  1. Hi Elaina. the same thing happened to me, I responded to the RFE as you did, received notification on Oct 27 that they are reviewing my response and am now waiting. Hope both of our RFEs are cleared up soon. It does not matter what we did or why we did it, it is done and now it will be fixed and others will learn from our mistake...a big part of what this forum is about. Look on the positive side, this RFE is while you are with your husband. What I am most annoyed about is not being able to work, so now I am starting to volunteer today. There is always a bright side to every situation.

    Thank you Lisa for your kind reply... Yes, we do "learn'. I am sending another letter today, as I found a 'blurb' on VJ about the I-693 posted by Capt Ewok...saying basically if you had your medical, and it was sent in the closed packet that you turned in at your POE...you did not have to even file the I-693. I copy/pasted that into my letter, and explained that I had my medical in Canada, that it was in that packet, and I was only given the Vaccination worksheet...which I resent again. I explained that it was MY mistake by filing the I-693, and that was probably what caused the confusion. But, I did have my medical in Feb of this year. So, hopefully this will clear up the matter.   2. Sending in the I-693 without having it properly filled out has caused several people to get RFEs. I am not sure who is advising people to do this, but they should not and stop it. If your vaccinations were complete, you only needed to send in a copy of the vaccination form you got from your medical in Canada. Since you sent in a basically blank I-693, they assumed you just did not have it filled out properly and are wanting to see a correctly filled out and signed form. You can try sending what they told you, with just the note and how you made a mistake including the I-693, but if it were me, I would go to a civil surgeon and have the I-693 filled out proper. I would not to risk it. You need to fill out Part 1- your info, Part 2- vaccinations section ONLY(no full medical needed), and Part 5- where the CS signs off on it.

    I thank you so much for your advice.... I spoke with an Immigration Officer today through Customer Service, and yes... I did not have to send in the I-693, just the Vaccination/medical worksheet. She has suggested that I reply to the RFE setting out what happened, and to include a copy of my I-94, the Vaccination/Med worksheet, 'their RFE" and I explained that my medical report was in a 'closed' packet that I gave to the Immigration office at my POE. Also, that I filed the I-693 in ERROR, and to please disregard. I HOPE this will clear it all up, as the Officer seemed to think it would. Thank you again for your input, it was much appreciated. I DID call a Civil Surgeon here today in my area,, and I may also do that. Just to be safe. thanks again.....

  3. You included only 1 page of the 693? You did not include the 693 vaccination form signed by a civil surgeon in the USA?

    If so -

    You should have never included just 1 page of the 693. You include the entire section of vaccination transcription or no pages at all.

    No, I included the entire I-693, but only filled out the top section with my name, with a note that I had my medical in Feb/2011..... along with the 'vaccination/medical worksheet' which is dated Feb 23/2011.........I was told to do this by other VJ members...and they had no problem. ? Are you saying I SHOULD have my vaccination/medical worksheet transcribed by a civil surgeon here???? IF SO>> I will do that..... and thank you for your reply.. Elaina

  4. I have read several posts relating to the RFE's regarding the Medical; however, I am still a little confused as to what I should do.

    In the RFE I received,they said that " the Civil Surgeon certified the exam more than one year before the date I filed the Form I-485" I had my Medical in Feb of this year, and filed for my AOS on September 27, 2011. I submitted the Vaccination Documentation and Medical Worksheet Two, ( that I received from the Consulate with my K-1 Visa,) along with the form I-693. On the I-693 I filled out the top portion with my name etc, and put a note on that form that I had my medical within the last year. When I received the RFE, I immediately contacted the Customer Service people, who transferred me to an Officer. I explained that I DID have my medical in Feb of this year. This officer told me to write a cover letter explaining that I did have my medical in Feb.2011; along with a copy of the Vaccination/Medical Worksheet two,(which shows the Feb 23/2011 date) and the Original RFE request letter, and mailedl it back to them. Now, I am wondering if there is something more I should do ???

    I am quite stressed over this, I DID have my medical exam, paid for it, and just want to be able to prove this. Can anyone tell me IF they have had this same thing happen, and what they did to resolve this? I did contact the medical clinic in Vancouver BC, where I had the medical and they said to ask the USCIS to contact them and they would confirm this. However, that was 'after' I sent my letter to USCIS. Any suggestions or help, would be much appreciated. Thank you... Elaina

    well yesterday was my birthday,and we got a call from the immigration office that they wanted to see us this morning! and we got approved!!!!!!! they ordered our green card! (even got a uscis update!) so were soooo happy!

    so everyone waiting on the I-601, keep your head up! it will all go good!!!

    Hi... I am so happy that I found this section of VJ ... today. I am waiting for approval of my I601 Waiver. I had my interview at the Vancouver consulate on Feb. 28 /2011. The man that conducted my interview basically approved my application SUBJECT to a Waiver for a 28 yr old criminal record. He said that they would recommend my waiver.....and I filed my application for the Waiver at the end of March. It was received in Vermont on Apr 19. I did have a pardon here in Canada.. I had a 'suspended sentence'... NOW today I received an email from the Vancouver Consulate.. asking me to confirm some information, which I did. I have NO idea what this might mean... I keep checking the site to see if USCIS has made a decision, but not yet....... I wait with my phone daily,... and am trying so hard to be patient. CAN you tell me anything about this process that might give me some hope?? I would so appreciate it....... Thank you.. elaina on VJ

    I was reading in FAQ re: K-1 Visa and I am somewhat confused regarding bring my car across. Do I need a letter from i.e Crysler Canada to say my car meets US Emission Standards? OR>.. if I had my car aircared...would that be acceptable? IF anyone knows, I would very much appreciate your advice or any information that could help me. ALSO: My fiance came up last weekend (Canada) to visit, and on his return he asked at the U.S. Border about bringing my household goods. The Border Guard informed him that I can only bring what is in my vehicle....and yet also, in FAQ here, it said you CAN bring more than what would fit in your vehicle. However, does it have to be brought through with a moving company, or can we rent a UHaul to follow my car when I am entering the U.S. on my K-1 Visa?? ANY ADVICE HERE would be very much appreciated, as our Interview is now booked for Feb. 28, 2011..

  6. USCIS will do their own background checks for any time spent in the US, you do not need to do it. I too spend significant time in the US and did not have a police check or criminal record check done

  7. My husband and I have filed for the I-130 and while I'm waiting for the approval, I wanted to get everything ready for NVC. I have a question about the police certificate though. I'm a Canadian citizen, and when I was 16 years old, I moved to the USA with my mother and sister under an L2 visa. I was there for only two years before I came back to Canada to start college.

    I know I have to get a police certificate here for Canada, but do I need to get one as well for the USA? And if so, how would I get one if I'm currently in Canada?

    I am also a Canadian, however grew up in Calif. from the time I was 6 till I was 20 yrs old, when I returned to Canada. MY understanding is that because I did live in Calif from the age of 16-20 I would need a Criminal Records check done........   8. Congrats! Man I'm just thinking back to when we finally had our WAC #...happy to say the time has gone by fast and here I am preparing for POE!! Hoping for a quick approval for you:)

  9. Just a BIG thank you to everyone that helped us get through our little hiccup when we submitted our I-129F . After receiving our package back Eric was fortunate to talk to a very nice person on the "help' line, and we received our WAC # and instructions on how to proceed with our Application. It has been sent back to them, and today I entered our # in their system and found our data, with our Acceptance of the Form noted... YES !! Step one completed... Eric was very impressed with how nice the woman was at the help number, and it really helped put us more at ease, So... now we begin OUR WAIT.....with the rest of you... *smile* Thanks again for your support and advise...   10. This posting is further to my HELP request yesterday: We received the letter today which is as follows:

    1. Received Notice of Action Form I-797C

    2. It says "your I-129F, fees and supporting documentation is being returned for the following reason:"

    A signature is not contained in the signature block. (I signed the wrong block meant for a 3rd party preparer.

    3. They sent my check back but with a Bank of America stamp. (It does not show up as check being cashed on my bank account.

    4. All the materials have been scanned ( numbers on side of applications with some initials)

    5. All pictues/envelopes/passport pictures are in a new bag stapled to packet.

    Do we re-submit the whole package as it was sent back to me or a whole new packet?

    Do I make a copy of the Notice of Action and include that in the packet

    The Intro letter has been discarded...do we need a new one (cover letter)

    FYI..All tabs have been taken off.

    The fastener was discarded and replaced with a single staple...

    ALSO they sent Eric's check back with a stamped "DEPOSIT" on the back...it was not deposited..so do we send that back too, OR a new check?

    Any ideas? Their instructions were really NOT CLEAR......only the 'sign here' portion gave us CLEAR 'to do' ... We are ASSUMING that he is to sign the same I-129f they sent back, and not a new one.

  11. I would like to thank all of you that replied to my "PLEASE HELP`` posting of yesterday.. Your information was very valuable; and appreciated. I do believe now that maybe it was the check....we`ll see, hopefully today; if the letter they sent us arrives. Once we know what the problem is we can fix this. We will be SURE to mail it to the Texas Lockbox. It was quite disconcerting to have this happen so soon....as we are still trying to find our way through this system. Again, I thank you for all your help and support.

  12. sending to wrong address shouldnt have been a problem (see copy/paste from USCIS website below *) but i am curious about this 'original' you have in hand... do you actually have the originals of the packet and photocopies were mailed in? if so, you need to know they want original signatures on the forms.

    *The Vermont and California Service Centers will forward incorrectly filed petitions to the USCIS Dallas Lockbox for a period of 45 days until Sept. 17, 2010. After Sept. 17, 2010, petitions and fees submitted at the Service Centers will be returned to the applicant, with a note advising them of the correct filing location.

    NO, I now have the original THINGS I.E. PIC';S, ETC...THEY TOLD US TO KEEP ...AND MY FIANCE GAVE THEM TO ME, SO I'D Have them for the Consulate, . THE 'COPIES' WERE MAILED, BUT EVERYTHING IS SIGNED IN ORIGINAL... JUST AS WE WERE INSTRUCTED TO DO. They have mailed us a letter 4 days ago...to explain the rejection... HOPEFULLY WE'LL GET IT TOMORROW....THANKS FOR YOUR REPLY.... but are 'they' saying in that quote that if they are incorrectly filed, they hold them for 45 days before you can fix them??? surely not.......

  13. Just because it was rejected doesn't mean that it's some awful thing. Maybe he wrote the check out wrong, maybe he forgot to sign the I-129F, etc. Just calm down in the meantime and whenever your petition gets back to you, you can see what went wrong and then re-send it! :)

    Did you happen to include EVERYTHING that was listed in the guides here?

    yes, we included everything, even put 'tabs; in it....signed everything...but thanks, we will wait for mail ..|(they said a letter) ... praying hard here thANK YOU SO MUCH FOR YOUR REPLY AM BREATHING A LITTLE NOW

  14. i AM TRYING TO STAY CALM HERE, AND IT'S VERY DIFFICULT. ERIC SENT THE I-129F PETITION IN ON AUG 3/2010, UNFORTUNATELY TO CSC, AS HE HAD IT WITH HIM TO MAIL BEFORE THE NOTICE OF CHANGE TO SEND TO TEXAS LOCKBOX. ERIC CALLED THE 1-800 'HELP' NUMBER TODAY TO ASK IF THEY HAD RECEIVED IT, AS THE CHECK HAD STILL NOT BEEN CASHED.........HE WAS TOLD THAT HIS PETITION WAS REJECTED !!! NO REASON WAS GIVEN......I KNOW HE DID IT ALL CORRECTLY, BECAUSE I HAVE SINCE RECEIVED THE 'ORIGINAL ' TO HOLD AS PER INSTRUCTIONS FOR MY VISIT TO CONSOLATE. DOES ANYONE KNOW, OR HAVE ANY IDEA WHY THIS MAY HAVE HAPPENED???????????? WE ARE SO UPSET, AND DON'T KNOW WHAT TO THINK OR WHAT TO DO........ PLEASE IF ANYONE HAS EVER HEARD OF THIS HAPPENING OR WHY... PLEASE LET ME KNOW, AS I AM UNABLE TO BREATHE .............. THANKING YOU IN ADVANCE.... ELAINA

  15. I have been searching for information on what medical dr's are approved for having your medical/immunizations done in Canada. I will be attending at the Vancouver Consultate when my time eventuallllllllly comes.......but I LIVE in the Vancouver area, so would my own Dr. be able to do this medical? And, if so, does the Consultate send a 'required list' of things the Dr. is to check for?? Or, is this just a standard medical ? I have found the immunization list...so I have that. Would appreciate any information or tips anyone would have on this...thank you, 'hangin in there in White Rock'

Eric shipped off our I-129F Application ON AUG 3,2010.... but NEVER heard or saw anything about TEXAS....so it was shipped to the California Service Center, as that is what their instructions said to do... do you think this is going to be a problem? We ARE Newbies here....and still reading up on everything, trying to catch up on information and them assimilating it all.....WHEW!! there IS a lot...and of course trying to keep it all straight is a challenge too. lol OH WOW, if anyone call tell me, I'd really appreciate it..... thank you

    I just went back to the USCIS site, and sure enough...they changed the address to Texas; HOWEVER...Eric completed the Appliction and put the package together, before that was even posted, he took the address in Calif when he was putting it all together and did up the evelope..... he mailed it on the 3rd on his way to work, without knowing about the change......do you think that is going to cause some huge delay???? OMG....not a good way to start

  18. Unless you had an I-94 done for all of your visits (which is not the norm for Canadians visiting the US), it's going to be hard for anyone to prove you overstayed. Honestly, I don't think you should be freaking out, but you may want to limit any kind of longer visits you had planned.

    Thank you JlovesA, for your posting... No, I didn't have an I-94 done, but I have been awake a long time fretting...so, thank you, I'll try to chill on this. You can be sure I'll be limiting my visits south... We have just found this 'site' recently and are so thankful for that...we just filed our I-129F and the amount of information is overwhelming at times, so we have a lot to comprehend, and by the looks of it, a long road to travel. As I grew up in Calif, as a Permanent Res. from the time I was a young girl...for 20 years, it is difficult for me not to think of myself already as 'half-American'., and Eric and I only live 3 hours apart, (if you don't count the rush-hour traffic in Seattle) *smile*.... and I guess it never occurred to us to 'document' everytime we drove across over the last year...then again, getting 'wrong' information and NOT verifying it, didn't help either. Again, thank you for your reply.

I think I was there longer than 6 months, ONLY because I was told it was in a calendar year., and it was before we even looked into the Visa process....and thank you, I did read your link...but I'm really worried now, as we do not want to do anything wrong... we are not kids,(trust me on this) and are very concerned about doing everything right... but sounds like we already made a HUGE mistake. How can we handle this ?? I live in B.C...and have NO intention of living in the US until we have the Visa and we can be married. But...what should we do now?? IS there someone or some place I should go to to find out IF I overstayed??? VERY WORRIED IN CANADA......
