    Thank you so much for the informative reply at least I am clarified and less worried about this waiver thing.

    I had a waiver done on my J1 Visa two years ago. As you said you can track it online at first when it is at the Dept of State but when it is passed on to USCIS you can't. I too got the favorable recommendation but I had already been told by a friend that once it gets to USCIS I would no longer be able to track it, so I was not worried. It took a couple weeks for me to receive the approval notice, about a month I think.

    You will know USCIS's decision when you get the answer in the mail.They will send it to your mailing address. USCIS hardly ever denies a waiver application that receives a favorable recommendation from the DOS, so you shouldn't worry. No way to expedite the process that I know of.

    You can file the I-130 and it will probably get approved but if you apply for AOS they will deny it unless u have the waiver so it is best to wait till the waiver is approved.

    I received a letter from the Department of State dated June 18, 2010 granting a favorable recommendation on my application for waiver of the two year home country residency requirement on my J1 visa. Furthermore,it also notified me that my application is now at the USCIS vermont service center. Since then, I did not hear any thing about this application. When my application was at the Department of State I tracked the progress of the application through their website. But now at the USCIS, I dont know how to follow up my application, I called the USCIS customer service twice and the people that I talked to dont know what a waiver is. They dont know what I was talking about. So, I gave up. Searching online lead me to this site. I hope some members will shed light on this because my husband (a US citizen) and I dont know what to do. And I cant adjust status unless I have the waiver. Our questions are: (1) How long will it take for them to decide whether the waiver is approved or not? (2)Is there a way to expediate this application?
