  1. Is your J-1 visa still valid? No.

    Your current immigration status is such that only a DHS document authorizing you to work (EAD) is acceptable for your I9.

    The driver's license and SS card are only for US Citizens. You aren't a citizen, and therefore have to use your EAD or green card as your proof.

    Thank you for the information. I thought that it was the case, I just wanted to make sure. We applied for Adjustment of Status two days ago, which means I have to wait for 3 months to get my EAD...

    I almost got a bookkeeping job =(

  2. Unfortunately the temporary EAD stamp issued at JFK is no longer valid. They changed the rules earlier this year and now require you to have the actual EAD card to be able to work. You can apply for the card, but it costs you $340, and is only valid for the 90-days that your K1 is valid before you apply for your AOS, and usually takes nearly the 90 days to process, before you have to reapply with your AOC anyway, so it's pretty much worthless to apply for.

    Sorry, wish there were better news.

    According to I-9 form, I must have 1 document from list A or B and one from list C. The first document listed on B is Driver's license or ID card issued by a state. I have a Social Security Card from when I had a J-1 visa. Does this mean if I get a NYS driver's license or ID card I will be permitted to work?

  3. Go to the interview and bring what you have and the printed copies of what you don't have. You may get by, or they may tell you that final approval will have to wait until the documents are sent to them. I'm thinking they may want the original I-134.

    We had a similar problem with a police certificate that had not arrived. We did have a faxed copy of the certificate but not the original. The embassy accepted the faxed copy and approved the visa without sending the original.

    Thank you so much for the advice. Of course I asked Jason to email me copies of his financial documents, but unfortunately he HAS NO copies of them. He just sent me the originals and they stock in Moscow. As for me, I have at least 3 copies of each document. Moreover, I always keep copies of important documents online, on my email account. I was very worried about that. I had to go to the interview with what I have. The officer didn't seem to be angry about that, she just told me to mail the papers any time. I felt soooo relived. Now the package is in Samara, but it's still not delivered to me.

    By the way, how long it could take to review our case one more time and approve the visa?

  4. Tell him to resend everything via FedEx Overnight. Pay the money. Have it held in Moscow for your pickup.

    They will not resked the interview just not give you final approval pending sending in those documents. No denial because of that also. Bringing copies may work and it may not. I'd do it just in case.

    Why did he wait so long?

    It took so long because we were waiting for the letter with the instructions and forms from the Embassy or at least email. We sent the petition in the end of May and I never got anything from USCIS or NVC or US Embassy on my mail or email. We didn't know that they could schedule me for the interview without noticing somehow. So when we finally called it was a little too late.

    I'm scheduled for the interview on the 2nd of September. So it's going to be in 2 days from now. All the documents are ready EXCEPT my fiancée's papers (I 134, w2 etс.) Unfortunately he sent it by USPS. The package is already in Moscow, but it's not going to be delivered to Samara, where I live, by the 2nd of September. I'm in panic...

    What happens at the interview in such cases? Will they schedule me for another interview? Will we be denied? What if I bring printed copies of those papers?

  7. why dont you ask a user name Sachinky what she would do... I believe that she was in a similar situation as you, and she choose to go back to her country, mary and then file an I-130 and I know that she use to complain that she shouldnt of done that... that she should of married in the us and then just filed and AOS... that way you wouldnt have to be apart...

    I fully agree with you... Being apart is such a torture for me and my fiancé... But we don't give up.
