  1. I see, sorry for the mix up.

    Yes, I could apply for citizenship, I would have to file for keeping my German first and then end of May I could apply for Citizenship. But I would have to come for biometrics, for the interview and for the oath ceremony, worst case scenario that would be 3 trips, and I can't afford that. And I will leave here end of June.

    Maybe that would be on time for biometrics here but not superlikely.

    Well, I would apply for reentry permit in case I could not come back on a spouse visa. I just don't know now if I want to come back in two years or not.

    So my most important question was, if my husband could file for a visa for me again on legal separation. If that is not possible I would probably file for reentry.

  2. Well, there are reasons why I want our finances separate and he understands it. It was part of our problem here that he was not so good with finances and I am just scared that he makes big liabilities and then I am responsible and I am not even there to see what is going on.

    Other than that we want to be on phone and skype and also visit each other.

    We are not planning any visa fraud or anything like that. My only reason to come to the US was to be with him and this would be the only reason why I would go back. I actually like my life better in Germany but I know that my husband can't come over, he does not speak German and is not very good in learning languages and also he has a little daughter. My daughter is already 19.

    So if I understand it right, I cannot go to Germany, work there and keep my Green Card with reentry permit, because I don't have permanent residence in the US and the center of my life is in Germany. But I thought that was the reason for a reentry permit, that you are out of the country longer than a year, less than two years and it gives you the opportunity to go back and live in the US.

    And if I would just give my Green Card back and visit my husband on visa waiver, I could not come back because with the legal separation there is no bonafide of a marriage anymore and that way we can't apply for a spouse visa again, although we visit each other and stay in contact?

    What can I do then to save my butt financially when I am overseas with having the opportunity to go back to the States and live there?

  3. I have a difficult question.

    I moved to the US in 2011 with my daughter with a CR-1 Visa, I just got my 10-year unconditional green card.

    Unfortunately, my daughter did not like it in the US and she moved back in 2012 with only 17 years old. We are in contact every day but that does not really make up for missing her. I also don't really feel home here and am missing my family and friends very bad.

    My husband and I decided now that we will try a long distance relationship again and that I move back to Germany for a few years with a maybe chance to return to the US.

    We would like to have a legal separation agreement, so that the other is not responsible for the other's debt in the future.

    My question now is, if we are legal separated and I decide to come back to the US in a few years, would the legal separation agreement still make it possible for him to file a spouse visa again or does it count almost like a divorce?

    We just want to separate our finances but still visit each other once in a while.

    I don't want to file for a reentry permit because I think that I won't go back within the next 2 years, I guess this will take a little longer.

    I would appreciate any help in this matter.

    I have received an appointment for the interview for May 3rd, 2011 8 o clock.

    I cant make this appointment as I am visiting my husband in the States on 9th of May and I need my passport for that, has anybody experiences if it is possible to change this date for the interview at the US embassy in Germany?

    I would rather have an appointment in June, as I am not in a hurry because we want to move to the US in August.

    I just called NVC and they told me that the embassy will make an interview date, tell this to NVC and then they will send the files to Germany and we will get an email, that its forwarded.

    And she also said that April was so busy with petitions, so it might be in May. Now I just hope, the interview wont be right at the time when I visit my husband in the US the next time, which will be 9th till 23rd May...

    our case was completed at NVC on March 23rd. my question is now, will there be mentioned on the AVR that the files are forwarded to Frankfurt embassy or will I hear from Frankfurt right away? And when I hear from Frankfurt, will this be per email or per postal mail:

    Also I would like to know, my husband was unemployed for 12 weeks while the case was pending and AOS was sent with last taxreturns, but will start his job again next week, could I get problems at the interview because of that?

    I have a question about the activating trip.

    My husband filed I-130 for me and my daughter. NVC closed the case and will now send the files to Frankfurt / Germany, where we will have the interview.

    My questions now are the following:

    I will visit my husband again in May but I will move to the USA with my daughter in August, because she has to finish her year of school.

    That means, I will go to the US in May without my daughter.

    In case that I have the interview before May, can I activate my Visa without my daughter and then activate hers in August when we go there together, or do we have to activate the Visa together. In this case I will ask for an interview date after May.

    Hope anyone can answer my question

  8. Hi, we have a pending case, too and I just visited my husband in the US, well I am still here :-)

    Our case is at NVC right now and we sent the DS-230 and the I-864 out on Monday from the US.

    I was only asked for my purpose of visit and I said, I am visiting my family and friends. Then how long I would stay, and I said 10 days. Then she asked me if I have ever been to the US and I told her like 20 times or so. And thats it. No more question, have a nice stay, yeeeehaaa, and I had letters from my companies, from my landlord, also my booked ticket for May, but they didnt want to see anything, lucky me.

    I am in the Visa process too, our case is at the NVC now, my husband will send out the AoS on Monday and I am preparing to fill out DS-230 and am planning to visit the States on February 14th, I am planning to stay for 10 days before I have to go back to Germany.

    I will take the following binding ties:

    I have two employers, both gave me a letter, that I am on a holiday and they expect me back at work end of February. Also I have a letter from my landlords that I am still in a binding contract renting my flat.

    Also I booked a flight to the States in May and I will bring my e-ticket to prove that I will leave the States as said on my ticket and then re-enter in May to visit my husband again.

    Other than that I have my daughter at home in Germany, we filed for her immigration too, so they will hopefully know that I would never leave her alone in Germany. Also I think that it would not make sense going to the States illegal shortly before the Visa stuff is approved.

    To the original poster i would like to say, that there are not really any binding ties that you have to prove that you will go back after the 89 days. There is no job, no flat, no kid left and the time you want to stay in the States is so long.

    But as you filed the petition in August and from the timelines I read, you should not be long from being approved to the Visa. I have no clue if I would take the risk in this case, because its not long that you will be together anyways. Also, the beneficiary should be home when he gets the interview appointment.

    Well, you never know what the officers say, maybe you are lucky and they will let you in, who knows.

    But I have so many binding ties and I am still nervous if they will let me in.

    Whatever you guys do, I wish you good luck and hope you will be okay.

    and when you say, the K2s paperwork, what do you mean with it? i thought he just has to file the affidavit of support plus tax returns etc.

    So, if he sends the AOS for me and the paperwork, and a copy of the AOS for my daughter, what else do I have to send with it? what should be the other paperwork for my daughter? Does he have to send the tax returns once more? Or what else do you mean?

    I am totally lost. Sorry, just a blonde German woman...lol

    Or has K1 to do with the K1 Visa? Because we are not filing this, we are filing CR-I. We are already married.

  11. Affidavit of Support: K2's don't require their own separate I-864 with supporting documents (tax returns, etc). Make sure they are listed in section 9 of the K1's I-864, and provide a photocopy of the K1's I-864 with the K2's paperwork. You don't need to include copies of the supporting documents with the K2's paperwork. You won't get an RFE if you do happen to provide a separate I-864 with supporting docs for the K2. It's just not required.

    my husband is filling out the form I-864 for me and my 16 year old daughter.

    Our question is now:

    in line 9. it says: Do not include any relative listed on a separate visa petition

    We had to fill out a seperate form I-130 for me and my daughter and we have two case numbers.

    But if you fill out the AOS you will have to come to the addition of household members and if you fill out two forms that would be 4 and we are only 3.

    on one AOS there would be my husband and me..so two members

    and on the other AOS there would be my husband and my daughter...so two members

    and both AOS together would be 4 members...or are we just thinking wrong?

    Would be nice to get answers :-))

  13. Hi, I am Anja from Germany.

    My husband is filing the I-130 petition for me and my 16 year old daughter.

    Our case is already at the NVC and my husband is waiting for the I-864 package and I am waiting for the DS-230 form.

    So, I thought I would let you know, that NVC didn't like that I sent the form DS-3032 (Choice of Agent) for me and my daughter in one email and not separate.

    We have two case numbers and they wanted an extra mail. And also they told me that I have to do all the correspondence that I will send in the future separate for me and my daughter.

    Maybe that should be included into the step-by-step guide for I-130, because there is nothing mentioned at all there, what has to be done, if you are filing for more than one person.

    Nope, you got me wrong. My husband is going to file in July 2010, when we are there for a visit. We are planning to move there in July 2011, so about one year later, so that should give us plenty of time and should hopefully work, right?

    I am grateful that I found this page with the step by step instruction for the I-130 petition, which will probably help me a lot to get all the things in order.

    My name is Anja, I am German citizen, married to an American since March of this year.

    I am planning to move to the United States with my 15-years-old daughter in July 2011 and my husband is going to file the I-130 petition for me and her in July of this year, when we will be there the next time.

    I am sure I will have a lot of questions coming up and also maybe my husband. I am looking forward to meet people in the same situation.
