  3. The affidavit of support can't be withdrawn once the green card has been issued.

    My advice would be:

    1. Call ICE and tell them whatever you know.

    2. File for a divorce ASAP.

    3. Move, or change the locks on the house/apartment. Get a restraining order to prevent him from returning. If you move be sure to notify USCIS of your new address, as required by the affidavit of support.

    4. Put his personal property in storage, but do not give him access to any common documents from the marriage - joint account statements, lease, etc. He'll need these to prove he entered the marriage in good faith. If he comes for his personal property then give it to him.

    5. When the divorce is final then send a copy of the divorce decree, along with a cover letter providing his name and A#, to USCIS. They'll send him a notice of intent to start removal proceedings unless he immediately files an I-751 to remove the conditions on his green card. If you receive this letter then it means he never filed a change of address with USCIS. Send the letter back to USCIS marked "Not at this address".

Hopefully, he hasn't collected the evidence he'll need to remove conditions on his own, and hasn't notified USCIS that he's moved. In that event, his conditional green card will likely be terminated. Unfortunately, our President has decided to rule by decree, and he's ordered ICE to suspend removal proceedings for anyone except convicted criminals. This means he probably won't be deported. You can expect that order to be lifted after the next election, either by the current President (he won't need Hispanic votes anymore) or by his replacement.

thank's so much but i was told that if i file for divorce, uscis will give him his 10 years of green card.is that true?

  4. Hi everybody,i have a question.my husband came on a k1 visa,we got marry and after three months he got his two years of green card,he received his green card in april and left in may.so i think he only marry me for the green card.since he left there is no communications between us.he is in ohio i just want to ohio two days ago but he refuse to even talked to me.He is not telling me nothing about the relationship or what he wants to do.what i just can't get over is he did not leave when he did not have his green card,he only left right after he got his green card. so my question is can i report this to immigration?if so what proof will immigration want?pls help thank's.

  8. Check box "a" in part 1.

Re. part 24.e: Are you including income from your husband to help you qualify as a sponsor? If so, then include your husband's name, relationship to you, and income in section 24.b, check box 24.e and write his name in the space provided. If you are NOT including your husband's income on your affidavit of support then do not enter his name in either section 24.b or 24.c, and do not check the box in section 24.e.

Hi again jimvaphuong, this is the question i'm still having problem with.it say's,the person listed above__________does not need to complete form I-864A because he/she is the interding immigrant and has no accompanying dependent.so do i write his name in this space?

  11. Actually it's well known that it's rude. Other people ignored it because it's obvious you don't speak english well so people tend to ignore it, just like they ignore misspellings and grammatical errors. Here's a link to prove it means yelling: http://www.google.com/search?q=what+does+typing+in+caps+mean%3F&ie=utf-8&oe=utf-8&aq=t&rls=org.mozilla:en-US:official&client=firefox-a and there are several threads where this is discussed in VJ itself. I didn't tell you to stop it in order for you to take offence, but you will find you will get many more replies to your posts when you don't type in CAPS. It's hard to read.

I didn't answer your post either. I am an organiser and you did not state what visa you were AOSing from and if you weren't adjusting from a K visa I would have to move this thread. I asked you what visa you were AOSing from so I didn't need to check all your old posts to find out. Seeing you didn't answer the qn I had to go to the effort of checking your old posts. For the record, the OP is adjusting from a K1 visa.

As the thread title is EAD I am moving this:

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to " Working & Traveling During US Immigration" as the main purpose of this thread relates to EAD **

SO that you know,i do know how to spell ok, people do make mistakes at times when typing,i'm going to listen to other people that are not rude and impolite like you and stop typing in capitals.again get over youself.i'm not going to response to any more of your post to me.this is not what this site was made for.Thank's.
  12. Please stop typing in CAPITALS. It's considered yelling and is very rude.

What visa are you adjusting from?

Please update your timeline so others can benefit from your experience and your profile to reflect that you are now AOS (pending). The timeline function is up the top called "immigration timelines". To update your profile click on "settings" (up the top right of the page) then the "profile" tab, then "change profile information" (which should be the default one that opens). Then scroll down to Immigration status where it currently says nothing and change it to "AOS (pending)".

FIRST OR ALL YOU DO NOT HAVE TO ANSWER TO MY POST,TYPING IN CAPITALS DOS NOT CONSIDER YELLING OR RUDE.I DO NOT KNOW WHICH PART OF THIS WORLD YOU ARE FROM.OTHER PEOPLE DID REPLY TO MY POST,AND NEVER HAD A PROBLEM WITH IT.SO GET OVER YOURSELF.

  13. The decision to use your husband's family name is yours...whatever you decide to do, stick with it and make sure the correct name appears on all your future paperwork.

EAD = employment authorization document/work permit

If you file the EAD at the same time as AOS, the cost of filing the EAD will be waived. AOS takes an average of 4 months to be processed, the EAD will take less time...depending on when he can get his biometrics requirement completed (some members have received their EAD in less than 2 months).

When are you guys getting married? You may want to file AOS soon, the fees will go up by November 23rd.

WE ARE ALREADY MARRIED AS OF THE 13TH OF THIS MONTH.WHAT IS THE FEES NOW?ANOTHER THING I DID NOT CHANGE MY NAME I'M STILL CARRING MY FAMILY'S NAME,WILL IT CAUSE ANY PROBLEM BACAUSE I DID NOT CHANGE MY NAME TO MY HUSBAND'S NAME WHEN WE ARE FILEING HIS AOS?
