I am an American studying in the USA since Oct 2009 (until Mar 2011) but am a German resident of over 10 years. My husband (of 7 years) is still in Germany (British citizen, German resident) occaisionaly over to visit me on a 90 day tourist visa (visa waiver program). As I am still technically a German resident, can I petition for the I-130 in Germany while I am studying in USA?
