Like Udella&Wiz mentioned above, this point for this section seems to be that IF your parents were married before your 18th birthday AND at least one of them was a US citizen THEN you might already be a US citizen. If neither parent was a US citizen, then I doubt the answer here really matters.

    Your birth certificate may contain some errors on it about your parents' marital status, but it is your actual legitimate certificate, and the discrepancy is neither material (in my opinion) nor is it something of your doing. I wouldn't worry about it. I WOULD, however, answer any question on any form as truthfully as my current knowledge allows.

    Can we really view the erroneous birth certificate as actual legitimate certificate even though there's an issue with their marital status? My wife's parents weren't really married at the time of her birth. They did eventually get married before she turned 18 but would have been null and void since her mother might still be married to her first husband. Making her still an illegitimate child?

    It is specifically asking whether her biological or adoptive mother or father is a US citizen by birth or naturalized before her 18th birthday - most of this section isn't required unless the answer to that is yes. Is her answer yes?

    The question is 'Were your parents married before your 18th birthday' - if the 2nd husband is considered her father than I guess the answer is yes.

    Her US citizenship isn;t reliant on whether she was legitimate - I wouldnt; worry about it

    Hi- thanks for the reply. My wife's mother's 2nd husband is her father. The caveat is that my wife's mother was still legally married to her first husband when she got married to her second husband (my wife's father). Logic tells me that my wife's mother's marriage to her father (2nd husband) would be null and void since she was still married to the first. Rendering my wife an illegitimate child.

  3. Hi all! My wife is about to file for her citizenship and we just saw that there is a question on the form asking:
    Were your parents married before your 18th birthday? We're not really sure how to answer this question because of an issue with her birth certificate.

    Here's a background to the issue.

    My wife just recently found out that her mother was married to another man before entering in to a relationship with her father. She didn't legally separate with her husband (did not get their marriage annulled). She just left her husband and started a new relationship with her father. A short time later my wife was conceived. My wife's mother and father told the hospital that they were married and came up with a date of marriage in order for my wife to be able to use her father's last name. My wife's birth certificate shows that her parents were married at the time of birth and she was a legitimate child. My wife's mother and father eventually decided to get married (when my wife was in high school--before her 18th birthday). Obviously this marriage would be null and void because she was still married to another guy. To this day my wife's mother has had no contact with her first husband. Although a family member informed her that her first husband already passed away. She hasn't verified whether this is true or not. She doesn't know when or where her first husband died. Therefore can't check or ask for a death certificate. My wife's mother went to the National Statistics Office to get a certificate of marriage and she saw that there were two records of marriage. The first one with her first husband and the second one with my wife's father.

    My wife's been using the erroneous birth certificate all this time. She used it starting from her K1, Adjustment of Status, and Removal of Conditions. My wife had no idea that there was an issue with her birth certificate until recently when her mother divulged this information to her.

    Now comes the question of what my wife should answer for the question if her parents were married before her 18th birthday. All of her previous USCIS applications used her erroneous birth certificate showing she was a legitimate child. Should my wife answer "yes" because this is what's on her birth certificate on file which she's used previously? Or should she answer "no" because she just recently found out that she might be an illegitimate child? Does her illegitimacy have any bearing on her citizenship application? We obviously want to answer truthfully and avoid any misrepresentation.

    Any advice would be appreciated!

  4. Wife's biometric was done today. Time to wait and see whether approval comes first or naturalization eligibility.

  8. As per OP timelines, 2010 is not relevant.

    That is correct. 2011 tax return would be our first filing together as a couple. As I originally posted, we're still waiting for some other tax documents before we can file 2012 tax return and we were thinking about just sending the ROC app with just 1 year of tax return. Based on other VJ member's replies/support, it looks like we can go ahead with just doing this. I sure hope it would be enough.

  9. Hi guys, just wanted to get everybody's input. My wife's about to file her removal of conditions but we don't have all our tax documents ready to file for 2012 tax return. She's ready to file on 2/19 and we're thinking about just sending 1 year of tax return (2011). We're going to be travelling on May and we wanted to get the ROC process started right away before we leave. Do you think we'll be fine? Here are the other financial documents that we'll be sending:

    2011 tax return

    Lease agreement with both our names

    Bank statements spanning 2 years of marriage

    Personal savings spanning 2 years of marriage

    Credit Cards showing her as an authorized user

    Personal loan with both our names

    Utility bills showing the same address

    Our driver's licenses showing the same address

    Copy of renter's insurance showing both our names

    Health insurance showing her as part of the coverage

    Car insurance showing her as part of the coverage

    Copies of our trips (itineraries, photos, etc)

  10. It's okay Monday is the only holiday anyway.. I already called the civil surgeons in the area so I know where to go if ever.. And his dad has all the previous years taxes where he was a dependent in case its needed.. so whatever it is, it should hopefully be an easy fix. On the bright side, they looked at my file exactly ONE month after being transferred, and if nothing had been wrong, it would have been approved yesterday.. WHICH MEANS to those who were transferred to CSC, you could be approved a month after it got transferred!! Hopefully once we send the RFE response we can get an approval right away :)

    I'm sorry to hear about the RFE. That really sucks big time! I sure hope the RFE is no biggie and is easy to take care of. I guess the tax thing is easier to deal with than the stupid medical (not just the civil surgeon but your original "medical" file that came along with your K1- I've read here that they sometimes get lost upon POE).

    But yeah, your theory on them processing the applicant's papers one month after being transferred to CSC seems to be pretty accurate. My wife's AOS application was approved a month after being transferred.

    Another update on our case, my wife got her welcome letter yesterday and earlier today she got her Conditional Green Card in the mail! We're USCIS free for 21 months!

    Goodluck with the RFE! I sure hope you get it in the mail right away so you'll figure out what they want from you.

  11. EAD and Advance Parole approved!!!!!!!!come on AOS please be next!

    God is good! Just got the text and e-mail regarding AOS from USCIS. Card production was ordered on May 23!!!

    Just a brief summary to all April filers:

    4/5 NOA 1 official USCIS receipt date

    4/19 case tranferred to CSC

    5/20 EAD and AP approved

    5/23 AOS card production ordered (APPROVED!)

    All in all approval came in one month after being transferred to CSC.

    Goodluck to everone who's still waiting! USCIS seems to be churning through applications right now! I hope most of you will get the same processing times.

  12. Hello, I filed April 14th my AOS paperwork. I have received all three i797C approval notices on April 23rd for work, travel and to adjust status. Nine days WOW!!

    Do you really mean that you're application for 485, 765, and 131 were all approved within 9 days or did you mean to say that you got your receipt notice that they have received your application and are now in process? If it's the former then that was indeed WOW!

    Got our biometrics appointment letter on 4/15 set for 5/9. I love this part of the application where everything moves fast up until this point. It's going to be months again before we get updates on our cases.

  14. Bob is correct- the date should be the same on her conditional and 10 year greencard.

    So if I understand what you're saying, if somebody adjusted their status and gets a 2 year conditional permanent residence and then would apply to remove this condition after 2 years then he or she can apply for naturalization a year later based on the 3 year rule for naturalizing based on marriage? Is this the process?

    Or is it 3 years after he/she gets the 10 year green card before he/she can apply to be naturalized?

    The three year starts from the date of her greencard- if you look at the card, it should say something like "Resident From...".

    Can you clarify if by "her green card" you mean that her real 10 year green card or it can start from her 2 year conditional green card?

    I guess we're on the same boat messybrownhair. I remember you from the k1 thread. Also under Tahoma's list. My wife just filed her aos and was received by the uscis on April 1. Check was cashed on 4/6. We just got our NOA1 hard copy today. Let the waiting begin. I sure hope we don't get any RFE's (finger's crossed). If anything it would have something to do with the I693 as we didn't include that on our submission. Just the ds3025 vaccination record. We went by the uscis instructions indicating that all that's needed is the vaccination records and nothing else. Just hoping for the best and hopefully we're part of the statistics that don't get rfe for this. lol

  17. Hi Everyone! POE at JFK was a success! Fiancee had her fingerprints taken and wasn't asked any questions. I don't know what the SOP is for the K1 entry but after the immigration officer stamped her I-94, we were directed to the passport control room and waited for additional processing. Didn't stay there for more than 5 minutes though. We were then sent our way to re-check our baggage. Once on the plane on our last flight to DC I asked to look at my fiancee's passport to see the notations that the immigration officer wrote and to my surprise, I saw that there was an "Employment Authorized" written on the back of her I-94 (valid for 90 days like the I-94)! Although, the alien # which I believe is my fiancee's had my name on it. This is the same as the notation shown on her passport under "Annotation". We were too busy being happy that everything went smoothly that I wasn't able to inspect the details of her passport and would have been able to ask an officer about this.

    Anyways, I'm just glad everything went well and my fiancee and I are finally together! Goodluck to the rest! AOS journey begins!

    Uhmmmm...Ok...You're going to wait for your visa today right? Or have you gotten it already? If you're still waiting for it, just to let you know that 2GO takes time to deliver the visa. My fiancee got her visa around 3pm and she lives in Manila. She went to PRISM for the seminar at 10am and finished just past 1230pm. She then went to the CFO office and got her sticker on her passport and didn't finish until 330pm. So it does take a while. I sure hope that you have your visa already and not have to wait. You should be fine for your CFO today if that's the only thing that you need to do.

  19. That's normal. I was approved Dec 9 then called the embassy, they said it was really approved approved on the 14th and was printed on 22nd. Asked when can I have it, they said they have no idea so I called 2go, then FINALLY 2go told me that my visa is out for delivery!!!! OH YEAH!!! I'm leaving tomorrow.

    Congratulations! That's good news Mcdsnight! Just a quick question though, have you done your CFO? Have you gotten your certificate and the sticker on your passport? I saw that you said you'll be leaving tomorrow.
