    I thought N-336 has to be filed and only if N-336 has been denied, then one can send her/his case to federal district court. Are you saying she doesn’t need to submit N-336 and go straight to district court?

    yes she worked most of the 2018. She submitted 1040 for the 2018 in place of the requested account & transcript for that tax year and USCIS says it is insufficient to prove that she has filed her taxes. What papers would you suggest her to submit along with her N-336?

    a friend of mine got a denial of N-400, due to the absence of tax account & transcript for one of the 5 years of filed taxes, which was filed in November 2021 but IRS is taking longer time to process her taxes, which is why she couldn’t submit them by the deadline. so she will be filing N-336. Her taxes for that specific year are still not processed by irs. Would you suggest to wait till irs processes her taxes and submit her N-336 along with the tax account & transcript for that year?

    If I submitted my petition to bring my brother to the States this year, how long would he have to wait till he can move here? I’m a US citizen. He is in Kyrgyzstan, married has children. We figured we’d try to bring him alone here first. We heard the wait period can be between 7-12 years and so we are thinking if its worth pursuing if the wait period is that long. Any information in relation to this is appreciated. Thank you. 

  5. Thanks, but here's one question I'm afraid they'll ask: "Why did you get married while on a tourist visa? Why did you not file for a fiancee visa like you're suppose to?". How am I suppose to answer that? We honestly just decided that it'd be really cool to get married one year since he proposed. So, 2 weeks later, we got married at the Town Hall. Would that be good enough as an answer? I didn't know all the rules of immigration prior to this!

    I got married while I was on a tourist visa though it was not the initial plan, it's just we figured it'd be the best way to go with when I was visiting the States. At the interview the officer didn't ask us why we didn't apply for fiance's visa. He just wanted to know how we met, developed our relationship and how we ended up getting married. he also asked about our parents and how they reacted to our relationship. I think they just want to know that you guys are not faking the relationship and marriage.

  6. We have received the letter with the interview date... April 27th :)

    Now the question is, how do you organise all the documents that you need to bring? Pictures, plane ticket confirmations, USCIS letters, all the other documents we need?

    I was thinking of putting the pictures next to the relevant trip, but the rest I`m not sure what to do with. Just collect everything and put it at the end of the file? Or should I put everyting in a date order?

    I don`t want to frustrate them because they can not find what they are looking for easily. Does anyone have any good tips?

    hey, good luck on your interview!

    Just organize it so YOU can find whatever they'll request at the interview. It's not like you bring everything and put it on their table. They'll ask one by one for anything they need. They might not ask for all of them like in our situation but I'd still bring them all, you never know.. At the interview don't be nervous and just take your time to find whatever paper they are asking for.

    Hello everyone!

    My name is Cristina and I've been reading this forum for a while now. This is my first post, though. I figured it was time for me to stop being a lurker and start being a joiner haha

    My main question is about the Lawrence, MA field office. Has anyone interviewed there? I was wondering what your experience was like since I just got my interview appointment NOA today!

    Also, after reading a few posts and timelines, I have another question. Is it normal that I received notice for "Initial Interview" before anything else? I mean, I had my biometrics done a week ago, but our I-130 still shows on the website as Initial Review. Some people even got their EADs before the interview, (if I'm not confusing information by now, after reading 7843872 immigration posts) so I'm wondering if my own timeline is a little wonky, giving me something to worry about, or if it's perfectly normal.

    It's only been 104 days since I sent in my first form, so I'm pretty happy that we have an interview scheduled already, but I was just wondering!

    it seems like you are doing fine. though I wonder why you haven't received your EAD first.. Did you send your EAD forms together with your AOS?

  8. We get married a week ago. Now we want to send all the documents out tomorrow. We don't have formal Marriage Certificate. The court will send us in 4-6 weeks.from the day we got married. My visa will expire in 10 days. So we want to send all the docs now. But we got a copy Marriage License. Can we use it instead of the formal Marriage Certificate???

    yes you can send copy of your marriage certificate. In the worse scenario they'll request it later on, or will ask you to bring with you originals to the interview.

  9. We have a child but our interview definitely did NOT think that was proof enough and asked for more. She wanted:

    - our lease together (in our case he wasn't on the lease so she wanted something saying we were both residents of the apartment if we had it)

    - insurance together (car and health)

    - receipts from buying our rings

    - joint bank statements showing we used the account

    - pictures (WITH the dates they were taken printed - NOT handwritten - on the back)

    - Anything else we had ... like letters, itineraries of trips we had taken together, etc.)

    yes, what you've put here would work. But don't freak out. Just submit whatever you have. Basically you have to prove you guys are living together and sharing responsibilities as a married couple.

    - If he listed you as his dependent in his tax returns, take those forms. He probably listed you as one of his dependants when you weren't working and so it means he had to take care of you financially. We put my name in my husband's tax return as dependent as I wasn't working at that time.

    - Pictures will work.

    - If you live together as your renter to write up a rent lease, it should work. Our renter wrote his rent lease on a piece of paper by hand and we had to sign it, but that was all; it wasn't even notarized or whatever.. So you can write up one of your own and bring it to the interview.

    - Do you share health insurance? add that one.

    When we brought all the papers they've written in their letter we had to bring for our interview, our interview officer hardly ever wanted to look at any of those papers. All he wanted to see our wedding photos, our rent lease and that's all. I guess he wanted to see our rent lease because at the time of applying for AOS we were living at friends' place and we submitted our applications with that address and with the affidavit from those friends telling that we are really living at their house and planning to move out when we can. But since we moved and got an apartment. Other than that he wanted to hear how we met, developed our relationship and how we got married. I think they can tell who's faking and maybe in that case they'll want to look at all your papers.

    - Having a child is a good proof, but they need to know that you guys are actually living together as a family if you are basing your AOS status on marriage.

    good luck and don't be nervous, if you guys are true - then they can't deny you.

Back then we didn't have his and his wife's pay stubs and work letters from their work, and so this time we are bringing something as a replacement for his pay-stubs and plus his wife's pay stubs together with their work letters. They gave us their W2 with their tax returns for 2010, and it shows they made less than what they made for the last year (I mean for 2009)... We are thinking not to bring their W2 and tax returns that we got just recently as in the interview letter it says submit them unless you have already submitted and we'd just tell them that we submitted them back in 2010, what do you think guys, will that work ok?

    we are back from Pittsburgh where we had our interview. I am getting my green card in two weeks. The officer just wanted to see our apartment rent lease and our wedding photos. None of the affidavit of support... He was super nice and just wanted to know how we met and developed our relationship and all that. On top of that we came about 45 minutes late for our interview because of the weather and traffic, but they still accepted us and the guy that does security check up on the 1st floor said it's ok, everyone was late.. It was such a relief after all that terrible trip.

    Cheer up all of you who are in the process of getting their status adjusted, things will go well, you just need to know what papers you need to turn in and in timely manner.

    Tomorrow we have our initial green card interview and we just received our co-sponsors' (both husband and wife) tax returns for 2010 along with their work letters. We've seem to have run into a bit of a problem with that though, as this past year they didn't quite make enough money to be co-sponsors (though they did before) and both of their work letters don't have all the required information in them (weekly, monthly and yearly pay information). The one work letter at least states their hourly wage, as the other just states how valuable they are to the company (though due to lake of work right now has been laid off until middle of March). We're not sure how to handle this and so any advise or help would be greatly appreciated!

    anyway, we moved to a new place and tonight we wanted to change our address online and when we were changing address for I-130 form we answered "spouse" where it asks a question "Person for whom you are filing", since I-130 was filled up by my husband (usc) & and underneath that thing we put my name where it says "if person is "self" the following fields are not required"... did we have to put my husband's name there since he's the one who filed I-130 form for me and so he's the one who's filing for his spouse? or should we just fill it up as if I am changing address for this form? the other 2 forms we filled up as if I am the one who is changing the address.. I don't know if anyone understands this all, not me, this is really complicated... I wonder if this is a big deal at all..

    another question I had - we filled out AR 11 form and changed address for all 3 forms we filed, is it all we have to do or do we have to send actual mail or call them? i've read some sent mails and some called, but on their site it says i have to fill out ar11 and change address for our forms and that's all.. what do we do?

    other than that the process is going smooth so far. had biometrics appointment last week & people were super nice there.

  14. why must i find a doctor? im confused. everyone else on here is sending their biometrics after the AOS forms.

    hi,

    go through your wife's passport once again. See if she has a visa sticker on her passport and a little white piece of paper with the information that tells when she entered the country and when it expires, that paper is called I-94. first you have to find out if she has her visa and then you need to understand what is VWP. Biometrics is also done when entering the country - like at the airport at the passport control they get finger prints before they put stamp on her I-94 and let her in the country, so maybe that's what you are reading here. But biometrics is not a medical test.

    After all if you still decide to do AOS for your wife, then here are the following forms to be filled out:

    1. Form I-130 - Petition for Alien Relative and supporting documents: your birth certificate, copy of your wife's birth certificate with translation attached (if it is in other than English), copy of her passport, including biographical page and I-94 front and back; and copy of marriage certificate; and money - fee for the form - they have new fees starting this month, go on their website and check the price.

    Form G-325A for you, with one color photo - put the photo in a plastic bag and put your name on it.

    Form G-325A for your wife with her 2 color photos - put it in a plastic bag and put her name on it.

    2. Form I-485 - Application to register Permanent Residence or Adjust Status and supporting documents: copy of your wife's passport, including biographical page, I-94 front and back; copy of your wife's birth certificate; copy of your marriage certificate; 2 color photos of your wife in a plastic bag with her name on it.

    3. Form I-693 - medical examination and vaccination record - Here is your favorite part - check online uscis.gov on the list of the doctors who can do this for you. Usually what happens is that you call him/her and that doctor can fax you a list of vaccinations that your wife needs to get; in our city we had department of health, where they did all the shots for free. after she gets all the required shots the people (in my case) of department of health will send the records to your doctor, and the doctor will call you and make an appointment. This doctor basically fills out the form, includes all vaccination records & puts them in one envelop, so when you come he hands it over to you. Before he gives it to you he'll give general medical check up to your wife - like checking blood pressure, measuring her weight, etc. Do not open the envelop he gives you - otherwise you might be asked to do the whole process all over again.

    4. Form I-864 this one is the time-consuming one, especially if your income doesn't meet their income requirements. If your income doesn't meet the requirements you'll need to find a co-sponsor; then you fill out this form anyway and your co-sponsor has to fill out the same form for himself/herself. The supporting documents would be: Tax returns for about 2 years, Copy of W-2, Pay stubs, letter from your work, your birth-certificate (& just anything you can find you believe will help to prove you have sufficient income). If you get a co-sponsor - he/she needs to submit about the same set of supporting documents; it gets complicated as you go, but you gotta come back here then.

    5. I-765 - Application for Employment Authorization and supporting documents are copy of your wife's I-94 front & back and 2 color photos.

  15. If you've received NOAs for the I-485,I-130, I-765, but NOT the biometrics appointment letter where exactly in the process are you?

    Does that mean your application is still being evaluated or does it mean the biometrics office is super busy.

    You first receive your NOAs and about a week later they will send you letter with biometrics appointment; your biometrics appointment will be held 2 weeks later after receiving that letter. and yes to both of your questions, your application is still evaluated and they are usually busy.

Finally got to talk to someone from USCIS who was nice but obviously didn't know.... she just said that if it was a problem they would let me know then i asked if i could speak to a supervisor and she said that noone of them were available at this time and to call back in 2 or 3 HOURS!!! ...Needless to say it wasn't helpful at all.

    it should not be a problem, you did not do anything wrong. if they needed your marriage certificate - they had to put it on your letter, and since they did not have it, it's not a problem.

    I had my biometrics last week and I also have my documents under my maiden name and changing it to my married name, but the lady at the biometrics didn't say anything about it.

    shouldn't worry about it, just let them know you want your name to be changed to your married name when at the interview just like that man said.
