    A friend of mine has a b1/b2 visa, he is planning to travel to the US getting married to his girlfriend and buying a small restaurant or laundry that will cost him less than 100k.

    In this situation, how things work can he start his business without US civil Documents, or he will have to get married first, then adjust status and after that he can buy a business..... If this scenario is applicable which states that allow you to issue An ID and owning a business before adjustment of status??

    Any insight will be highly appreciated

Thanks all, I don't really have such amount and small CPA services firms don't need that much I am only wondering what's the best approach in my case to get the permanent status " green card " and when I said I have a client I mean I am already in the business so I can hire people to work in my firm

  6. In order to sponsor her mother the child needs to be 21 years old. I would seek the advice of an attorney to see what other options the mom has. Could perhaps the mother get an employer sponsored visa?

    the daughter must be 21 to file petiton for her mom but if they are already in the us how the mother can live n the US until that ??????

    I know a divorce women her husband is a USC and she have a baby daughter 1 years old was born in the US how she can get a green card from her USC daughter ????

    if the baby must be 18 to file for her mom how they can live in the USC UNTILL the beby become 18 years old ??????

  8. Not true. If the mother had lived in the U.S. for 5 years cumulatively, 2 of which was after the age of 14, then her son would be a U.S. citizen at birth. Your description is kind of contradictory -- you said she was born in the U.S., which implies that she was in the U.S. for a period of time; yet you say she has never lived in the U.S. So how long was she in the U.S.? and at what age?

    Yes he would need to get a green card through his mother and move to the U.S. If he moves to the U.S. with his mother, he can immediately get citizenship through the Child Citizenship Act of 2000.

    she was born in the US and after one week she left " with her family of course" the US and never comeback sooooooooooo she is totally live in the US 7 DAYS only

  9. i know that ............... i know the child will never get the citizenship by birth unless he was born in the us , but if he was born in jordan and want to get the USC he will get green card first or he can apply for citizenship ........ whats the requirment for child ????

    also i know that she will file I-130 not my friend , and by the way if she never file the US TAX what is consequences ??????

    a friend of mine get married , his wife was born in the US so she is a USC but she never live in the US , and never visit the US at all , NOW both of them live in jordan ( my friend and his wife )......

    1) if she will give birth in jordan how this child will get the US citizenship ????

    2) if my friend want to file I-130 to get the green card is there any condition or any requirement based on his wife status ????

  11. I hope you don't mind me asking, but why did he go to all the effort of qualifying to work in the US if he has no right of abode in the US?

    cpa is the highest qualification in accounnting in USA and all over the world he make the cap & cma because its a good qualification everywhere, he is already working in his country but he is willing to work in USA

    and by the way he didnt brooke any immigration law he is just coming to usa as tourist and will travel...... am just wondering if the H1B visa unavailabel whats the compannies do in these circumistances ????????????

  12. First, he needs to stay in status to be eligible for H-1B or employment based green card. If he is on tourist visa and does not leave when his I-94 expires, then he is out of options for getting H-1B or a green card in US anymore.

    Second - both H-1B visa or EB green card require employers that will incur all the associated costs and sponsor him.

    His likely will be 3rd preference unless he has appropriate degree - then maybe 2nd.

    No one can tell you wha his chances are because no one knows his qualifications.

    As a CPA in his country, does he know US accounting and tax laws?

    An H1-b is an employment based visa. So your statement of switching from an H1-b (an employment based visa) to an employment based visa does not make sense.

    There is zero chances that your cousin can switch from a tourist visa to a work visa. It simply does not work that way.

    Finding a US employer is only the first step. It can take more than a yer for a willing US employer to bring someone to the US on an employment based visa.

    Don't expect to get an employment based visa during the time allotted or a b1/b2 visa holder is in the US. Even with a 6 months I-94, there is not enough time for n ploy meant based visa.

    and if he find a company whats the most frequently process h1b or employment based immigration ?????????? he need to fill a adjust of status or he most travel to his country to receive the visa ??????????

    under which categories the CPA CLASSIFIED IN EMPLOYMENT-BASED PREFERENCES ????? Priority Workers, Skilled Workers, Certain Special Immigrants

  15. If you don't belive my case has similar timeline. I had a 2005 PD in F2B and my case was approved by USCIS in 2009, so my NVC number was 2009 in F2B category. Couple of months later I've upgraded my case to F1 (parent became USC)so now I have NVC number with 2009 and my PD is apr 2005 (F1) - current PD is 01 sep 04 and I am still waiting for interview.

    aha maybe.... you know i am in f2b my pd : 12 aug,2009 , case has been approved in 2009 and i got my nvc case number in 2010 most of people told me it takes 3-5 years to to get my IV but it seems to be 8 years thats what make me waiting impatiently hope to get my IV ASAP
