIS error on my GC, however it states that I need to send the original back to them. Has anyone tried sending just a copy? The problem is it is my ONLY form of ID in this country I am very reluctant to mail it off to the abyss of USCIS!

Thanks for the DOS reference.
So do you think I should just skip the infopass and file an I-90? I'd be game for that too

Hello,
This topic has been clarified and reclarified to death on this board. I know that, even if you have a CR1 visa, if you enter the US after your two year anniversary you can get an IR1 status stamp on your passport. Many people have said this and I know it's true because it's what we did :-P
My question is where in the law/regulations/guidelines/etc is this specifically written? I can't find it on the USCIS website.
I ask because we were given the IR1 stamp at entry after explaining/demonstrating to the POE officials, but now several months later in the mail we were issued at a 2 yr conditional GC. I'm scheduling an infopass appointment to get it fixed but I've already bumped into a USCIS official that doesn't know about this. I'd love to have something written somewhere that I can quote.
Any help would be appreciated.

Thanks to both of you for your replies. I'll try the infopass appointment and bring the i90 you linked to.
RE: ROC vs AOS, I didn't know the terminology because I didn't expect to have to do either!
I'll update this post here to see what infopass says if anyone with a similar issue is interested.

Hi, All,
Can someone provide some advice on this issue? Here is the story.
1. Applied for and received CR1 immigrant visa
2. Waited until we had been married for over two years for our POE
3. At POE, immigrant visa/passport was endorsed properly as IR1, as 2 year anniversary had passed.
4. Just received the official green card in the mail today and it is.... CR1!!!! Expires in two years!
But in the passport it is endorsed as IR1!!
This is 100% "their" mistake, does anyone know how I can go about getting them to properly change/re-issue the green card correctly as IR1?
So upsetting, I thought we were done with this struggle! Visajourney got us through the whole application process and we did everything right. I don't want to go through AOS after two years because we were admitted as IR1!
Thanks everyone!

Hi, All,
I need some help. I entered on a immigrant visa (which is now expired) and on entry got an entry stamp that says IR1 in it. I've gotten a note in the mail from USCIS saying welcome to America and the physical green card is on the way, but it hasn't arrived yet.
I've since left the US for a short trip, and have a return flight already. I'm now worried that the "stamp" in my passport isn't the "right" stamp for re-entry as my temporary green card.
So here is my question. I'm attaching a scan of my immigrant visa (WHICH IS NOW EXPIRED!) with the two stamps the did actually put on it. Can someone tell me if this is valid for my re-entry since my physical green card hasn't arrived yet?
Thanks!

Hello,
My wife is now a proud green card holder.
I want to get life insurance for me, and have her as a beneficiary, and vice versa. Is this allowed, or is life insurance for USCs only?
What if conditional LPR expires while waiting on I-90?

The original stamp expired Sep 2011, so it's no longer valid. I suppose if I do an infopass to get it restamped they would see the IR1 and put in another IR1 though? While the I-90 is waiting for processing?
