  1. Does the denial letter say "This decision is without prejudice to future applications filed"? If so then you can just refile. You don't need to file the motion to reopen. They don't usually initiate removal proceedings against K1's who are denied because they didn't respond properly to RFE's. The denial letter might mention that point, as well.

    Thank you so much JimVaPhuong, yes you're right we called lawyer yesterday we asked about it and they said they don't initiate removal pproceedings unless you have criminal backgrounds. And yes it also says decision is wihtout prejudice to future application in the denial letter. I have one more question can we re apply AOS in like couple months after? and also, if we re file again, can i apply for work authorization with it? i didnt apply for work authorization the last tiem because i didnt have sss#, can i get ss# now for work authorization even my I-94 expired already?

  2. This is our last day to file a motion to reopenl. I do not have the money for an attorney and Im worried about just losing another 630 dollars for nothing. If i go to removal proceedings what exactly happens. If she loses at the court hearing will she be taken into custody? I got her here on a k1 visa and we failed the adjustment of status using the same information, which makes no sense to me.

    also can we reapply for adjustment of status after 30 days to file for motion to reopen? or we have to do something else before we can apply for adjustment of status again?

  3. thank You Jimvaphuong, if we staRT all over again, can we just get another co sponsor? because the last request they sent me it says that the income of the sponsor was insufficient, submit more evidence to supply the income and also said to obtain different sponsor but we didn't because we know that the income was enough for three of us its even way above 3 household size. and we also supplied more evidence for it.

    and also i thought it's just $110 for motion to reopen the case. if we have to start all over again, do i need to do the medical all over again?

    I just checked my status online today and it says they mailed me a denial decision notice yesterday and it explains why the decision was made. I'm so scared. I don't know why the denied me. when we we're applying for my aos, the asked for RFE Two times and i thought we already did it right the last time. the rfe btw was for I-864, we had to have my father in law as a joint sponsor because my husband's income didnt meet income required.

    Did anybody experience like this? AOS being denied? what did you do? i also heard that if aos is being denied you can reopen the case, do we need to pay again if we reopen my case? I know i posted alot here before but this is the one that's very sad. Please Help. Any advice or insight is greatly appreciated. Thank you

  5. He is not married anymore he has kids but the only one living with him is just my husband and we dont even live in the same building and he didnt sponsor anybody else before, he was also the one who sponsored me aside from my husband when i was still in our country. Yes it is.

    We're thinking maybe we will just have his mom sponsor me, is it ok to have someone sponsoring you even when she live in different state?

  6. Hi Visajourney Members! Please I need some advise or maybe those who have experienced like this please help.

    I got RFE Letter today saying "Based on the documents submitted with form I-864, affidavit of support for the joint sponsor, the income did not meet 125 percent of the poverty line for the joint sponsor household size. Submit evidence of assets that meet the standards listed below or obtain a different joint sponsor". They incircled "obtain a different joint sponsor".

    They already asked for this the same requirement after i sent my aos and we submit what they asked for. Before we sent them, we had infopass and the lady there said that we just didn't filled up the form right, and said there's no problem with it because the joint sponsor meet the income requirement and so we filled up the form the way she taught us. AND BTW, My husband, the sponsor didnt meet the 125 percent poverty line so we had to have my father-in-law to be a joint sponsor which has 40,000 income last 2010. I don't know why they didnt accept it I know he meet the income required. Also in the letter it says to submit ALL the information requested below at one at a time. Failure to do so will result in denial, submit the information within 45 days... Maybe we will just find another person to sponsor but I don't know about 45 days:( It's so depressing to receive RFE Again I don't want to be far away from my husband anymore. Please help, Any advise is greatly appreciated.

  7. I really have several questions.

    If my AOS is denied will they refund the filing cost to me? if so, is it automatic or do i have to fight them for it?

    This is more a techincal question rather than procedural question. When proving my income for the k1 visa i used two separate bank accounts, the first bank accoount of 7 thousand dollars was in my name alone, the second bank account however of 21 thousand dollars had mine and one other name on it. They eventually approved me for k1 visa, will they also approve my AOS using the same two bank accounts with different yeAr.

    If we are not eligible for a refund, I might consider delaying filing for adjustment of status. realistically, how long do we have? Do we need to fear forced deportation. Is it possible for a family member to sponsor at this point?

  8. Hi...we have same situation! I'm 1 year now here in the US and just got approve for my gc yesterday. :dancing: my I-94 expired June last year and applied for AOS Dec. my medical expired feb this year...but everything went fine! your medical will depends on the sheet that you have. I can give you the requirements...:)if you want to leave your email..:) goodluck..

  9. I'd wait while we saved up the money and they file on my own without the lawyer. Every answer to ever question on the forms that the lawyer has done for you so far, he's gotten from you or your husband. :whistle:

    Mostly for my own curiosity, how much did the lawyer charge your husband above and beyond the I-129F and other fees charged by the government? :blush: I'm almost willing to guess that his "fee" would have more then covered

    he paid almost half amount for the aos

  10. ok so there is no problem in waiting, i saw while searhing that we can even wait up to two years.

    I also saw that we might be able to get a fee waiver because we are below the 150% poverty line (well below it) what im wondering is if we apply for this are they going to deny because of the affadavit of suppor, like showing I wont become a public chArge. Would you wait or try for the waiver?

  11. Hi. My husband is broke at the moment and cannot afford the 1010 for the aos filing fee. His lawyer mis-represented the timeline information which leads us to this situation.

    Anyway what are our options, and i mean all options. I think we can apply for an extension but i want to know the other options. BTW the 90 days ends in 2 days. Also if I happen to stay over the 90 days what exactly will happen?
