  1. 10 Year green card came in the mail yesterday, updated date below!! Thrilled to be done for 10 years, can't believe how easy this step was! My wife said "they must be under new management" LOL. Thanks again, VJ!

  2. A driver license is really the LEAST of your concerns at this point. These kind of stories fascinate VJers so that's why this is getting so much attention....people love to hear about others major problems.

    Bottom line, get an attorney immediately. Like, before the day is up. You are probably in deportation proceedings already and you are damn lucky you've made it this far. At this point even a simple speeding ticket could put you in ICE detention and separated from your family for a long time. Don't waste another moment reading this thread!

  3. I'm sorry but your position in applying for the ROC does not appear to be good. Pictures, affidavits, cards, letters, trip records etc can all be easily faked which is why they aren't considered primary evidence. You need to tell your husband to get with it ASAP and add your name to the checking account you use as your primary account, at minimum. I assume since you are using his credit card accounts your name is on the card(s). Providing a copy of that would at least be something.

    Remember it's not what you or your husband thinks is important in demonstrating co-mingling of your finances and personal situations it's what USCIS thinks! It may be too late, even if you went today and added your name to the joint accounts, to prove to USCIS that you co-mingled satisfactorily throughout the last two years. Based on what you've said I'm afraid you are looking at an RFE and probably an interview.

  4. My wife walked in to the Austin, Texas ASC today to do her biometrics early. She said they could not have been friendlier...she was in and out in less than 10 minutes and one of the staff actually held our 6 month old while she did our fingerprints! I'm SO relieved that she went and did it early since we are scheduled to be in Ireland during our original appointment on 1/3/13. We can highly recommend the Austin TX ASC!   5. Got the biometrics appointment letter today. Scheduled in Austin,Texas on January 3, 2013. Too bad we are going to be in Ireland then. My wife is going to walk in early next week, from what I've read it should go smoothly she just might have to wait a little longer if there are others with appointments. I'll update next week when she goes.

  6. Ok, I'm joining the December 2012 filers. Mailed my package on 11/30 from Austin, Texas and was received and signed for on 12/3 at the VSC. Received NOA 1 in the mail today dated 12/4 and check was cashed yesterday. Now, we await the biometrics letter and then WAIT! Good luck to all!

  8. Thanks, I've decided to send one statement for each quarter from 2010 - present. So...if anyone cares to know here is our package:

    1) Completed form and $590 fee check

    2) Front and back color copy of wife's greencard

    3) Residential & office address history since she became a permanent resident...we have moved several times

    4) IRS transcripts showing joint returns filed in 2010 and 2011

    5) Front and back copies of both of our Texas driver's licenses showing the same address

    6) Quarterly joint checking and savings bank statements from 2010 - November 2012.

    7) Warranty deed showing joint ownership of a rental home in Houston Texas

    8) Warranty deed showing joint ownership of our home in Austin Texas

    9) Official state of texas birth certificate for our daughter born in May of this year with our names as parents

    10) Joint vehicle lease agreement for my wife's car

    11) Affidavits from two co-workers testifying to the legitimacy of our marriage/relationship in Texas

    12) State Farm liability insurance certificate for my wife's car showing both of our names

    13) State Farm homeowner's insurance certificate showing coverage of our Austin home in both of our names

    14) State Farm life insurance policy on me showing my wife as beneficiary

    15) Photos of us and our new daughter spanning from the date my wife entered the US with her visa to now

    That's it! Hope it's enough and the only thing we hear is an approval!

  9. My wife and I have had joint checking and savings accounts since before we were even married in 2010. So, I have nearly 3 years of statements showing joint ownership and use of the bank accounts.

    I'm getting ready to send off the I-751. I have probably 30 pages of good "other" evidence...tax returns, warranty deeds, insurance etc. but I printed over 200 pages of bank statements...one statement for each month since we are married. To be honest the package looks a bit ridiculous and I'm wondering if the officer will be annoyed that our package is so huge. Should I just send one statement per quarter for the last 2 years instead of one for every month for the last 36 months?

  10. Hello all! Well, time has certainly flown by. My wife and I are preparing the i751 form and appropriate documentation...we hope to send everything out tomorrow. Her 2-year conditional green card expires on 2/15/13 so we have plenty of time.

    A question...we will be visiting her family in Ireland from December 27 - January 8th...luckily her green card is still valid for more than a month after we get back but my question is what if they schedule her biometrics during the time we are out of the country? Is it easy to reschedule? Or can you just go early?

    My best to everyone on this process...I will post on the timeline once we've mailed it off!

  11. My wife visited me 18 times on the VWP over 2 1/2 years from Ireland via various POEs (mainly Newark)and we decided we wanted to give it the old college try again while awaiting the CR1 visa. She had been hassled a few times after the 12th trip or so but she always made it through with a 90 day stamp. She was DENIED at the Dublin airport POE after she said she had an I-130 pending for a CR1. Even with an apartment lease still in Dublin, a substantial irish bank account balance and a roundtrip ticket...and proof we were trying to do things the legal way by applying for a visa. She was heartbroken and it was very emotional for both of us as this occurred 2 weeks after our big wedding in Ireland. We had to wait exactly 8 months and 13 days from the day we applied (while she was in Ireland) until the day she stepped into the US. It was terribly difficult but I can say it would have been easier, especially at the beginning of the process, if we had NOT tried to enter the US under VWP and been denied.

    You never know, its entirely up to the inspection agent at the POE. He may get stamped without so much as a question. But then again,he could be denied and it could make the next few months even more exceptionally unbearable. No one can really tell you for sure.

    A couple of other points...one reason we tried at the Dublin POE is that if she did get denied she was still in her home country...she was just walked out of the inspection area into the main Dublin airport and was free to go. I can NOT imagine if she had traveled all the way to the US, entered at NY or Texas and THEN been sent back home on a 10 1/2 hour flight without being able to see me. If there is an airport in the UK with US inspection there DEFINITELY do that...or find one that has one...fly out of Dublin or Shannon.

    Also, Continental airlines was really cool about giving us the amount we paid for the ticket back as a full credit to be used within a year...she just used the credit when we finally got the visa.

  12. We thought about it often too...the 8 1/2 month wait apart from my wife was almost unbearable. You are lucky though, Canada isn't that far compared to many people on this forum (including myself) who have a big pond between themselves and their loved ones. We just thought of it like this...8 months in the grand scheme of a 30-50 year relationship is nothing. To us it was about keeping the big picture in mind and minimizing risk. There were too many "what if" scenarios if we would have tried to do AOS off of a VWP visit or even a tourist visa. Now that that chapter is finished for us I don't think we would have chosen a different route...we have our whole lives ahead of us now. I know it is very hard to really take these words on board while you are stuck in limbo/waiting mode (I was the same way) but, in our experience it was worth the wait! Good luck.

  13. My wife entered the US at Houston Intercontinental airport POE on February 15. We received no less than 3 identical welcome letters (we got one of them on the same day as the green card LOL) and one receipt letter from the Texas service center. Her green card arrived in the mail on March 5. So, a little more than 2 weeks since she crossed the POE.

    Also, her SSN arrived within one week after crossing the POE. And, this was interesting, it was a completely NEW number than the one she had been assigned on a J1 visit. Thought this information might be helpful to someone. We are very excited to be done for 2 years!

  14. We had a similar issue of my wife's birthdate being off by 3 days in the NVC system. And since I didn't know the birthdate they had they were unable to open the file and tell me anything. We had to send them a copy of every page of her passport. Then, guess what, they STILL had it wrong. The embassy ended up correcting it for us in Dublin. Be prepared to be frustrated beyond belief with the NVC. Oh, and the time it took to photo copy her passport in Ireland, send it back to the US and for them to receive it and look at it cost us a MONTH extra. Welcome to the US immigration process!

  15. She needs an SSN that takes about 2 weeks after entery. Her green card 2 weeks or more.

    Sometimes the SSN does not arrive 2 weeks after and takes longer - I would suggest you go to the SSN office after waiting 2 weeks and see if you can get her SSN number from them so she can look for work.

    Thanks for your reply. She actually already has a SSN from a previous J1 visa stay and work in California. Will they issue her a new one?

  16. My wife finally entered the US on Tuesday at Houston POE with her brand spanking new CR1 visa. The entry officer said the stamp on her visa in her passport is good for one year and is her "temporary green card". The actual conditional green card is good for 2 before we have to petition to remove the conditions.

    How long should we wait to receive the green card and welcome letter in the mail? Who do you contact if you haven't received it in the "normal" time frame? Also, can she start work now or do we have to wait for green card?

  17. Congratulations! Did you wait to book the flights after the interview?

    We mistakenly booked our flights before we had it in hand and ended up changing them. I recommend you wait until the postman hands you the envelope...tickets to the US are really cheap right now from Dublin anyway. We booked a same day flight for only 600 euro!!

    Again, I wish someone had told us how long the wait realistically was after the interview. We thought something must be wrong since the embassy's web site says you should get it 2-3 days after the interview. Nope, you have to wait...probably for 2 weeks or so for name checks and various administrative processes. Good luck!

  18. We FINALLY got our immigrant visa in the mail this morning! A wonderful Valentines gift!! We waited 8 months and 13 days since we sent in the petition to USCIS.

    All Dublin filers...you WILL wait almost 2 weeks from your interview until your visa is issued and in hand. We read on the Embassy's website that it only took 2-3 days but ours took 13 days and the most recent other VJ Dublin filer took 13 days. So, be prepared to WAIT (again)!

    We are off to the US tonight!

  19. WHats the verdict from the Dublin consulate? Good luck at the upcoming interview!

    I called the Visa Services number on Friday and they said no problem I can attend. I think it really is a good idea if they allow it...we are bringing duplicates and in some cases triplicates of every possible form, certificate, tax return, pay stub, pictures etc that we can think of. With both of us there with all of our pertinent information I hope we are reducing the chance of something missing and causing a delay in processing. Our interview is Tuesday at 115pm in Dublin...I leave Houston tomorrow morning...wish us luck!

    PS. The lady on the phone said the only requirement for me is a US passport

  20. ****SORRY I MEANT i134 vs i864****

    Some of you may have read my post from a few weeks ago...we have been relatively smooth sailing through this whole process. A few minor delays here and there but nothing big. When my wife called Dublin embassy to confirm her interview appointment they told her, yes its confirmed but there is a problem with your affidavit of support...they said the folder was sealed and they were unable to tell her what the problem is until the interview. The NVC had apparently marked on the folder that it had been sent back TWICE even though we never heard so much as a whisper about it. We've looked through the form we submitted with a fine tooth comb and can't find ANYTHING wrong with it...we've even had other attorneys (other than the one that helped us with this case) review it...all ok.

    But, last night I started browsing the forums and saw the i134 mentioned all over the place...nary a mention of the i864. Could we have completed the wrong affidavit?? Should we have completed the i134? We were initially K3 applicants...changed to CR1 at the NVC like so many others. Only been married since May 2010. What is the difference between the forms? Luckily the embassy said the problem can be handled in Dublin but I still racking my brain trying to figure out what the problem is!
