sorry but you are wrong tweety. the requirement is 3 years from the date on the greencard minus 90 days. so actually you can file the application after 2 years and 9 months after the date of approval on the greencard.

if i am not mistaken you are not able to apply for n-400 because you are divorced. you will have to wait and apply under the 5 year rule. under 3 year rule you must still be married to the same us citizen for 3 years to be eligible for naturalization. i dont think its different for vawa cases but i could be wrong.

filed aos from florida address. bios are aug. 11 in asc in fort myers. will be moving to new york sept 1. have new add. in new york already. if i file online change of add. after bios are completed, does anyone anticipate there will be any problem with having the interview in new york instead of having to return to florida.its pssible there might be an interview set in florida before i make the move. im hoping to get the interview changed to new york if that becomes the case. thanks in advance for inputs

On her GC is a date which says "Resident Since" she may apply 3 years minus 90 days from that date providing on the day she applies you have been married for 3 years. If you haven't been married 3 years on that date you have to wait until you have.

The residence in State is 3 months before applying but if she is back home on vacation her US residence in State still continues.

correction .i did not think it would be an issue

just a little confusion about the qualifying time to be in country and in state of residence. my wife has more than 18 months in usa since greencard was issued. but she had to return to her country for a month recently and will return to usa the 28 of july. we can file n400 the first of august. i read somewhere about 3 months in state residency. is that 3 months total or 3 months consecutive before filing.thanks in advance for opinions.
