hello all.
we have been sent our AOS interview letter. dated Feb. 27th. 2013
it seems to me as if they are asking for things that we already sent with our initial packet.......
if anyone could please give me a checklist of documents that ACTUALLY need to be brought, based on K1 entry.
also, for EVIDENCE of relationship......do they wish to see past photos/evidence or since our entry into states?
We have a 10 month old daughter, lots of photos, marriage license, were both on birth certficate of daughter.
Although...at the moment we are living with American spouses parents and theyre name is on the rental lease, We are using american spouses mothers extra car in her name.........
what should we use for evidence?
what else do you suggest as evidence?

Yes, you are correct bigdog.
The only thing i hant received yet is the receipt for I-131.
Is there a possibility that these processing times are longer?
The approval of I-131 does it depend on approval of I-485?

We have received our letter/receipt NOA for I-485 and I-765...but it mentions nothing about the I-131? does this come seperately? Should we call or mention this at biometrics apt>?
We have 4 days till apt.

for Affidafit of support.....does the co sponsor need to provide just a copy of biographic info pages on passport? or every page like when doing with the I-134?
for Affidafit of support I-864.....does the co sponsor need to provide just a copy of biographic info pages on passport or every page like with the I-134 for proving citizenship???

hello and good day to all...
i have a number of questions concerning processing papers for AOS for my husband.
* I-485 ( PART 1 - ASKS FOR I-94 #....Where is this located? )
- I-485 ( ARE WE BOTH REQUIRED TO FILL OUT BIOGRAPHIC DATA FORMS? )
* I-864 Affidavit Of Support: ( i will explain my situation so as to make it easier to answer......I do not qualify to be sponsor, i am under 125% pov. level and we have a baby girl, which would mean im supporting 3 persons. I am not working and have not been since ive been pregnant (baby 7 mnths old) . My grandfather was the co sponsor for our I-129f petition and will be the Co-Sponsor for the AOS. He definitely qualifies to be sponsor, more than enough. He does not live with us.
So here are my questions regarding filling out "MY" I-1864:"
- PART 3: (8 : i am sponsoring the principal immigrant named in part 2 ........DO I CHECK YES OR NO? next to "NO" says ( applicable only in cases with two joiny sponsors.....) ???
- PART 5: HOUSEHOLD SIZE: says enter number of persons you are sponsoring "1" my husband.......ok....then ( C. ) says if you are currently married (yes...we are married) enter "1" for your spouse.....DO I LEAVE THIS BLANK ? IT SAYS DO NOT COUNT ANYONE TWICE.
BEINGS I DO NOT QUALIFY TO BE SPONSOR DO I NEED TO PROVIDE BANK STATEMENTS, BANK LETTER, PROOF OF NOT FILLING TAXES (below level), ? I AM PROVIDING AN SUPPLEMENTARY EXTENSIVE LETTER WITH I-864 EXPLAINING MY SITUATION, WHY HAVE NOT FILLED TAXES, AM UN-EMPLOYED ETC.
I HEARD THAT IF I-131 APP FOR TRAVEL DOC & I-765 EMPLY. AUTH. WERE FILLED WITH FORM I-485 AOS THEN THE FEES WERE WAIVED? (normally the cost) IS THIS TRUE?

hello all
my situation is,
i have lived off and on in peru for the past 3 years normally spending on average 6 - 8 months out of the year in Peru, and then working in the states for a few months out of the year.....
wondering if i am still valid to DCF for the Spouse visa?
most recently my situation is, i am pregnant and have been in peru but have decided to come back to the states (alone) to have my baby in the USA.....by the time i return to peru i will have probably been out of peru for 2 -3 mnths....
does this affect my ability to DCF?
or upon my next arrival from that time i need to be living there 6 months?
any advice greatly apreciated!

hello all,
In short, I have what they call a "Delayed" birth Cert. which means.....my mother did not file me a birth certificate until 6 years AFTER i was born. The birth certificate that i have simply states :
- my full name
- date of birth
- sex
- county of birth
- mothers name
and nothing else.....not my fathers name, not WHICH COUNTRY she was born in......arrrggg
But the thing is.....i have done all my papers in the states with this birth cert. INCLUDING getting a passport.
Vital records tells me that its completely Legit, and it a good birth cert. its simply doesnt have alot of the information, (as my mom for some reason decided not to fill this all out)!
TO GET TO THE POINT.....wondering if this will be acceptable when getting married in peru?
any advice greatly appreciated!

so...tentative plan to make process as easy and fast as possible is to get married in lima, (so as to cut down processing time) then receive cert. in lima..(is this possible?), after cert. received have all papers ready to present for the I-130 and go to the embassy to give them our petition....
this seems like alot...haha but im sure this ultimately would be the best and quickest way to do it right?
ah yeh, just to clarfy...."after" we receive Marriage Cert. in Mail we must bring it to the Reniec correct? Then wait a couple days? what is it that they do at the reneic?

I believe I will be getting my Birth cert. apostillized/notarized in the states......though its wonderful to know there is the option of doing this in peru!
so all in all how much time would you say it takes from start to finish (married legally with certificate)?
thinkn well just wait around in lima to recieve certificate then apply directly for the I-130.....

i have a question concerning the ceritfication of documents when marrying a peruvian. I am American citizen, and am wondering about how to go about getting my Birth Cert. and Proof of being Single paper certified, notarized, etc.
Is this something i can do in Peru?

does anyhow have suggestions for good, affordable hostel near or within 20 min or so near to the american embassy?
does not have to be 4 or 5 star, something cheap but clean for the week or so hes there doing papers.

Yes, he/she must be above the 125% poverty level. However, you also have to take into consideration if he/she has dependants.

i have a few questions for you:
beings it will be my fiance and his son applying for the visa, will they both be charged the amount of $350?
what medical information needs to be collected for his son? will he need a medical exam, the same as his father?
if, my father (the co-sponsor) is self employed and does not file taxes, but can show more than sufficient proof of income through his bank account and his assets, will this be fine?

i am wondering if the Police, and military records have to be gotten in the city of Lima? or if they can be gotten in iquitos, where my fiance has lived his whole life....?
i understand that lima is the center, and so all archives might be kept there.
we are trying to gather all paperwork ahead of time, and we are only in lima for a week.
and if we are to get the papers in lima, which offices should we go to?

Your not having your own home and living in your mothers house will not affect your Affidavit (I-134) at all. I to lived in my mothers home at the time of filing for our I-129F and K1 and this did not affect anything.
Here is a link to the 2013 Fed. Poverty Guidlines. 2013 Fed. Pov. Guidelines this will help you figure out if you make enough to be the SOLE sponsor.
If you do need to use your mother as a Co-Sponsor, She herself must also fill out a I-134 form, completely with all of her proof.
you also will completely fill out a separate I-134., complete with financial proof. ( instructions for the I-134 will give you list of documents needed)
